American politicians are calling on Russia to be charged with war crimes at the International Criminal Court. The only problem is the U.S. has been dodging accountability for its own alleged war crimes for decades. So, how do both Russia and the U.S. get away with it?

‘Netanyahu, a war criminal, is speaking at the UN’
“The United Nations should be ashamed of itself. They’ve let their own staff down.”
Writer and activist Ashish Prashar blames the UN for allowing Israeli Prime Minister Benjamin Netanyahu to speak at the General Assembly.
He tells TRT World that Netanyahu is a “war criminal who has targeted hundreds of United Nations employees” in Gaza, Lebanon and the occupied West Bank.
Since the beginning of Israel’s war on Gaza, nearly 300 humanitarian aid workers, more than two-thirds of them UN staff, have been killed.

Rules of War in a Nutshell - script
Since the beginning, humans have resorted to violence as a way to settle disagreements.
Yet through the ages, people from around the world have tried to limit the brutality of war.
It was this humanitarian spirit that led to the First Geneva Convention of 1864,and to the birth of modern International Humanitarian Law.
Setting the basic limits on how wars can be fought, these universal laws of war protect those not fighting, as well as those no longer able to.
To do this, a distinction must always be made between who or what may be attacked, and who or what must be spared and protected.

Most importantly, civilians can never be targeted. To do so is a w...

4:50 How are War Crimes Proven?
5:58 How are War Criminals Punished?
The concept of "the rules of war" goes back a long time, but only recently did most of the world agree on how wars should be conducted. This is known as International Humanitarian Law and it's made up of a patchwork of different treaties and conventions, like the Geneva Conventions which were created after WWII.
Because International Humanitarian Law is pulling from a number of different sources, not all countries agree on every single law within it. They may recognise one convention, but not another - but pretty much every country recognises the core ideas of minimising suffering and protecting people not involved in the fighting.
So, what are the different types of war crimes? The Rome Statute breaks it down into 3 different categories: War Crimes, Crimes Against Humanity and Genocide - there's a bit of overlap, but they're largely separate.
War crimes are when you break the rules of war during an armed conflict, and there are a lot of different crimes that fall under this category (killing civilians, torture and taking hostages, denying medical care, attacking historical monuments, forcing people to leave their homes).
It's not just what you do during a conflict, but also how you conduct yourself when you’re actually fighting (child soldiers, using civilians as human shields - e.g. firing missiles from inside a crowded school, so your enemy can't retaliate).
There's also something called collective punishment (punishing a group of people because you suspect some might be enemies). Then there’s the use of certain weapons. They may be considered inhumane because they cause unnecessary suffering, or it could be because they’re indiscriminate, not targeted, and likely to cause collateral damage & harm civilians.
A war crime can be the death of just one person, whereas crimes against humanity are often organised campaigns with the aim of killing or torturing or displacing a large group of civilians over a period of time. Another big difference is that crimes against humanity don’t need to take place during a conflict. Think Apartheid in South Africa, or the way that Joseph Stalin used to make his political opponents disappear in the Soviet Union.
The final category is genocide. What separates genocide from Crimes Against Humanity is that the end goal needs to be the complete destruction of an entire group of people. Genocide also doesn't technically have to involve killing. It could take the form of trying to starve a group of people, or taking away their children.
When it comes to proving war crimes, Human Rights groups play a big role in the collection of evidence. That can involve interviewing witnesses and survivors, working with local organisations and journalists, and going through huge amounts of photos and videos to try to reconstruct events.
Human Rights Groups create detailed reports and pass them on to international bodies or governments, or use them to pursue legal action.
Prosecuting war criminals in court, is challenging for a number of reasons. Proving a war crime has taken place can be straightforward, but linking it to an individual, can be very tough. Also, it’s often not possible to go to court in the country where the crime was committed, because the country may still be at war, or it may be the government that has committed the crime.
There are international tribunals and courts like the ICC, but its powers are limited because not every country recognises its authority. Another option are the domestic courts of countries that have universal jurisdiction (e.g. France in 2014, convicting Pascal Simbikangwa for his role in the Rwandan Genocide).
Actual war crime convictions aren't all that common, but that doesn't mean that the work of Human Rights Groups goes to waste. Detailed reports and evidence can lead to international pressure, and travel bans on war criminals. Early reporting on war crimes can also sometimes help to stop a conflict from escalating, and it can lead to support and assistance for victims of war crimes and make sure that the crimes committed against them aren't forgotten. - Story by Nicholas Maher

