REPORT OF CONSTITUTIONAL
REVIEW COMMITTEE (2013)
In 2009, a nine-member committee under the John Mark Bekui
led administration started a review of SRC constitution with the
hope of establishing a written document that would meet
contemporary demands. On the 19th of January 2013, are'
committee was set up with the approval of the executive
committee of the SRC under the Edmond Kombat
administration purposely for the recommencement
the 2009 review of the constitution of the SRC. The re committee
comprised major stakeholders who were involved in the
operationalizing of the SRC constitution.

The review saw some few significant changes mainly regarding

the establishment of nine Junior Common Rooms (Halls of
Residence) which were not recognized by the SRC constitution.

We believe that this review would go a long way at enabling the
SRC seek the welfare and interest of the student body of Ghana
in general and this University in Particular.

REPORT OF CONSTITUTIONAL
REVIEW COMMITTEE (2009)
The John-Mark Bekui led Administration (SRC 2009/2010)
appointed a nine-member Constitutional Review Committee
with the approval of the General Assembly of the SRC to collect
proposals and to review the SRC Constitution to enable it meet
contemporary demands. The Constitutional Review Committee
comprised the under listed students of University of Ghana:

The committee co-opted Mr. Godwin Tamakloe, a law student as

a member.
In the pursuit of its work, the Constitutional Review Committee

duly invited proposals from the general student body and all
stakeholders who have been involved in operationalizing the
SRC Constitution. Several meetings between the Committee
and other strategic stakeholders of the SRC were held. These
included meetings with Committee Chairpersons, SRC
Executive Officers, JCR Presidents of the traditional Halls of
affiliation, members of the General Assembly, distance learning
students, ordinary students, to mention but a few.
The proposals which were in both written and oral forms were
duly considered by the Constitutional Review Committee at
arriving at the current reviewed Constitution.
The review saw very significant changes in many provisions of

the Constitution. It is the belief of the Committee that the
present reviewed Constitution would go a long way at ensuring
that the SRC is brought to the door steps of the ordinary student
while also ensuring institutional strengthening, which is critical
to the realization of the aims and objectives of the SRC.
Significant changes were made to the following Chapters:

Chapter 2
Composition of the SRC
The composition of the SRC has been defined to include all
persons who are in "statu pupillari" of the University of Ghana.
Explicit mention has been made of the fact that all students of
University of Ghana Accra City Campus, Graduate School of
Nuclear and Applied Physics, College of Health Sciences, all
distance learning students of University of Ghana as well as
students of the Main Campus are all members of the SRC.
This explicit definition of the composition of the SRC is very
important especially at a time when the University recognizes
only the Main Campus SRC in its scheme of things.
This is equally important as it would ensure a more formidable
and united front of students who would no: be making parallel
demands.
Chapter Three
The composition of the General Assembly has been re-
examined and reviewed appropriately to have a mud wider
representation of students at the General Assembly of the SRC; a
body of the SRC of University of Ghana which takes very critical
decisions affecting all students of this university. The General
Assembly now has more members. The composition of the
General Assembly has been broadened to include
representation from students with Special Needs, Distance
Learning students, ant representations from University of
Ghana Accra City Campus, Graduate School of Nuclear and
Applied Physics as well as representations from the various
colleges, faculties and schools in this university.

Another major change in the students' governance system is

the decoupling of the SRC President as the Chairman of the
General Assembly. A new independent leadership of the
General Assembly has been created to among others, promote
the level of confidence of students in the General Assembly,
promote probity and accountability of the SRC leadership as
well as avoid the inevitable conflict of interest situations that
often arise with the SRC President doubling as chairman of the
General Assembly.
In view of the fact that the SRC President is no longer chairman
of the General Assembly, chairpersons of some specified
committees have been made members of the General Assembly
to promote the business of the SRC.
Chapter Four
The Executive Committee of the SRC has been modified in terms
of its composition to include representations from
faculties/colleges/schools, University of Ghana Accra City
Campus, Graduate School of Nuclear and Applied Physics and
Distance Learning students.
The office of SRC Vice Secretary has been expunged. A Clerk has
been provided for who would take down minutes and other
correspondence of the General Assembly. The Clerk of the
General Assembly is not a member of the General Assembly and
the Executive Committee unlike the Vice Secretary who used to
be a member of these bodies.
A more detailed procedure for appointing the Legal Advisor to

the SRC as well as the qualifications of the said office has also -
been provided for. The Legal Advisor is made a member of the

