The Georgia Court of Appeals is the intermediate appellate court in Georgia. It was established in 1906 and has five divisions with three judges each. According to information provided by the court's official source:

The Court of Appeals has statewide appellate jurisdiction of all cases except those involving constitutional questions, murder, and habeas corpus cases where original appellate jurisdiction lies with the Supreme Court. The Court of Appeals may certify legal questions to the Supreme Court.[1]

The fifteen judges on the Georgia Court of Appeals are chosen in nonpartisan elections to serve six-year terms. If they wish to continue serving, they must run for re-election.[4]

Qualifications

To serve on this court, a judge must be:

  • a resident of Georgia; and
  • admitted to practice law for at least seven years.[4]

Chief judge

Judges of the Georgia Court of Appeals serve as chief judge on generally a two-year rotating basis, based on seniority. The chief judge of the court has the authority given by statute to appoint a presiding judge for each of the five divisions of the court.[5]

Vacancies

If a vacancy appears on the court, the position is filled by assisted appointment. The governor chooses an appointee from a list of qualified candidates compiled by the judicial nominating commission. As of March 2023, the judicial nominating commission consisted of 35 members, each appointed by the governor. For each court vacancy, the commission recommends candidates, but the governor is not bound to the commission's choices and may choose to appoint a judge not found on the list.[6] If appointed, an interim judge must run in the next general election held at least six months after the appointment, and, if confirmed by voters, he or she may finish the rest of the predecessor's term.[4][7][8]

Ethics

The Georgia Code of Judicial Conduct sets forth ethical guidelines and principles for the conduct of judges and judicial candidates in Georgia. It consists of four overarching canons:

  • Canon 1: "Judges shall uphold the independence, integrity, and impartiality of the judiciary and shall avoid impropriety and the appearance of impropriety in all of their activities"
  • Canon 2: "Judges shall perform the duties of judicial office impartially, competently, and diligently"
  • Canon 3: "Judges shall regulate their extra-judicial activities to minimize the risk of conflict with their judicial duties"
  • Canon 4: "Judges shall refrain from political activity inappropriate to their judicial office"[9][1]

History

The Georgia Bar Association first proposed the Georgia Court of Appeals in 1895. The association launched a campaign to secure an intermediate court between trial courts and the Georgia Supreme Court. Eleven years after the first proposal a bill to submit to the electorate an Amendment to the State Constitution creating a Court of Appeals and defining its jurisdiction was approved almost unanimously by the Georgia legislature. The amendment went on to be ratified by the electorate on October 3, 1906. The Supreme Court maintained final appellate jurisdiction in capital felonies, and its precedents were binding to the Court of Appeals, but certain civil cases are given final appellate jurisdiction over certain civil cases.[5]

Presidential voting pattern

Georgia voted Republican in five out of the six presidential elections between 2000 and 2020.

Pivot Counties (2016)

Ballotpedia identified 206 counties that voted for Donald Trump (R) in 2016 after voting for Barack Obama (D) in 2008 and 2012. Collectively, Trump won these Pivot Counties by more than 580,000 votes. Of these 206 counties, five are located in Georgia, accounting for 2.43 percent of the total pivot counties.[11]

Pivot Counties (2020)

In 2020, Ballotpedia re-examined the 206 Pivot Counties to view their voting patterns following that year's presidential election. Ballotpedia defined those won by Trump won as Retained Pivot Counties and those won by Joe Biden (D) as Boomerang Pivot Counties. Nationwide, there were 181 Retained Pivot Counties and 25 Boomerang Pivot Counties. Georgia had five Retained Pivot Counties, 2.76 percent of all Retained Pivot Counties.
