Section 240 of New York State Labor Law, also known as the “Scaffolding Law,” protects the rights of construction workers who suffer a fall or are struck by a falling object. This legal requirement mandates construction site owners and contractors to provide scaffolding and other safety equipment that affords proper protection for workers.

These unique types of cases require careful preparation with settlement as the goal. The Hon. Paul J. Baisley, Jr. (Ret.) and Michael B. Titowsky, Esq. will provide guidance and offer tips on navigating the settlement of these matters. They will address how best to approach these types of mediations by answering questions such as how to increase chances of success, how to respond to, and hopefully move past, an impasse, and will also provide tips on proper preparation, submissions and what a mediator is looking for to facilitate a resolution.

Meet NAM's Presenters

The Honorable Paul J. Baisley, Jr. is a retired Justice of Supreme Court, Suffolk County, and is a member of NAM's (National Arbitration and Mediation) Hearing Officer Panel. For 25 years, Judge Baisley presided over and settled more than a thousand cases, giving him a broad range of experience and knowledge across numerous case types including commercial, employment, insurance, labor law, fraud, matrimonial, medical malpractice, negligence, personal injury, premises liability, and real property/real estate (commercial and residential). Judge Baisley is known and respected for his legal acumen and his ability to resolve conflict in an unbiased manner. He is available to arbitrate and mediate cases throughout New York State.

Michael B. Titowsky, Esq. is a member of NAM's (National Arbitration and Mediation) Hearing Officer panel and is a highly experienced attorney who has focused the majority of his legal practice representing clients in litigation and private mediation focusing on personal injury and labor law matters. Throughout his 40-year legal career, he has represented clients throughout the New York Metropolitan area in thousands of cases, both in court litigations and private mediations. Prior to joining NAM, Mr. Titowsky was a partner in a prominent New York law firm. During his 29-year tenure with the firm, he handled a variety of personal injury related matters including high-exposure NY labor law, premises liability, motor vehicle, general liability, insurance coverage/indemnity, and medical malpractice cases from inception to trial and appeals. Mr. Titowsky is available to mediate and arbitrate cases throughout New York State.