General Assembly though without a voting right. The rationale

is to make the legal Advisor readily available to give legal advice
to the General Assembly, while promoting the neutrality of that
office.
Chapter Five
Removal from office
In addition to the already existing provisions on removal from
office, provisions have been adequately made for the removal of
the leadership of the General Assembly a: well as chairpersons of
committees of the General Assembly.
The chapter has also been thoroughly revised to cater

adequately for situations where vacancies exist in the Executive
Officers' positions.
Chapter Six
Elections and Qualifications
The review saw the Electoral Commission been mandated to
start the electioneering processes early enough in the second
semester so as to enable issues arising there from be adequately
and promptly dealt with so that the electioneering could
proceed.
The qualifications to contest an election as an Executive Officer

has been modified to include inter alia, the requirement for
attaining a Cumulative Grade Point Average (CGPA) of 3.0 or
better, at the date of filing nominations to contest elections. A
requirement that a candidate for election should have been a
resident student for at least one academic year as well as the
requirement that only graduate students who pursued their

undergraduate studies in this university can contest elections

has been expunged.
Provisions on the Electoral Commission has been reviewed to

allow the election of an Electoral Commissioner at the
beginning of the academic year as well as to allow a wider range
of qualified persons to contest for that office.
The General Assembly instead of the Executive Committee is
now mandated to appoint the Electoral Commissioners of the
SRC after a vetting of applicants has been done:
Equally, provisions have been made for the removal of any
member of the Electoral Commission on some specified
grounds.
The composition of the SRC Vetting Committee has been re-

examined and re-modified to have the Legal Advisor as a
member so as to provide instant legal advice in the conduct of
vetting of aspirants for elections under the Constitution.
The Electoral Commissioner who used to have the right of
appointing three other students onto the Vetting Committee no
longer has that power, as same as has been given to the General
Assembly which would do so after receiving applications from
qualified persons and conducting a vetting of such persons.

Chapter Eight
Finance
As part of measures to improve prudent and transparent
financial management, the Treasurer is now required to present
audited financial statement of the SRC to the General Assembly
twice every semester.
Chapter Nine
Committees of the General Assembly
The Finance Committee has been re-modified to exclude the
Treasurer as secretary to that committee. This is to improve the
neutrality of the committee in the performance of its
constitutional mandate of inter alia pre-auditing the SRC's
finances.
The Audit Board whose membership used to be appointed by
the Executive Committee now has the General Assembly doing
same after receiving applications from suitably qualified
students. This is to further guarantee the independence of the
Audit Board insulate it against possible executive control,
manipulation and interference.
The Entertainment Committee of the SRC has been expunged

and its major functions reassigned to the Programmes and
Projects Committee. This is part of efforts at reorienting the SRC
to be more relevant to students.
An Academic Affairs Committee of the SRC has been created

and mandated to take charge of the very many academic related
issues that arise daily and which need urgent attention. This
again, is central to making the SRC more relevant to students.

A Non-Resident Students' Affairs Committee made up of only

non-resident students has been created and mandated to
illuminate the very many problems faced by the-non-resident
students who in recent times have out- numbered the resident
students. This committee is equally mandated to propose
solutions to the problems so enumerated.
Also, recognizing the utmost importance of the Welfare

Committee as far as making the SRC more relevant to the course
of its constituents, the functions of the Welfare Committee have
been re-examined closely and these have been modified to
include ensuring the highest standard of hygiene as well as
product and service quality at all centers where food and/or
other products and services are produced and/or rendered to
students, as the case may be; Working with the appropriate
bodies or units to ensure the continuous and optimum
functioning of all student facilities, including but not limited to
lecture rooms, washrooms and residential quarters and utilities.
The Arbitration Committee's functions of settling disputes

between JCRs and among students have been extended to
include the resolution of disputes between colleges, faculties,
and schools. The Arbitration Committee has also been given the
mandate to be an alternative dispute resolution body of the
SRC. This is part of the national effort at promoting Alternative
Dispute Resolution (ADR). This has the potential of reducing the
number of cases brought before the Judicial Board of the SRC,
and further enhancing the effectiveness and efficiency of the
Judicial Board in the handling of issues brought before it.