********
Rules of War in a Nutshell - script
Since the beginning, humans have resorted to violence as a way to settle disagreements.
Yet through the ages, people from around the world have tried to limit the brutality of war.
It was this humanitarian spirit that led to the First Geneva Convention of 1864,and to the birth of modern International Humanitarian Law.
Setting the basic limits on how wars can be fought, these universal laws of war protect those not fighting, as well as those no longer able to.
To do this, a distinction must always be made between who or what may be attacked, and who or what must be spared and protected.
- CIVILIANS -
Most importantly, civilians can never be targeted. To do so is a war crime.
“When they drove into our village, they shouted that they were going to kill everyone. I was so scared, I ran to hide in the bush.
I heard my mother screaming. I thought I would never see her again.”
Every possible care must be taken to avoid harming civilians or destroying things essential for their survival.
They have a right to receive the help they need.
- DETAINEES -
“The conditions prisoners lived in never used to bother me.
People like him were the reason my brother was dead.
He was the enemy and was nothing to me.
But then I realized that behind bars, he was out of action and no longer a threat to me or my family.”
The laws of war prohibit torture and other ill-treatment of detainees, whatever their past.
They must be given food and water and allowed to communicate with loved ones. This preserves their dignity and keeps them alive.
- SICK & WOUNDED -
Medical workers save lives, sometimes in the most dangerous conditions.
“Several fighters from both sides had been critically wounded in a fierce battle and we were taking them to the closest hospital.
At a checkpoint, a soldier threatened us, demanding that we only treat his men. Time was running out and I was afraid they were all going to die.”
Medical workers must always be allowed to do their job and the Red Cross or Red Crescent must not be attacked.
The sick or wounded have a right to be cared for, regardless of whose side they are on.
- LIMITS TO WARFARE -
Advances in weapons technology has meant that the rules of war have also had to adapt.
Because some weapons and methods of warfare don't distinguish between fighters and civilians, limits on their use have been agreed.
In the future, wars may be fought with fully autonomous robots.
But will such robots ever have the ability to distinguish between a military target and someone who must never be attacked?
No matter how sophisticated weapons become it is essential that they are in line with the rules of war.
International Humanitarian Law is all about making choices that preserve a minimum of human dignity in times of war, and makes sure that living together again is possible once the last bullet has been shot.

A new documentary from Al Jazeera takes a look at evidence of war crimes in Gaza in the form of social media posted by Israeli soldiers recording and celebrating their own attacks on Palestinians. We play excerpts from the film Investigating War Crimes in Gaza, now available online, and speak to two of the journalists involved in its production, director Richard Sanders and Gaza-based correspondent Youmna ElSayed. “Israelis themselves were telling us precisely what they were doing and why they were doing it,” says Sanders about the evidence the team reviewed. “They don’t think it’s complicated. They don’t think it’s nuanced. Their rhetoric is often overtly genocidal.” ElSayed adds, “They’ve had all the courage to do that because...

Mossad's Deadliest Mission: The Hunt for al-Wazir | Real Crime
After the Mother's Bus Attack, where armed individuals took over a bus near Israel’s Dimona nuclear facility and killed three people, Israeli intelligence identified Abu Jihad, a leader of the Palestinian Liberation Organization (PLO), as the person behind the attack. Defense Minister Yitzhak Rabin ordered his assassination, leading to a carefully planned operation by the elite military unit Sayeret Matkal in Tunis, where Abu Jihad lived. The commandos used surveillance and smart tactics to reach his villa and successfully carried out the mission, even though they had an unexpected encounter with his wife. While Israel did not officially take credit for the operation, it received a lot of media attention and sparked discussions about its impact on the ongoing conflict in the region.

Israeli soldiers ‘tiktoked’ war crimes: Filmmaker Richard Sanders on new Al Jazeera film
“All uploaded under their real names and ranks” is how award-winning journalist Richard Sanders describes the Israeli soldiers' social media posts, which serve as key evidence in his latest Al Jazeera documentary. In a conversation with Middle East Eye columnist Peter Oborne, Sanders explains how these videos reveal acts of destruction and mistreatment of civilians in Gaza, exposing potential war crimes.
The film explores a trove of over 2,500 social media accounts of Israeli soldiers, shedding light on shocking footage that Sanders calls “the first live-streamed genocide in history.” The documentary also features testimonies from brave Al Jazeera journalists in Gaza, juxtaposing the soldiers’ posts with the harsh reality on the ground.

"They Identified Themselves!" Israeli Forces Proudly Exhibit Their War Crimes | Richard Sanders
A groundbreaking new Al Jazeera documentary exposes the horrific war crimes and sadistic activities carried out by Israeli soldiers during its ongoing genocide in Gaza over the last year and reveals the identities of the perpetrators.
But director Richard Sanders says finding information about the soldiers was not difficult because “they identified themselves” - many of the soldiers had actually uploaded the footage to their personal social media pages and sometimes even to their online dating profiles.
Richard Sanders is a British journalist and award-winning filmmaker who also directed Al Jazeera's The Labour Files and October 7 documentaries.

A deliberate, man-made famine is underway in Gaza, according to many human rights experts. Starving Gaza is a new documentary by Al Jazeera English's Fault Lines investigating how Israel has killed civilians seeking aid and attacked humanitarian networks. The harrowing film is based on the work of Palestinian reporters in Gaza who are suffering the same conditions as their subjects. "They've been displaced, they've been injured, they've watched their own children die in front of them, and yet they somehow conjure the professionalism to pick up a camera and record and tell other people's trauma," says journalist Hind Hassan. "They really will be remembered in history as the titans of journalists."

Ahmed Alnaouq is a Palestinian journalist from Gaza.

“Putin’s Attack on Ukraine: Documenting War Crimes” draws on original footage; interviews with Ukrainian citizens and prosecutors, top government officials and international war crimes experts; and a vast amount of previously unpublished evidence obtained and verified by the AP — including hundreds of hours of surveillance camera videos and thousands of audio recordings of intercepted phone calls made by Russian soldiers around Ukraine's capital city, Kyiv.
From award-winning director Tom Jennings, producer Annie Wong, AP global investigative reporter Erika Kinetz and her AP colleagues, the 90-minute documentary traces a pattern of atrocities committed by Russian troops in Ukraine, focusing on areas near Kyiv, such as Bucha, where some of the most shocking carnage was found.
FRONTLINE and the AP uncovered exclusive evidence that links possible war crimes in Bucha through the chain of command to one of Russia’s top generals — evidence that prosecutors hope might help build a case against Russian President Vladimir Putin in court. But the joint investigation also explores the challenges of trying to hold Putin and other Russian leaders to account.
