Fontfabric End-User License Agreement (“FF EULA”)

A Fontfabric End-User License Agreement (“FF EULA”) states all specifications, conditions, mandatory rules, obligations and limitations when a Licensee (and/or Licensee client(s) when working for hire) must follow when purchasing or downloading Fontfabric Fonts (Software).

Once a Fontfabric End-User License Agreement (“FF EULA”) is issued:

Fontfabric Desktop License

A Fontfabric Desktop License allows a Licensee to install Fontfabric Fonts (Software) on a desktop computer and use them in editing software such as Adobe Illustrator, Photoshop, InDesign, etc.

What is a Fontfabric Desktop License?

A Fontfabric Desktop License allows a Licensee to utilize Fontfabric Fonts (Software) for the majority commercial use-cases, such as: creating graphical designs of logos, print materials, signs, etc. and/or producing offline merchandise for both personal and client use.

A Fontfabric Desktop License is based on the number of Desktop Users (either a single person or a single device) that are going to work with Fontfabric Fonts (Software).

What can a Licensee do with a Fontfabric Desktop License?

  • A Licensee CAN (✓) use Fontfabric Fonts (Software) within desktop applications such as: TextEdit, Microsoft Word, Mac Pages, Adobe Photoshop, Adobe Illustrator, etc.
  • A Licensee CAN (✓) use Fontfabric Fonts (Software) to create and distribute static images on any surface, including computer and TV screens, paper and physical products in raster formats (.JPEG, .TIFF, .PNG, etc.) and vector formats (.EPS, .SVG, etc.)
  • A Licensee CAN (✓) use Fontfabric Fonts (Software) to create non-editable documents (.PDF, .DOC, DOCX, etc.)

Fontfabric Desktop License restrictions:

  • A Licensee CAN NOT () send editable documents embedding Fontfabric Fonts (Software) only if the documents are created for in-house use or if they are sent to Third Parties, working on Licensee behalf and in accordance with the Fontfabric Desktop License.
  • A Licensee CAN NOT () send documents embedding Fontfabric Fonts (Software) to any other Third Parties if they’re not in a secure read-only non-editable format such as .PDF that does not permit the extraction of any embedded Fontfabric Fonts (Software).
  • A Licensee CAN NOT () embed static images into an electronic document with a representation of a Fontfabric Fonts (Software) so long as such images are not used as a replacement of Fontfabric Fonts (Software) as stated in the issued Fontfabric License.
  • A Licensee CAN NOT () exceed the number of licensed users installing Fontfabric Fonts (Software) that is stated in the issued Fontfabric License.
  • A Licensee CAN NOT () distribute Fontfabric Fonts (Software) under a Fontfabric Desktop License to clients. In such cases, Licensee clients must acquire their own Fontfabric Desktop License.

Usage of a Fontfabric Desktop License is constrained by the number of “Desktop Users” / devices allowed to utilize Fontfabric Fonts (Software). Essentially, the Fontfabric Desktop License permits a Licensee to install Fontfabric Fonts (Software) on a desktop computer to use with the wide array of offline applications allowed.

What is a Desktop User?

Essentially, a “Desktop User” is a single person (or a single desktop device) that uses Fontfabric Fonts (Software).

What are font Page Views?

Page Views quantify the number of users accessing Licensee web pages monthly.

A simple definition for Page Views can relate to a user viewing a web page on a website or online platform. Think of Page Views as requests to load a single page on a website that indicate how many times a font is served.

How to check / measure Page Views and license the correct quantity?

The best way to track unique Page Views is through specialized analytics technology.

If your website is still in development and you don’t have visitors’ data yet, go with the lowest number of monthly Page Views and adjust your Fontfabric Webfont License as your numbers grow.

If the total traffic of websites or online platforms utilizing Fontfabric Fonts (Software) and measured in Page Views per month, exceed the monthly count specified in the issued Fontfabric Webfont License for two consecutive months, a Licensee must update the initial Fontfabric Webfont License.

Fontfabric Webfonts License and other Fontfabric Licenses:

Selecting fonts for web copy differs from using fonts for desktop publishing or word processing applications. In web design, it is not sufficient to simply highlight a block of text and apply a font or style in the same manner as with desktop applications.

