Daniel Gallegos was a judge for Division XV of the New Mexico 2nd Judicial District Court. Gallegos assumed office in 2019. Gallegos left office on December 31, 2020.

Gallegos (Republican Party) ran for re-election for the Division XV judge of the New Mexico 2nd Judicial District Court. Gallegos lost in the general election on November 3, 2020.

Gallegos was a Republican judge of the New Mexico Court of Appeals. He assumed office in 2018. Gallegos ran for re-election to the seat but lost in the general election on November 6, 2018. He left office on December 31, 2018.

Education

Gallegos received his J.D. from Notre Dame Law School.[1]

Career

At the time of his appointment to the bench, Gallegos served as a staff attorney with the New Mexico Court of Appeals and as a staff judge advocate for the United States Navy Reserve Judge Advocate General's Corp. He was previously an assistant district attorney in the Crimes Against Children Division of the Second Judicial District Attorney’s Office, an assistant district attorney in the Thirteenth Judicial District Attorney’s Office, and a deputy command judge advocate for the United States Navy Judge Advocate General’s Corps.[1]

Selection method

The 10 judges of the New Mexico Court of Appeals are chosen by assisted gubernatorial appointment. A new appointee must stand in the next partisan election after his or her appointment. If a sitting judge wishes to serve additional terms, he or she must compete in an uncontested retention election and receive at least 57 percent of the vote.[2] In the event of a midterm vacancy, the governor appoints a replacement from a list of qualified candidates recommended by the judicial nominating commission. The newly appointed judge must run in the next general election to serve out the remainder of the unexpired term. To win further full terms, the judge must stand for retention by voters thereafter.[2]

Qualifications

To serve the court of appeals, a judge must:

  • be the minimum age of 35;
  • have practiced law for the ten years preceding assumption of office;
  • be a state resident of at least three years preceding assumption of office.[2]

Selection of the chief judge

The chief judge of the court of appeals is selected by peer vote to serve a two-year term.[2]