The Women Commission of the SRC has been modified in terms

of the functions it is to perform. It has also been provided for
under committees of the General Assembly. In the view of the
Constitutional Review Committee, the restructuring of the
Women's Commission is essential in the quest to prevent
struggle for power between elected Executive Officers and the
leadership of the Women' Commission which often lead to
bizarre outcome. It is also to further deepen the interest of the
Executive Officers in the activities of the Women's Commission
and to make the former more answerable for the success or
otherwise of the latter.
Chapter Thirteen
Miscellaneous
While maintaining provisions that require General Assembly
members to be given copies of the SRC Constitution at the
beginning of their tenure, the review also saw the creation of a
new provision that gives the General Assembly the mandate to
direct that a copy of the SRC Constitution be given to every first
year student of this university as part of going through
registration formalities. This has the potential of giving more
students the opportunity to know more about the SRC, curbing
to some extent, apathy which is a bane to the SRC.
The SRC has also been mandated to pay both NUGS and USAG
dues promptly to improve the performances are these bodies
whose performances are inextricably linked to their finances.
This is also to avoid the situation where some SRC Executive
Officers over burden their successor by not paying the requisite
dues for their tenure.

Schedules
Oath of office for committee/commission/board chairpersons
have been provided for in addition to the existing ones for the
other positions of the SRC.
Enough provision has been made for officers elected/appointed

under the constitution before the coming into force of the
reviewed constitution to continue to hold office as such through
the transitional provisions.
Standing Orders of the General Assembly have been introduced

into the reviewed -constitution. This is to enhance proper
debate in the General Assembly in a more orderly manner.
It is the belief of the Constitutional. Review Committee that

should the reviewed constitution be adopted and enacted, and
its provisions adhered to, it would see a new SRC that would be
of the utmost relevance to the students of University of Ghana.
The Committee in conclusion thanks everyone who has made

the review exercise a success.

Assembly on issues arising either from the stated
agenda or from the floor of the General Assembly.;
b. “article” means a section of a Chapter of this

Constitution, consisting of clauses;
c. “clause” means a section of an article of this

Constitution, consisting of sub-clauses;
d. “sub-clause” means a section of a clause of this

Constitution, consisting of statements or lists
enumerated by ordered alphabets;
e. “constitutional instrument” means (a) regulation(s) or

provision(s) made under a power conferred by this
Constitution;
f. “function” includes powers and duties conferred under

this Constitution;
g. “judgement” includes a decision, an order or decree of

the Judicial Board;
h. “sitting” includes a period during which the General

Assembly or other committee, commission or board
meets continually;
I. “interest of students” includes any right or advantage

which inures or is intended to inure to the general
benefit of the student population of this University;
j. “session” means a series of meetings of the General

Assembly within each semester;
k. “SRC” shall have the meaning assigned in article 4 and

shall include committees, commissions and boards of
the General Assembly or those established under a
resolution of the General Assembly;
l. “an accredited observer” means an observer who had

applied by letter through the SRC Secretary prior to any
meeting to participate in the said General Assembly
meeting;
m. “chairperson” means the head of a committee,

commission or an association of the SRC.
n. “he, him, himself” and “his” means the person, male or
female, referred to by any provision of this Constitution,
unless otherwise specified.
o. “The House” means the at least a quorum of the General

Assembly as provided for in this Constitution.
p. “JCR” means Junior Common Room
q. “Hall of residence” means Legon Hall, Akuafo Hall,

Mensah Sarbah Hall, Volta Hall, Dr. Hilla Limman Hall,
Proffesor Alexander Adum Kwapong, Elizabeth Frances
Sey Hall, Jean Nelson Aka Hall, African Union Hall,
United Nations Hall, Nelson Mandela Hall, Proffesor
J.T.N. Yankah Hall, Jubilee Hall and any other hall that
will come to be.
r. All pronouns used in this Constitution shall refer to both

sexes unless otherwise stated.