There are rare instances where a Fontfabric Webfonts License does not impose traffic restrictions but instead operates within specific timeframes or domains.

Fontfabric App License restrictions?

  • A Licensee CAN NOT () redistribute Fontfabric Fonts (Software) together with an app’s source code
  • A Licensee CAN NOT () install Fontfabric Fonts (Software) to the operating system on which the app(s) runs
  • A Licensee CAN NOT () embed Fontfabric Fonts (Software) in an app that enables end-users to create custom typesetting with Fontfabric Fonts (Software).
  • A Licensee CAN NOT () use Fontfabric Fonts (Software) under a Fontfabric App License for additional uses, such as: desktop use, website templates distribution, product creation websites, e-books, and digital ads.
  • A Licensee CAN NOT () install Fontfabric Fonts (Software) on servers, broadcast it on cable television or the Internet without the appropriate Fontfabric License or a Custom Fontfabric End-User License Agreement.

It’s the Licensee responsibility to monitor Monthly Active Users (or total downloads) and update the Fontfabric App License as user numbers grow.

Similar considerations apply to ePub formats (digital books, e-magazines, etc). 

Be cautious of licensing terms in similar cases, as you a Licensee may be required to re-license Fontfabric Fonts (Software) when updating and releasing a new version of a e-book, or obtain a fresh Fontfabric License for each new issue of an e-magazine. 

Additional requirements, such as readership numbers and timescales, may also be specified. Thoroughly review your needs of Fontfabric Licensing before purchasing to make sure a use case is compliant.

How does the Fontfabric ePub License work?

A Licensee can use a Fontfabric ePub License to embed Fontfabric Fonts (Software) in electronic publications such as e-books, e-magazines, e-newspapers, interactive PDFs, or other formats of digital publishing.

The Fontfabric ePub License is based on the number of separate and distinct electronic publications where Fontfabric Fonts (Software) are or will be embedded. Each issue of an electronic publication counts as a separate electronic publication.

Important: Regional or format variations do not count as a separate electronic publications.

Permissions to a Fontfabric ePub License:

  • A Licensee CAN (✓) embed Fontfabric Fonts (Software) into an electronic publication (commercial use included) and distribute it worldwide to end-users in a secure manner that does not allow end-users to access Fontfabric Fonts (Software) outside of the electronic publication.
  • A Licensee CAN (✓) embed Fontfabric Fonts (Software) with a file format that protects Fontfabric Fonts (Software) by means of encryption or obfuscation (safe formats: PDF, EPUB 2.01, EPUB3, KF8, etc.).

Restrictions to a Fontfabric ePub license:

  • A Licensee CAN NOT () have an electronic publication as an executable file for uses different than display by e-reader software or read-only devices.
  • A Licensee CAN NOT () install Fontfabric Fonts (Software) on the operating system on which the an electronic publication runs
  • A Licensee CAN NOT () use a Fontfabric ePub License for: desktop use, website use, website templates distribution, product creation websites, and digital ads

What is a Fontfabric Server License?

The Fontfabric Server License allows a Licensee to install Fontfabric Fonts (Software) on a server that the Licensee owns or controls.

The Fontfabric Server License is based on the number of central processing units (CPU) or servers on which the font is installed. A Fontfabric Server License comes with specified duration, and the Licensee might be required to obtain a license for each CPU on your server stack. However, development servers don’t count towards this.

The Licensee may use Fontfabric Fonts (Software) on development servers for internal development(s) only.

The Fontfabric Broadcasting License refers to anything related to using Fontfabric Fonts (Software) for onscreen broadcasting via television, film, or video and specifically for dynamic text which is used for titling, credits, etc.

Why is font licensing an ethical issue?

Font licensing is a contentious issue, made more confusing by intellectual property laws on typefaces. Basically, in the USA, font files are protected by copyright, but font renderings are not. In other words, it’s illegal to redistribute fonts, but it’s legal to “reverse-engineer” them by printing them out on graph paper and designing the curves to match the printout.

However, reverse engineered fonts are typically cheap and freely available but of poor quality. Perhaps one of the most offensive things about the nature of font piracy is that it artificially devalues the work of type designers, as there is no due credit given.
