Michael Caputo (Democratic Party) was a member of the West Virginia State Senate, representing District 13. He assumed office on December 1, 2020. He left office on December 1, 2024.

Caputo (Democratic Party) ran for election to the West Virginia State Senate to represent District 13. He won in the general election on November 3, 2020.

Biography

Michael Caputo was born in Rivesville, West Virginia.[1] Caputo graduated from Rivesville High School in 1975.[2]

Elections for the West Virginia House of Delegates took place in 2014. A primary election took place on May 13, 2014. The general election was held on November 4, 2014. The signature filing deadline for candidates wishing to run in this election was January 25, 2014. District 50 is represented by three delegates. Incumbents Michael Caputo, Linda Longstreth and Timothy Manchin were unopposed in the Democratic primary. Barry Bledsoe, Phil Mallow and Bobbie Triplett II were unopposed in the Republican primary. Caputo, Longstretch and Manchin defeated Bledsoe, Mallow, Triplett and Michael Ray (L) in the general election.[7]

Caputo was re-elected to District 43. He defeated Republicans Travis L. Blosser, Lynette Kennedy McQuain,and Rick Starn. He was one of six candidates running for three positions in District 43 on the ballot in the November 2, 2010, general election. The top three vote-getters were elected.[11][12][13]

Noteworthy events

Battery charges filed against Caputo

Caputo was charged with misdemeanor battery after he charged through the door to the House chamber and injured a doorkeeper. He was also accused of pushing a delegate out of his way. The charges were later dismissed.[14]

“I have already apologized for losing my temper that day, but I certainly didn’t intend to physically hurt anyone and don’t believe I committed a crime,” Caputo said.[15]

Caputo made an initial court appearance on September 30, 2019.

On December 5, 2019, Caputo's lawyer filed a motion requesting legislative immunity. "[Caputo] was trying to enter the House chamber in an effort to carry out his privileges and obligations as a member of the House of Delegates,” the motion stated. “Because this legislative act committed within the legislative sphere is statutorily protected activity, [Caputo] cannot be prosecuted criminally based on allegations made in the criminal complaint.”[16]

On January 27, 2020, Judge Tod J. Kaufman dismissed the charges against Caputo on the grounds of legislative immunity. Kaufman wrote in the ruling, "[The] defendant was trying to enter the House chamber in an effort to carry out his privileges as a member of the House of Delegates. Because this legislative act committed within the legislative sphere is statutorily protected activity, defendant cannot be prosecuted criminally and will be shielded from the issuance of extraordinary writs with respect to his legislative acts."[14]
