Under Hague definitions, the removal of a child is wrongful where:
The removal is in violation of the rights of a person or entity under the laws of the state or country where the child was habitually residing immediately prior to the removal and retention
At the time of removal or retention, the custodial rights were actually exercised, or would have been exercised if the child had not been removed or retained

The removal is in violation of the rights of a person or entity under the laws of the state or country where the child was habitually residing immediately prior to the removal and retention
At the time of removal or retention, the custodial rights were actually exercised, or would have been exercised if the child had not been removed or retained
For purposes of these definitions, the rights of custody or possession may come from operation of law, a judicial or administrative decision, or by an agreement which has the appropriate legal effect.
The determining factor in applying international custody rules is the habitual residence of the child. This is where all of the evidence will be presented to a court. The Hague Convention applies to any child who was a habitual resident in a contracting country (a country which has signed the Hague Convention) immediately before any breach of custody or access rights. But the Hague Convention does not apply after the child reaches 16 years of age.
A big aspect of the Hague Convention is that the signatory countries to the treaty cooperate with each other. The contracting countries to the Hague Convention each have a central authority and have agreed to cooperate with the other countries for the return of a child. The true extent of that cooperation, in practice, depends on the country.
Hague proceedings are also meant to be quick. The judicial or administrative authorities of contracting states are mandated to act expeditiously for the return of children. Generally, they are to be resolved in six weeks.
Filing quickly when a child has been removed from his/her habitual residence country is also important. If a proceeding for the return of a child is started within one year of that child’s removal, the foreign authority should order, if appropriate, the return of the child without delay.
But, of course, there are some defenses to the return of a child. The Hague Convention states that a court is not bound to order the return of the child if the person or entity that opposes its return establishes that:
The custodial person or entity wasn’t exercising custody rights or consented (or acquiesced) to the removal or retention of the child
There is a grave risk that the child’s return would expose that child to physical or psychological harm or otherwise place the child in an intolerable situation
The foreign country may also refuse to return a child if doing so would violate the fundamental principles of that country’s protection of human rights and fundamental freedoms.
The court, in addition to acting quickly, does not determine the merits of a child custody case, only which country should be the one to make that determination. Under the Hague Convention, after receiving notice of a wrongful removal or retention of a child, the judicial or administrative authorities of the contracting state to which the child has been removed or in which he or she has been retained shall not decide the merits of rights of custody until it has been determined that the child is not to be returned under the Convention or unless an application under the Convention is not filed within a reasonable time.

Hi, it’s Mac Pierre-louis, houston attorney and mediator. The topic in this video is the international treaty known as the hague convention on the civil aspects of international child abduction. This hague convention is an international treaty in which about 100 member countries sign and agree to partner together and follow a set of rules on how to return children back to their home countries, when those children are allegedly abducted from the home country or illegally retained in the other country.

Houston, being a large and diverse international city, has a high number of family law court cases where children living in Houston become the subject of international custody fights started by parents living in foreign countries trying to get their child to be returned home.
“Inbound” hague cases like this Houston example, typically begin when one parent living in a foreign Hague country files a hague application through their countries’ Central Authority office, requesting help for the U.S. state department and local lawyer to help track down a child and facilitate the child’s return back to the child's home country.
“Outbound” hague cases such as where a US child is taken to a Hague country works in reverse where the US parent submits a hague application to the US state department for submission foreign countries central authority office so that office can facilitate the return of the child. It may be helpful to have a local attorney on the ground in the foreign country to help return the child.
There are plenty of countries known as non-hague convention countries, such as many countries in Africa and Asia. For example, parents of children from Nigeria, India, or mainland China may not get the benefit of the Hague convention treaty, because those counties have not yet approved the treaty. It may prove really difficult for a US parent to get their child back home to the states from a non hague country. Parents of children who may be taken to a non-hague country should be sure they have a custody order that addresses international travel to such countries.

Countries such as the United States, Canada, Mexico, the European countries, most of Latin america, now accept this hague convention treaty and those countries do what they can to help find a child and return that child to their home country, also known as the place of “habitual residence”
Houston, being a large and diverse international city, has a high number of family law court cases where children living in Houston become the subject of international custody fights started by parents living in foreign countries trying to get their child to be returned home.
“Inbound” hague cases like this Houston example, typically begin when one parent living in a foreign Hague country files a hague application through their countries’ Central Authority office, requesting help for the U.S. state department and local lawyer to help track down a child and facilitate the child’s return back to the child's home country.
“Outbound” hague cases such as where a US child is taken to a Hague country works in reverse where the US parent submits a hague application to the US state department for submission foreign countries central authority office so that office can facilitate the return of the child. It may be helpful to have a local attorney on the ground in the foreign country to help return the child.
There are plenty of countries known as non-hague convention countries, such as many countries in Africa and Asia. For example, parents of children from Nigeria, India, or mainland China may not get the benefit of the Hague convention treaty, because those counties have not yet approved the treaty. It may prove really difficult for a US parent to get their child back home to the states from a non hague country. Parents of children who may be taken to a non-hague country should be sure they have a custody order that addresses international travel to such countries.

The UAE is not a signatory to the Hague Convention. Within UAE laws, there are no statutory provisions specifically dealing with child abduction.
Summarize the Position in Your Jurisdiction
UAE Personal Status Law for Muslims: Post-divorce, if the custodian of the child is other than the child’s mother, he or she must obtain a written agreement from the guardian before taking the child out of the UAE. If such permission is withheld by the guardian, the custodian may obtain permission for the child’s travel from a judge (Article 149 Personal Status Law).
The guardian of a child has the right to hold the child’s passport for safekeeping but must hand the passport over to the custodian when it is required for the child’s travel. Furthermore, the judge may order the passport to be kept with the custodian if they experience difficulty dealing with the guardian when the passport is requested (Article 157 Personal Status Law).
UAE Civil Personal Status Law for non-Muslims: Custody is shared on an equal basis even post-divorce (Article 10 Civil Personal Status), and in case of any dispute related to joint custody, such as possession of passports of the child, the parents can request an intervention of the court.
Under What Circumstances May a Parent Apply to Remove Their Child from the Jurisdiction Against the Wishes of the Other Parent?
UAE Personal Status Law for Muslims: The custodian of the child may not permanently settle the child in another country if it would cause harm to the other parent, and if the distance between the two countries prevented the non-resident parent from visiting the child and returning home in one day (Article 151 Personal Status Law).
If the guardian can prove that his residence in the UAE has expired due to valid reasons such as the end of his employment or due to any other reason, that the court will not find arbitrary, the court may allow the guardian to take away the children and the mother will have the choice to join them.
UAE Civil Personal Status Law for non-Muslims: If one parent wishes to remove the child from the jurisdiction against the wishes of another, he or she may submit an application to the court for the same, and the court will decide the matter based on the child’s best interests (Article 10 Civil Personal Status).
