Marty J. Jackley (Republican Party) is the Attorney General of South Dakota. He assumed office on January 2, 2023. His current term ends on January 4, 2027.

Jackley (Republican Party) ran for election for Attorney General of South Dakota. He won in the general election on November 8, 2022.

Jackley was the 30th attorney general of South Dakota from 2009 to 2019. A Republican, he was appointed to the position by Governor Mike Rounds (R) on August 14, 2009, to fill the vacancy left by Larry Long who had been appointed to the Second Judicial Circuit Court. Jackley was sworn into office on September 4, 2009, and was elected to a full term in 2010.[1] He served until January 2019.

Jackley was a Republican candidate for governor of South Dakota. He lost the primary on June 5, 2018.

Biography

Marty J. Jackley graduated from Sturgis High School in 1988.[2] Jackley earned a B.S. in electrical engineering from the South Dakota School of Mines and Technology in 1992 and a J.D. from the University of South Dakota in 1995. His career experience includes working as a partner with Gunderson, Palmer, Nelson & Ashmore, LLP; a special assistant attorney general with the state of South Dakota, and a United States attorney with the South Dakota United States Attorney's Office.[2][3]

Affordable Care Act lawsuit (2010)

Jackley was one of 13 state attorneys general who initiated a 2010 lawsuit challenging the constitutionality of the Patient Protection and Affordable Care Act. The suit argued that the individual mandate fell outside of the federal government’s authority and that the requirement for state Medicaid expansion of coverage violated state sovereignty. The case was ultimately heard before the Supreme Court, which ruled to uphold the individual mandate as falling within Congress’ authority to levy taxes and struck down the Medicaid expansion as being unduly coercive in light of the withholding of funding that would result from noncompliance.[4]
