The Civil Section is a state mandated service of the Sheriff’s Office.
Purpose & Function
The Civil Section’s purpose and function is to serve and execute the various legal processes issued not only by and for the several non-criminal courts of the state and its subdivisions, but also for the legal community and the general public. Departmental and divisional policies and procedures are consistent with New York State and court case law. These policies are designed and developed to insure the accurate, expeditious, and judicious service and execution of all matters relating to civil process.
Service of Process
The Civil Section requires advance payment for each Service of Process. In addition, there may be fees to levy, seize, inventory, transport, store, protect, preserve and dispose of property taken into custody of the aforementioned processes.
Service of Papers
The Civil Section serves numerous papers, including but not limited to:
- Income Executions
- Notices
- Orders and Mandates
- Property Executions
- Seizures
- Subpoenas
- Summons and Complaints
- Warrants of Evictions
Eviction Enforcement
Should you require an eviction enforced, landlords are asked to complete a Cayuga County Sheriff’s Department Enforcement of Eviction form (PDF). This form should be returned to the Civil Section along with fees, the original Warrant and 3 copies of the Warrant per person being evicted.
Accurate Information
All work is based on the information you provide, therefore the more accurate, detailed and copious the information, the more likely we are to succeed. A post office box is not an acceptable address as we cannot serve a post office box.
Special Information
Any information regarding officer safety issues, the elderly or infants, animals, etc. must be conveyed when the work is delivered.
Legal Counsel
It is recommended that all litigants obtain competent legal counsel when necessary. The Sheriff cannot give legal advice. The Sheriff’s Office does not supply forms, nor can we complete them. There are several suppliers or publishers of legal forms available on line or consult the telephone directory.