CHAPTER ONE
THE CONSTITUTION
1. Name
The organization shall be known and called the

“Students Representative Council” of the University of
Ghana, hereinafter referred to as “SRC”.
2. Supremacy of the Constitution
(a) This Constitution shall be the supreme constitution of

all students, clubs, associations or unions in the
University of Ghana and any other constitution found
to be inconsistent with any provision of this
Constitution shall, to the extent of that inconsistency,
be null and void.
(b) Notwithstanding Article (2) clause (a) this constitution

shall be subject to the Constitution of the Republic of
Ghana, Laws of Ghana and Statutes of this University.
3. Enforcement of the Constitution
(1) Any student who alleges that:
(a) An act or omission of any person or group of persons; or
(b) A constitution, decision or resolution of any body,

organization, club, union or association;
is in contravention with a provision of this Constitution,

may apply to the Judicial Board for a declaration to that

effect.
(2) The Judicial Board shall, for the purposes of such a

declaration under clause (1) of this article,
make such orders and give such directions as it may
consider appropriate for giving effect, or
enabling effect to be given to the directions so made.
(3) Failure to obey or carry out the terms of an order or

directive made or given under clause (2) of this article
constitutes a violation of this Constitution and
contempt of the Judicial Board, and shall, in the case of
the Executive Officers, constitute ground for removal
from office.

CHAPTER TWO
Aims and Objectives
(1) The aims and objectives of the SRC shall include but
not be limited to:
(a) Seeking the interests and welfare of the student body

of Ghana in general and this University in particular.
(b) Serving as the mouthpiece of the entire student body

of this University;
(c) Providing a means of communication between

students and the University authorities in all matters
affecting the student body as a whole or part thereof;
(d) Coordinating with other student organizations in

Ghana and elsewhere in matters of mutual interest; and
(e) Fostering good relations between students of this

University and the outside world.
(2) For the purpose of achieving these objectives, the SRC

shall organize lectures, s y m p o s i a , d e b a t e s ,
publications and such other activities as are necessary,
the SRC shall celebrate its week which shall fall within
the First Semester of the academic year, with the actual
date to be fixed by the General assembly, and where
impossible, to be fixed by the Executive O f f i c e r s i n
consultation with the Dean of Student Affairs.

5. Composition
(1) The SRC shall be composed of:
(a) The General Assembly;
(b) The Executive Committee;
(c) The Judicial Board;
(d) The Executive Officers, and
(e) The General Student body, to wit, all persons in “statu

pupillari” of the University of Ghana.
(f ) For the avoidance of doubt, any student of the

University of Ghana main campus, Accra City Campus,
Medical School Campus, Ghana Atomic Energy
Commission campus, Distance Education students and
any other campus of the University shall be deemed a
member of the SRC.

CHAPTER THREE
The General Assembly
(1) There shall be a General Assembly which shall

comprise:
(a) The Executive Officers elected under this constitution
(b) The Presidents and Secretaries of all JCRs of the Halls of

affiliation in this University;
(c) Five representatives from the College of Health

Sciences elected by an Electoral College consisting of a
representative from each school within the said
College;
(d) Five representatives from the JCR of each traditional

Hall of affiliation, elected by the respective JCRs or by
an electoral college of the same.
(e) The President and Secretary of the International

Students Association;
(f ) The President and Secretary of the local Students'

Representative Council of the Accra City
campus of this University and five other representatives from
the same, elected by an electoral college of the
said Council; and
(g) President and Secretary of the Graduate Students

Association, of this University, as well as five
other representatives elected by an electoral college
of the said association.

(h)
(i) Two representatives each from the following:
Faculty of Engineering Sciences
Faculty of Science
Faculty of law
Faculty of Arts
Faculty of Social Sciences
College of Agric and Consumer Science
Business School
elected by an electoral college in each respective

association.
(ii) Notwithstanding (a) above, a Faculty that shall come

into existence after the adoption of this Constitution
shall be entitled to membership of the General
Assembly, in accordance with the provisions of the
same paragraph, except in the case that the said Faculty
shall belong under a School or College of the
University.
(I) Two representatives from the Association of Students

with Special Needs, elected by an electoral college of
the said association.
(j) A Chairperson from each of the following:

Non-Resident Students Affairs Committee
Academic Affairs Committee
External Affairs Committee
Publications and Information Committee
Welfare Committee
Intelligence and Students Affairs committee
Finance committee
Projects and Programmes Committee
Scholarship Committee
(l) Two representatives from the Graduate School of

