How vacancies are filled in Wisconsin
If there is a vacancy in the Wisconsin State Legislature, a special election must be held to fill the vacant seat.[1] The governor can call for an election when allowed by law. The election cannot be held after February 1 before a spring general election, unless it is held on the same day of the election, which is the first Tuesday in April. The same requirement applies to any election preceding the fall general election (after August 1), with the exception of elections held on the first Tuesday in November.[2] Also, all vacancies must be filled quickly as long the vacancy happened before the second Tuesday in May during an election year.[3]

The Wisconsin State Legislature is the legislative branch of Wisconsin. It is a bicameral legislature composed of the lower Wisconsin State Assembly and the upper Wisconsin State Senate. It is based in Madison, Wisconsin.

A special election for Wisconsin State Senate District 8 was held on April 4, 2023. Daniel Knodl (R) defeated Jodi Habush Sinykin (D) with 50.9% of the vote to Habush Sinykin's 49.1%. Wisconsin State Senator Alberta Darling (R) retired on December 1, 2022. Darling’s retirement reduced Senate Republicans' 22-member supermajority to a 21-member majority.[4] Republicans regained a supermajority in the state Senate after Knodl won the election. As of the election, a party with a two-thirds supermajority in the Senate could suspend Senate rules and impeach state officials.[5] A primary was held on February 21, 2023, and the candidate filing deadline was January 3, 2023.[6] Leading up to the Republican primary, The New York Times reported that the Democratic Party of Wisconsin mailed postcards and aired TV ads that promoted Janel Brandtjen's (R) candidacy. One ad said, "On Abortion, Republican Janel Brandtjen Is As Conservative As They Come."[7][8] The ad also called her a "Conservative Pro-Trump Republican."[7][8] Wisconsin Assembly Republicans removed Brandtjen from the Republican caucus on November 11, 2022. The notice of removal said, "Yesterday, at our caucus, the members voted to no longer allow you to participate in closed caucus. The continual issues from the past have led our caucus to lose trust in you. For this reason, this vote was taken."[9][10] Brandtjen said in a statement that "I will continue to represent the 22nd Assembly District and address the issues my constituents have told me are important to them, including voting integrity, with the same determination I have in the past."[11] General electionSpecial general election for Wisconsin State Senate District 8Daniel Knodl defeated Jodi Habush Sinykin in the special general election for Wisconsin State Senate District 8 on April 4, 2023.

A special election for Wisconsin State Assembly District 24 was held on July 18, 2023. A special primary was held on June 20, 2023. The candidate filing deadline was May 23, 2023.[12] The seat became vacant after former incumbent Daniel Knodl (R) resigned on May 3, 2023. Knodl resigned after being elected to Wisconsin State Senate District 8 in the April 4, 2023, special election.[12] General electionSpecial general election for Wisconsin State Assembly District 24Paul Melotik defeated Bob Tatterson in the special general election for Wisconsin State Assembly District 24 on July 18, 2023.

The partisan breakdown for the special elections was as follows:
- 33 Democratic seats
- 20 Republican seats
As of December 1st, 2024, Republicans controlled 55% of all state legislative seats nationally, while Democrats held 44.12%. Republicans held a majority in 56 chambers, and Democrats held the majority in 41 chambers. Two chambers (Alaska House and Alaska Senate) were organized under multipartisan, power-sharing coalitions.
