Impact of redistricting

The Democratic-controlled Legislature passed a new House map on August 5, 2011, which was vetoed by Gov. Earl Ray Tomblin (D) for technical errors. On August 21, during a special session, the legislature approved revisions to the map, with the House voting 55-38 and the Senate voting 15-14. Tomblin signed the map into law on September 2. The number of single-member districts increased from 43 to 47 out of 67 districts. Three lawsuits challenging the House map were consolidated in a case argued before the West Virginia Supreme Court of Appeals, which upheld the maps by a vote of 4-1. In their opinion, the court stated, "Once the inquiry goes beyond equal representation (and certain other immutable, historically suspect, and objective criteria like race), other authorized or permissible redistricting factors like compactness, community interest, protection of incumbency, partisan advantage, single-member vs. multi-member, political boundary lines, and even contiguity in some instances, are just that – factors – that are properly part of the legislative balancing process, but only very rarely if ever can serve as the basis for a successful court challenge to redistricting legislation."[3][4]
Qualifications
Section 13 of Article 6 of the West Virginia Constitution states, "No person holding any other lucrative office or employment under this state, the United States, or any foreign government; no member of Congress; and no person who is sheriff, constable, or clerk of any court of record, shall be eligible to a seat in the Legislature."