Nuclear Energy and Atomic Physics, elected by an
Electoral College composed of students of the
said School.
(2) On the assumption of office, the SRC Secretary shall,

within seven working days, request in writing the
names of all such members as provided for in
paragraphs (c), (d), (e,) (f ), (g), (h), (I), (j), (k) and
(l) of clause (1) of this article, from the various associations,
unions or other appropriate bodies concerned.
(3) Any person, association, club, union, organization or

body written to by the SRC Secretary shall forward the
names of such representatives qualified to be members
of the General assembly by virtue of paragraphs (c), (d),
(e,) (f ), (g), (h), (I), (j), (k) and (l) of clause (1) of this article,
to

the SRC Secretary within seven weekdays after the

receipt of the request referred to in clause (2)
above.
(4) For the avoidance of doubt and with the exception of

persons in paragraphs (a) and (b) of clause (1) of this
article, a person shall not be deemed to be a member of
the General Assembly unless his name has been
submitted in writing to the SRC Secretary within ten
(10) working days after the assumption of office of the
new Executive officers of the SRC.
(5) A member of the General Assembly shall, before taking

his seat in the General Assembly, take and subscribe to,
before the Chairperson of the Judicial Board, the oath
of a member of the General Assembly set out in the
fourth schedule to this Constitution.
7. Leadership of the General Assembly
(1) (i) There shall be a Chairperson of the General Assembly

who shall not be an Executive Officer of the SRC or a
member of the General Assembly.
The Electoral Commissioner shall open nominations for

the Chairmanship of the General Assembly
within 48 hours after the inauguration of new Executive
Officers, and shall receive such nominations from the
general student body.
(ii) Nominations referred to in clause (2) of this article shall

be submitted in writing to the Electoral
Commissioner, and must be seconded by signature of
(20) students with one student from each of the Halls of

residence.
(iii) A person nominated to the said office should have
been a student of this University for at least
one academic year prior to his nomination, and
must meet the requirements necessary for qualification as
an Executive Officer under this Constitution.
(iv) The Chairperson of the General Assembly shall be

elected by a simple majority of the General
Assembly at the first sitting of the same, in an election that
shall be conducted by the Electoral Commission.
(v) The Chairperson of the General Assembly shall have no

voting rights in the General Assembly, and shall not
participate in discussions of the General Assembly.
Such participation shall include statements of opinion,
comments or any contribution that may potentially
impinge upon the substance of discussions.
(2) (i) There shall be a Deputy Chairperson of the General

Assembly, nominated from among the membership of
the general Assembly and elected by a simple majority
of the same, provided that the said member shall not be
an Executive Officer of the SRC.
(ii) For the avoidance of doubt, the Chairperson shall not

chair a sitting of the General Assembly in which
matters concerning his ability to perform his duties, for
whatever reason, are under discussion. In this event,
the Deputy Chairperson shall act in his stead.
(iii) The Deputy Chairperson shall, in the absence of the

Chairperson, perform the duties of the Chairperson,
and when acting in that capacity, shall not have the

right to
vote or participate in the substance of discussions.
(iv) Notwithstanding (iii) of this clause, the Deputy

Chairperson, in the absence of the Chairperson, shall
not chair a sitting of the General Assembly in which
matters concerning his ability to perform his duties, for
whatever reason, are under discussion. In this event,
the Clerk of the General Assembly shall act in his stead.
(v) Furthermore, shall the Chairperson and the Deputy

Chairperson both be absent from proceedings, the
Clerk of the General Assembly shall chair the sitting.
(3) There shall be a Clerk of the General Assembly who shall

keep all records of the G e n e r a l A s s e m b l y i n
accordance with the provisions of this Constitution,
and shall see to all correspondence between the
General Assembly and any other person or
body, as the case may be. Among such records, the
Clerk shall keep a record of all m e m b e r s o f t h e
General Assembly.
(4) The Clerk shall be nominated by the Chairperson in

consultation with the Deputy Chairperson, whose
nomination shall be approved by the General
Assembly, provided that the nominee is not a
member of the General Assembly. Furthermore, the
Clerk shall have spent at least one academic year as a
student of this University.

8. Meetings
(1) The General Assembly shall meet at least three times

every semester.
(2) The Clerk shall, in writing, notify members of such

meetings, specifying the agenda not less than
three clear days before the meeting.
(3) The quorum for a General Assembly meeting shall be
(a) The Chairperson or in his absence, the Deputy

Chairperson;
(b) Two (2) Executive Officers including the President or

the Vice President, five (5) JCR Presidents of the
traditional Halls of affiliation;
(c) Two Faculty, School or College representatives; and
(d) Twenty-five (25) other members.
9. Emergency meetings
(1) Notwithstanding clause (1) of article 8 of this

Constitution, the Executive Committee or, any twenty-
five (25) members of the General Assembly, may
request an emergency meeting, provided that notice of
such a meeting shall be given in writing, and that the
agenda or agendum, as the case may be, shall be
attached and delivered to the SRC Secretary.
(2) For the avoidance of doubt, a request made under

clause (1) of this article shall be duly signed by

all the members of the General Assembly requesting the

emergency meeting.
(3) The SRC Secretary shall, in consultation with the

Executive Committee summon such meeting within
three (3) days of receipt of such request through the
office of the clerk.
(4) Without prejudice to clause (1) of article 7 and clause (1)

of article 8 of this Constitution, the first sitting of the
General Assembly shall be within twenty-one (21) days
after the assumption of office of new Executive Officers.
10. Decision Making in the General Assembly
(1) The General Assembly shall be the highest decision

making body of the SRC and all issues concerning
students shall be decided at the General
Assembly.
(2) Notwithstanding clause (1) of this article, decisions of

the General Assembly shall be subject to Judicial
Review in accordance with clause (1) of article 3 of this
Constitution.
(3) Notwithstanding clause (1) of this article, the General

Assembly shall not have the power to overturn a
decision of the Judicial Board in respect of any matter.
(4) The General Assembly may concern itself with

questions of general policy referred to it by the
Executive Committee of the SRC.

Assembly shall on its own initiative consider and make

recommendations on any matter provided for in this
Constitution or affecting the welfare and interest(s) of
students.
(6) For the avoidance of doubt, it is hereby declared that

proceedings of the General Assembly shall not be
inconsistent with the letter and spirit of this
Constitution.
(7) The General Assembly shall enact and/or adopt such

instruments or regulations as may be necessary to
ensure the highest level of academic
endeavour in the University. In accordance with this
provision, the General Assembly shall set up an
Academic Affairs Committee to pursue the said
objective.
(8) The General Assembly shall regulate its own
proceedings using such procedures and protocols as
may be appropriate, notwithstanding the Standing
orders provided for in Schedule Eight of this
Constitution.
(9) Except as may be otherwise provided for in this

Constitution, the decisions of the General Assembly
shall be made by a simple majority of members present
and voting.
(10) (i) The General Assembly shall arrive at decisions by voice

count, head count or by secret ballot as may be
appropriate.
(ii) Notwithstanding (I) of this clause, decisions made by a

voice count shall be subjected to a second round of
voting in event that a member of the House, seconded

by at least ten other members, shall call for the same. A

second round so called, shall be a head count of
members present and voting.
(11) The proceedings of the General Assembly shall be
communicated by the Clerk to the general
student body within five (5) days after the close of such
proceedings. Such communication shall be
made through the use of email, the SRC and/or
University Website, radio and appropriate notice boards
in the University, as well as other media as may be
appropriately available.
(12) The General Assembly shall, at least once every

semester, carry out an evaluation of the work of the
Executive Committee, use in such methods as may
be agreed upon by the General Assembly.
11. Tenure of Office of members of the General Assembly
(1) A member of the General Assembly shall vacate his seat

in the General Assembly:
(a) Upon the dissolution of the General Assembly; or
(b) having conducted himself in a manner:
I. Which brings or is likely to bring his position as a

general assembly member into disrepute, ridicule or
contempt; or
ii. Prejudicial or inimical to the interests of students; or

To be incapable of performing the functions of his
office by reason of infirmity of body or mind or,
to have embezzled funds or recklessly handled the finances of

© If he is absent, without the permission in writing of the

Chairperson, and is unable to offer a reasonable
explanation to the Welfare Committee, for two sittings
in a semester; or
(d) If he is expelled from the General Assembly after having

been found guilty of contempt of the General
Assembly by the Disciplinary Committee; or
(e) If he resigns from office as a member of the General

Assembly by writing under his hand addressed to the
Chairperson of the General Assembly; or
(f ) If he is removed from office in accordance with article

26 of this constitution.
(2) (a) The General Assembly shall be dissolved by the

outgoing Executive Committee on the same day as the
new Executive Officers shall be handed over
(b) For the avoidance of doubt, the handing over of new

Executive Officers shall be held only after the
dissolution of the General Assembly.
12. Challenging the Election of a Member of the

General Assembly
(1) The Judicial Board shall have jurisdiction to hear and

determine any question as to whether:
(a) a person has been validly elected as a member of the

