Mistaken identity is a defense in criminal law which claims the actual innocence of the criminal defendant, and attempts to undermine evidence of guilt by asserting that any eyewitness to the crime incorrectly thought that they saw the defendant, when in fact the person seen by the witness was someone else. The defendant may question both the memory of the witness (suggesting, for example, that the identification is the result of a false memory), and the perception of the witness (suggesting, for example, that the witness had poor eyesight, or that the crime occurred in a poorly lit place).
Because the prosecution in a criminal case must prove the guilt of the accused beyond a reasonable doubt, the defendant must convince the jury that there is reasonable doubt about whether the witness actually saw what he or she claims to have seen, or recalls having seen. Although scientific studies have shown that mistaken identity is a common phenomenon, jurors give very strong credence to eyewitness testimony, particularly where the eyewitness is resolute in believing that their identification of the defendant was correct.
Mistaken Identity is the debut solo album of American guitarist and Living Colour-member Vernon Reid, released in June 1996 on Sony Music-imprint label 550 Music. It features contributions from his backing band Masque, and production was handled by Reid, hip hop producer Prince Paul, and jazz producer Teo Macero. The album's title was inspired by Reid's experience with cultural identity in his life.
Mistaken Identity is the fifteenth studio album by Donna Summer, released in 1991.
Since making her name as the biggest female star of the disco era in the 1970s, Summer had experimented with different musical genres throughout the 1980s with varying degrees of success. For Mistaken Identity, Summer adopted a more urban style. The first released single "When Love Cries", peaked at number 77 on the US Billboard Hot 100. Once again her vocal prowess is on display with tracks like "Cry of A Waking Heart", "Friends Unknown", and "Heaven's Just A Whisper Away".
Before the release of the album, New York magazine printed an article about alleged statements Summer had made back in 1983, which cast her in a homophobic light. Summer, who had always denied making the statements, held a press conference in regards to the article printed, and again denied ever making the statements. She sued the magazine (50 million) for libel. The case was settled out of court but the damage had been done.
