John Austin's Command Theory of Law and Legal Positivism
Today's stream returns to philosophy of law. We're discussing John Austin's command theory of law, a species of legal positivism. Austin articulated one of the first modern theories of legal positivism, which claims that the existence of a law depends on certain descriptive social facts and not on the moral merits of that law. For Austin, a law was a command made by a sovereign that was backed by sanctions.
We'll take a look at Austin's 1832 work The Province of Jurisprudence Determined (Lectures 1 and 6), in which he makes his arguments for his particular command theory of law. We'll see how he categorizes laws, including divine and human law, as well as what commands, sanctions, and sovereignty are on Austin's theory.
Finally, we'll take a look at how Austin's theory was critiqued by...

Hart - Concept of Law - Ch 2 (Summary of John Austin's Theory of Law)
I am writing a book! If you want to know when it is ready (and maybe win a free copy), submit your email on my website: https://www.jeffreykaplan.org/
I won’t spam you or share your email address with anyone.
This is the first video lecture in a course on the philosophy of law. In this chapter, Hart summarizes John Austin's habit- and sanction-based theory of law. Austin's behaviorist (or very nearly behaviorist) theory of law is presented by the introduction and step-by-step adaptation of a simple gunman scenario. The concepts of internal supremacy and external independence are also explained by Hart. These are the notions that make up Austin's conception of sovereignty.

This is a video lecture about legal positivism (the theory in analytical jurisprudence, which holds that legal facts depend ultimately on social facts alone) and non-cognitivism (the theory in metaethics, which holds that moral judgements are not truth-apt). The work of Joseph Raz and HLA Hart is discussed. This is part of a course on the Philosophy of Law.

LAW121 - Positivist Legal Theory
In contrast to natural law theorists, legal positivists assert that laws are merely a compendium of rules designed by a sovereign (usually the state) for the regulation of society. It is NOT, they suggest, a universal moral code to which we must submit. In fact, laws retain their validity irrespective of their perceived (im)morality, so long as it is properly made (pedigree) by the recognised law-making authority. People do not obey the law because they feel morally inclined to do so, rather because they respect the legitimacy of the law-making body and fear that the state's coercive forces (police, prosecutors, etc.) will punish them if they do not.
If this is so, how do we distinguish between good law and bad law? Must we obey all laws simply because the state tells us to? What if the...

Ultimately, we will see how Austin laid the groundwork for later legal positivists like Hans Kelsen and H.L.A. Hart, and how even this early form of legal positivism helped inform the work of critical political theorists like Karl Marx and Max Weber and American Legal Realist jurists like Oliver Wendell Holmes Jr.

What if the law calls for behaviour that we consider immoral? How do we reconcile our legal duty with our moral preferences?

Hello Friends!
In today’s Video Lets start with Basics of Jurisprudence!

1. Analytical School
2. Philosophical School
3. Historical School
4. Sociological School
In chaaron Schools of Jurisprudence ka main difference ye hai - ki how do they Define Law - What is Law? However, Each School of Jurisprudence has a place of its own in connection with the particular law out of which it grows!
ANALYTICAL SCHOOL - The main aspect of this School is ‘Relationship of Law with State’
Main Exponents of this School are Jeremy Bentham and John Austin. Both are popularly Known as the Fathers of Analytical School.
Jeremy Bentham in his book ‘Limits of Jurisprudence Defined’ said that State`s objective is to provide and ascertain Maximum Liberty and Maximum Happiness - This is Known as Doctrine of Utility. According to Bentham, the Ultimate End of Law is "Greatest Happiness of Greatest Number” and the Ultimate Purpose of Law is "To Bring Pleasure and Avoid Pain” - To eradicate hurdles on the Freedom of Human Being - this means that Bentham was a supporter of Laissez Faire - ‘Let the Men Free’
John Austin is known as the Father of Analytical School of Jurisprudence
His Lectures are accumulated in the name of 'Province of Jurisprudence Defined’ - According to him "Law is a Rule laid down for the Guidance of an Intelligent Being By an Intelligent Being having Power over him”
Law is a Command by the Sovereign backed by Sanction.
Anything that is not a Command is not a Law.

Hello Friends!
In today’s Video Lets start with Basics of Jurisprudence!
Mainly there are 4 Schools of Jurisprudence:
