Local travel agency to pay $500K over misleading practices

A Wilkes-Barre Twp. travel agency has been ordered to pay a half-million dollar settlement to customers who were duped by “bait-and-switch” pricing and high-pressure sales tactics, according to the state Office of Attorney General.

Sundance Vacations, at 264 Highland Park Blvd., also misrepresented sweepstakes programs to its customers and must in the future clearly disclose upfront all costs associated with its travel packages, prosecutors said.

“Sundance misled Pennsylvanians into thinking that they were getting significant bargains on pricey vacations, when, in reality, Sundance was just hiding the final bill,” Attorney General Michelle Henry said in a statement. “Bait and switch pricing will not be tolerated in Pennsylvania, and this settlement ensures the deceptive practices employed by Sundance end today.”

Prosecutors said the company presented slideshows for potential customers advertising “30 vacations for $15,000,” hiding the true costs of the vacation packages.

In addition to misrepresenting the cost of the vacation packages, the company misled customers about the price of competitor packages, failed to provide consumers adequate opportunities to review written materials, engaged in high-pressure sales tactics and misrepresenting the characteristics of sweepstakes prizes, prosecutors said.

In doing so, Sundance violated the Unfair Trade Practices and Consumer Protection Law, prosecutors said.

“Sundance Vacations is a small family-owned company, and we are confident in our business practices,” a spokesperson for the company said in a statement.  “While we strongly disagree with the OAG, we have decided to settle this five-year inquiry as it has significantly impacted our business and personal lives. Two prior Pennsylvania AGs had already reviewed our business practices and took no action. This settlement underscores our continued commitment to voluntarily do what is right for our customers.”

Under terms of the settlement, certain customers can cancel their contracts within 30 days. Customers who choose to cancel will be relieved of all outstanding financial obligations to Sundance, and their loans will be reported as paid in full to the credit bureaus.

Certain customers who already filed complaints will get their money back, and other eligible customers could get refunds if they file a complaint with the Office of Attorney General before May 16.
