AFFIDAVIT FILED BY THE CAVEATOR

I, Chundru Srinivasu son of Kondala Rao, Hindu, Aged 42 years, cultivation,

Samalkota do hereby solemnly and sincerely affirm and state as follows:-
1. I am the caveator herein and well acquainted with the facts of the case. I submit and
pray that the Hon'ble court may be pleased to read the plaint in O.S.No.1408 of 2001 along
with applications therein filed by me as part of this affidavit.
2. I submit that I filed I.A.No. 3437 of 2001 in O.S.No.1408 of 2001 on the file of
Principal Junior Civil Judge, Kakinada. Along with the suit the Hon’ble Principal Junior Civil
Judge, Kakinada was pleased to grant interim injunction and the said petition has been
allowed on 19.1.2002 by Hon'ble Principal Junior Civil Judge, Kakinada and made the
interim injunction absolute. Inspite of the interim injunction the defendants tried to disturb
my possession and then I filed I.A.No. 3552 of 2001 for grant of police aid. The said
petition was allowed by orders dated 19.1.2002. I am apprehending that the respondents
may initiate revision before the Hon'ble High Court and obtain exparte order by
misrepresenting the facts of the case since few days. We are ready to appear through our
advocate. If the respondents obtain any exparte order, we will be put to irreparable loss.
3. Hence, in the interest of justice I submit and pray that the that the Hon'ble court may
be pleased to lodge the caveat and

or going to be filed against the order and decree dated 19.1.2002 in I.A.No. 3552 of 2001

Kakinada before granting exparte order by the Hon'ble court to caveator's advocate Sri
V.L.N. Gopala Krishna Murthy, Advocate, 106 Expresso Apartments, A Block, Laka-di-ka-
pool, Hyderabad. Else I suffer serious and irreparable loss.

For the reasons stated in the accompanying affidavit the caveator prays that the
Hon'ble court may be pleased to lodge the caveat and order notice on all miscellaneous
applications filed or going to be filed in any Revision filed or going to be filed against the
order and decree dated 19.1.2002 in I.A.No. 3552 of 2001 in I.A.No. 3437 of 2001 in
O.S.No.1408 of 2001 on the file of Principal Junior Civil Judge, Kakinada before granting
exparte order by the Hon'ble court to the caveator’s counsel V.L.N. Gopala Krishnamurthy
