The Attorney General of North Dakota is an elected executive position in the North Dakota state government. The attorney general is the chief legal counsel and adviser to the state government. He or she acts as the representative of the state, its interests, and its people in legal proceedings, as well as issues opinions on questions of law.[1] The attorney general is popularly elected every four years in midterm elections and is not subject to term limits.[2]
North Dakota has a Republican triplex. The Republican Party controls the offices of governor, secretary of state, and attorney general.
Current officeholder
The current Attorney General of North Dakota is Drew Wrigley (R). Wrigley assumed office in 2022.
Authority
The North Dakota Constitution establishes the office of attorney general in Article V, Section 2:
The qualified electors of the state at the times and places of choosing members of the legislative assembly shall choose a governor, lieutenant governor, agriculture commissioner, attorney general, auditor, insurance commissioner, three public service commissioners, secretary of state, superintendent of public instruction, tax commissioner, and treasurer. ...[2] |
Term length
The four-year term length was established after an initiated constitutional amendment on the 1964 ballot was approved. Prior to this, the term length was two years.[2]
Qualifications
Article V, Section 4 of the North Dakota Constitution establishes the qualifications to hold the office of attorney general:[2]
- a qualified North Dakota voter
- at least 25 years old
- a resident of North Dakota for at least the five preceding years
- licensed to practice law in North Dakota
To be eligible to hold an elective office established by this article, a person must be a qualified elector of this state, must be at least twenty-five years of age on the day of the election, and must have been a resident of this state for the five years preceding election to office. To be eligible to hold the office of governor or lieutenant governor, a person must be at least thirty years old on the day of the election. The attorney general must be licensed to practice law in this state.[2] |
Vacancies
Article V, Section 8 addresses vacancies in state executive offices. In the event of a vacancy, the governor nominates a successor who must be confirmed by the state Senate. Once confirmed, the individual serves the remainder of the unexpired term.[2]
Elections
The attorney general in North Dakota is popularly elected every four years in midterm elections, such as 2018, 2022, and 2026. The term of office is four years.[2]

2010 On November 2, 2010, Wayne Stenehjem won re-election to the office of North Dakota Attorney General. He defeated Jeanette Boechler (D) in the general election.
2006 On November 7, 2006, Wayne Stenehjem won re-election to the office of North Dakota Attorney General. He defeated Bill Brudvik (D-NPL) in the general election.
2004 On November 2, 2004, Wayne Stenehjem won re-election to the office of North Dakota Attorney General. He defeated Bruce Schoenwald (D-NPL) in the general election.
2000 On November 7, 2000, Wayne Stenehjem won re-election to the office of North Dakota Attorney General. He defeated Glenn Pomeroy (D-NPL) in the general election.

Duties
As the chief legal officer in the state, the attorney general represents and defends the interests of North Dakota and its people in both civil and criminal actions. Chapter 54-12 of the North Dakota Century Code outlines the specific duties of the office:
- represents the state before the supreme court in all cases in which the state is interested as a party
- represents state officers, agencies, boards and commissions
- advises the governor, state officers and state's attorneys
- provides written opinions on all legal or constitutional questions not addressed in current state law
- acts as the superintendent of the bureau of criminal investigation
Additionally, the attorney general is a member of the North Dakota Board of University and School Lands, the Industrial Commission, the Drug and Alcohol Commission, the Judicial Council and the Pardon Advisory Board.[1]

Compensation

The attorney general, along with the rest of North Dakota's state executive officers, is legally entitled to an annual salary in accordance with Title 54 of the North Dakota Century Code. Taking into account value adjustments, the statute contains compensation figures for the previous and current year only.[5] The attorney general's pay may not be increased or diminished effective during the current term.[2]

In 2022, the officer's salary was $165,630, according to the Council of State Governments.[6]

In 2021, the attorney general received a salary of $163,394, according to the Council of State Governments.[7]
2020
In 2020, the attorney general received a salary of $159,409 according to the Council of State Governments.[8]

In 2019, the attorney general received a salary of $157,009 according to the Council of State Governments.[9]
2018
In 2018, the attorney general received a salary of $157,009 according to the Council of State Governments.[10]

In 2016, the attorney general received a salary of $152,436 according to the Council of State Governments.[12]

In 2013, the attorney general was paid an estimated $138,159. This figure comes from the Council of State Governments.[15]
