Conditions of Sale

PRICES

All prices on flower, vegetable seed and accessory products are payable in Canadian funds. Recent changes in tariffs and counter tariffs on seed imported into the US may require us to change prices without notice.

MINIMUM ORDER VALUE

Please be advised our Minimum Order Value is now $150 before taxes & shipping ($19.95).

REMITTANCE

We will accept Visa, MasterCard and personal cheques, or money orders made payable to Stokes Seeds Ltd. Do not send cash in the mail because we cannot accept responsibility for its loss. Sorry - No C.O.D.’s or SASE. A $40 fee will apply for any NSF cheques.

CREDIT

All charge orders from our regular commercial grower customers, who have established credit with us, will be invoiced and are due 60 days from the invoice date. Interest will be charged on all overdue accounts at the rate of 2% per month, an annual rate of 24%.

NEW CREDIT

We cannot extend new credit by phone. Please write, call or visit our website for a credit application and supply us with two complete credit references. All new credit is limited to 60 days. All overdue accounts will be reviewed for future credit and interest will be charged at 2% per month or 24% per annum.

CASH DISCOUNTS

A 2% discount applies to all orders over $500, when a cheque accompanies your order. Discount is not applicable on credit card orders. This discount does not apply to special prices.

SALES TAX

Residents of AB, MB, SK, YT, NT, NU and BC please add 5% GST. Residents of NB, NS, NL, PE and ON please add applicable HST. QC add 14.975% TVQ

SHIPPING

Stokes Seeds reserves the right to ship via United Parcel Service ground service, Postal Service or truck whichever is most economical. Our method of shipping is prepaid within Canada. Residents of YT, NU and NT - all orders over 1 lb. are subject to additional shipping charge of $2.00 per lb. Orders under $500.00 are subject to a $19.95 shipping and handling charge.

Please allow approximately two weeks for delivery unless otherwise notified.

To ensure prompt and efficient delivery of your order please include your "911" or fire address if different from your postal address. For expedited services such as Next Day, 2nd Day, and

Purolator please call one of our telephone order representatives for a quote. Reminder - "No C.O.D.'s" or SASE. 

PALLET FEE:  A $15.00 per pallet fee will be applied to all orders shipped by LTL truck.

DAMAGED SHIPMENTS:  Only a small percentage of material is damaged during shipping, but be prepared to take action in order to receive proper credit or replacement.  
Customer service will assist you by filing a claim with the freight company and will need accurate information.  Please observe the following steps (exactly and promptly):

  1. Take time when unloading. Count the pieces. Look for any damaged goods. Ask the driver to note any shortage or damage on all copies of the freight bill.
  2. Immediately contact our office at  1-800-263-7233 and send a copy of the freight bill (with damage noted) within 10 days.
  3. Enclose a note indicating the name and quantity of each variety that is missing or damaged.

CORRESPONDENCE

If you have any reason to write or phone us about shortages or errors on your order - please provide us with your order number as shown on the pick list included with all orders.

DELIVERY

Orders under $500.00 are subject to a $19.95 shipping and handling charge. For prompt, efficient delivery of your order these charges MUST be included.

PRODUCT ILLUSTRATIONS

All color illustrations are copyrighted and are the property of Stokes Seeds® or their respective owners. Colors may vary in printing.

RETURNED ITEMS

All returns must be authorized by our main office for your account to receive credit. We have no control over the environment in which the seed is stored after leaving our premises. For the protection of all of our customers, we will not accept seed returns for any reason other than an error on our part in filling your order (please contact us at 1-800-263-7233 within 10 days). Opened containers cannot be returned for any reason. A 15% restocking and handling charge will be charged on all returns that were not an error on our part.

CROP FAILURES AND SUBSTITUTIONS

We are dealing with live products, many of which are harvested after our catalog has been printed. If a crop fails or develops a shortage, we reserve the right to pro-rate the item, substitute another item or refund your money. Please indicate your preference on your order.

TESTED FOR GERMINATION

All seed is tested for germination and vigor each year, before we sell it. We maintain our own seed testing department to ensure that only seeds of high germination will be supplied to our customers. Results of the most recent germination test of each stock are marked on all packages of flower and vegetable seed. Germination varies each year.

SUBSTITUTIONS

All items offered are subject to crop failure, shortages or other causes beyond our control. We will send the closest available substitute to complete your order unless you advise us otherwise.
