Alabama is first state to seek ban on gender-affirming treatments for children

The state of Alabama has called on a federal court to uphold a ban on so-called gender-affirming medical treatments for transgender youths, citing a recent Supreme Court ruling that allowed state governments to prohibit abortions.
In a 76-page brief filed with the 11th US Circuit Court of Appeals on Monday, Alabama Attorney General Steve Marshall insisted that a previous injunction on the state’s ban of transgender treatments should be overturned, since such care is not protected under the 14th amendment to the US Constitution as it is not “deeply rooted in the nation’s history and traditions.”
“The Legislature determined that transitioning treatments in particular are too risky to authorize, so it is those treatments Plaintiffs must show the Constitution protects,” the brief says. “But no one –adult or child– has a right to transitioning treatments that is deeply rooted in our nation’s history and tradition.”
The state’s argument closely resembles the reasoning behind the recent US supreme court decision to overturn Roe v. Wade, which removed federal abortion protections and placed the responsibility for legalizing or banning the procedure on individual states and their citizens.
Supreme Court judges that ruled in favor of overturning the legislation argued that terminating a pregnancy was not a fundamental constitutional right because it was not explicitly mentioned in the US constitution and was not “deeply rooted in this nation’s history and tradition.”
In the brief, Marshall goes on to insist that the Constitution reserves to the state, and not courts or medical interest groups, the authority to determine that “sterilizing interventions” are too dangerous for minors, adding that the State has a right to regulate or prohibit such interventions for children “even if an adult wants the drugs for his child.”
The Attorney General also noted that research regarding these “novel interventions” was poor and that they were unproven to offer lasting relief to children suffering from gender-related distress. “What research does exist is already outdated – a remarkable fact given that the seminal study on transitioning children was published less than a decade ago and has not been replicated,” he added.
Marshall also drew attention to the fact that gender-related distress has become “a tsunami” as clinics offering “‘transitioning’ treatments on kids are seeing their patient loads increase by thousands of percent,” noting that the new trend was “troubling.”
In April, Alabama governor Kay Ivey signed into law a bill which made it a felony to provide gender-affirming treatments to minors, and sought a 10-year prison sentence and a $15,000 fine for anyone providing puberty blockers, hormones or surgical procedures to transgender youths under the age of 19.
However that legislation was partially blocked one month later by a federal judge, who dismissed the state GOP leader’s claim that puberty blockers were “experimental,” and insisted that transitioning medications were “well-established, evidence-based treatments for gender dysphoria in minors” endorsed by “at least 22 major medical associations.”
Americans’ Rejection of Coronavirus Shots Is a Reason for Hope for the Country

For over a year, Americans have been subjected to relentless pressure to take experimental coronavirus “vaccine” shots and, more recently, to even have the shots given to children who have a miniscule risk of becoming seriously sick or dying from coronavirus. The shots are widely available, free for the taking, and nonstop marketed by politicians, government bureaucrats, and people in the media as “safe and effective.”
But, many Americans have been smartly rejecting claims pushed on them by government and media. Americans have done their own investigating and found that the shots have known serious dangers, as well as additional likely serious dangers yet unknown because of the lack of proper examination of consequences of taking the rushed into distribution shots. Many Americans have also learned that the shots do not stop people from getting, spreading, and dying from coronavirus. Plus, many Americans know people who have been hurt by the shots.
A large percentage of Americans have just said no to the drug pushers from the beginning. So strong has been the conviction of many individuals against taking the purported miracle drugs that they have said “no” even though it means they will be fired from their jobs due to vaccine mandates and excluded from many activities due to vaccine passports.
Many other Americans, who took the initial shots after giving in to the pushers or after giving the pro-shots propaganda the benefit of the doubt, have since declared, “no more.” Some were hurt by the shots they took and do not want to go through more of the same or worse. Others investigated the shots, learning about the drugs’ safety and efficacy deficits. Others, who never bought the propaganda in the first place but allowed themselves to be pushed into the initial shots, are adamant in their rejection of more.
You will not find much objective discussion in the big money media about the safety and efficacy of the experimental coronavirus vaccine shots. But, you will find recognition that resistance to the vaccine push has been strong and widespread, even if the topic is brought up just to belittle the resisters. One example of that recognition is a Tuesday Associated Press article by Mae Anderson that begins with the following observations regarding the Americans choosing to decline taking the shots:
The COVID-19 booster drive in the U.S. is losing steam, worrying health experts who have pleaded with Americans to get an extra shot to shore up their protection against the highly contagious omicron variant.
Just 40% of fully vaccinated Americans have received a booster dose, according to the Centers for Disease Control and Prevention. And the average number of booster shots dispensed per day in the U.S. has plummeted from a peak of 1 million in early December to about 490,000 as of last week.
Also, a new poll from The Associated Press-NORC Center for Public Affairs Research found that Americans are more likely to see the initial vaccinations — rather than a booster — as essential.
‘It’s clear that the booster effort is falling short,’ said Jason Schwartz, a vaccine policy expert at Yale University.
Overall, the U.S. vaccination campaign has been sluggish. More than 13 months after it began, just 63% of Americans, or 210 million people, are fully vaccinated with the initial rounds of shots. Mandates that could raise those numbers have been hobbled by legal challenges.
Vaccination numbers are stagnant in states such as Wyoming, Idaho, Mississippi and Alabama, which have been hovering below 50%.
It seems to be quite frustrating for the big money media and authoritarians in government that so many Americans are choosing to make up their own minds not to take the shots, or not to allow the shots to be given to their children, instead of just doing as they are told. That exercise of independent decision making in the face of intense pressure to go along, though, reassures people who highly value freedom that there is yet hope for the country.

US Prison Population Shrinking; States Ready to Sell Extra Prisons

In what some experts say may be the beginning of the end for mass incarceration, the U.S. prison population declined for the third year in a row last year.
In 2012, the prison population shrunk by 1.7% (or 27,770 inmates), according to the Bureau of Justice Statistics (BJS).
The third consecutive yearly drop in prisoner numbers has been the result of fewer crimes and changes in state correctional policies. Many states are now relying more on probation and parole instead of locking people up.
Although the percentage decline might seem small, the fact that it followed decreases in 2011 and 2010 indicated the country is undergoing a “sea change” in criminal justice policy.
“This is the beginning of the end of mass incarceration,” Natasha Frost, associate dean of Northeastern University’s school of criminology and criminal justice, told The New York Times.
Before 2010, the U.S. prison population increased every year for 30 years, from 307,276 in 1978 to a high of 1,615,487 in 2009.
The decline has not affected federal prisons, which are seeing record numbers of prisoners.
At least 17 states are selling or are considering selling some of their underutilized prisons. For example, in Pennsylvania, the state is looking to sell off two prisons that were recently emptied and shut down. A 40-building prison in Cambria County and a 32-building correctional facility in Westmoreland County are among 37 surplus state properties listed for sale.
According to BJS, 47% of prisoners have been incarcerated for non-violent crimes, such as property offenses, drug offenses and public order offenses.
Louisiana had the highest percentage of its population in prison last year, 893 per 100,000 state residents. In second place was Mississippi (717 per 100,000 state residents), followed by Alabama (650 per 100,000 state residents), Oklahoma (648 per 100,000 state residents), and Texas (601 per 100,000 state residents).
Maine had the lowest imprisonment rate (145 per 100,000 state residents), followed by Minnesota (184 per 100,000 state residents), and Rhode Island (190 per 100,000 state residents).
