London City Council v. Allen | Ann.Cas.1916C 932 (1914)
A municipality plans to build a road, but landowners break a covenant, so the municipality takes a detour to court in London County Council versus Allen.
Morris Allen owned two parcels of land and made a covenant, or agreement, with the London County Council, promising not to build on the land unless the council consented. The council planned to build public roads on the land. A few years later, Allen conveyed one parcel to his wife, Emily. A man named Norris acquired an interest in Emily’s parcel when she got a mortgage from Norris. Emily built three houses on her parcel. Around the same time, Allen built a wall on the other.
The council filed a writ against Allen, Emily, and Norris, and asked the court to enforce the covenant and force them to tear down the houses and wall. Emily and Norris argued that the council didn’t own any parcels touching the property, which could have created an easement. As a result, Allen and the council’s covenant only applied to Allen. Also, both Emily and Norris argued that the covenant didn’t apply to them because they were bona fide purchasers who didn’t receive notice of the covenant when they received title. The court held that Emily and Norris failed to prove they lacked constructive or actual notice of the covenant. On the argument that the council didn’t own any connecting land, the court reasoned that, because the council was responsible for building public roads, the covenant ran with the land, applying to any owners. Allen, Emily, and Norris appealed.