General Assembly; or

(b) the seat of a member has become vacant
(2) A person aggrieved by the determination of the

Judicial Board under this article may appeal to the
Appeals Board.
13. Attendance of Observers at General Assembly

Meeting
(a) Observers or a member of any committee who is not a

member of the General Assembly, shall be entitled to
participate in the proceedings of the General Assembly
and shall be accorded all the privileges of a member of
the General Assembly except the entitlement to vote.
(b) A motion tabled by any such accredited observer or any

non member of the General Assembly, shall be valid
provided the said motion is seconded by at least five
General Assembly members.
(c) An observer shall not have the right to second a motion

raised in the House, and shall not have the right to vote
on any motion in the General Assembly.
(d) For the accordance of doubt, an observer shall be a

student of the University of Ghana.
(e) Notwithstanding (d) of this clause, the General

Assembly may invite the audience and/or participation
of a non-student, who shall not participate in
discussions apart from the substantive issue for which
the invitation was made.

CHAPTER FOUR
THE EXECUTIVE
14. The Executive Committee
(1) (a) There shall be an Executive Committee consisting of

the President of JCRs of the Halls of residence, the
Executive Officers, as provided for in article 16,
the Chairperson of the Women's Commission, the
President of the GRASAG University of Ghana
branch, a permanent representative from each Faculty,
School and College represented in the General Assembly, the
President of the local SRC of the Accra City Campus, the
President of the Continues and Distance Education
Students Association, and the Legal advisor to the SRC.
(b) For the avoidance of doubt, the representative of

Schools, Faculties and Colleges at the G e n e r a l
Assembly shall not be eligible to serve on the Executive
Committee.
(c) Representatives referred to in (b) of this clause shall be

elected through the same process provided for the
election of their respective representatives to the
General Assembly.
(2) The other members of the Executive Committee shall

assist and counsel the Executive Officers in the
performance of their duties, and with the Executive
Officers, see to the implementation of the decisions of

the General Assembly.
(3) The quorum for Executive Committee meeting shall be

nine (9) Executive Committee members including the
President or his Vice President.
(4) The Executive Committee shall in the exercise of its

functions, have the power to issue Executive
Instruments in accordance with the provisions of this
Constitution concerning the activities of the SRC.
(5) (a) The Executive Committee shall, in times of
emergency, have powers to act promptly without
prejudice to any provision of this Constitution,
provided that the General Assembly shall,
where this University is on vacation, within three days of
re- opening at an emergency or, within three days
where this University is in session, be informed of the use of
such emergency power by the President.
(b) The General Assembly shall, upon receiving the facts

and circumstances pertaining to the said
emergency action, review the decision and make
appropriate resolutions for the continuance or
otherwise of the said emergency action.
(6) The Executive Committee shall formulate policies of

the SRC and refer same to the General Assembly for
consideration. No policy so formulated shall be valid
without the approval of the General Assembly.
(7) The SRC Secretary shall inform the Clerk of the General
Assembly of all such policies and of the agenda for

General Assembly meetings.
(8) The Executive Committee member(s) before assuming

office shall and subscribe to, either at a public
gathering, at the first general meeting or any other
general meetings of the General Assembly, the
Executive Committee affirmation set out in the third
schedule to this Constitution.
15. Fora and Press Conferences
(1) The Executive Committee shall hold at least one (1) fora
each semester
(2) Notwithstanding clause (1) of this article, any group of

fifty (50) students may request an emergency forum,
provided that such a group comprises at least three
students from each Hall of residence, as well as at least
one (1) student each from every Faculty, College or
School.
(3) The Executive Committee of the SRC may hold press

conferences as and when it shall be deemed necessary
and in accordance with the rules and regulations of the
University.
(4) The content of any such press conference shall be

discussed at the General Assembly before the
date set for the press conference.
16. Composition of Executive Officers
There shall be four Executive Officers to wit, the

President, Secretary and Treasurer, elected under this

Constitution, and the Vice President.
17. The President
(1) There shall be a President who shall be the Chief

spokesperson of all students in this University.
(2) The authority of the President shall extend to the

execution and maintenance of all provisions, including
article 4 of this Constitution.
(3) All meetings of the Executive Committee shall be

chaired by the SRC President, and in his absence, the
Vice President.
(4) Before assuming office the President shall take and

subscribe to, before the general student body, or at a
public gathering, the Presidential affirmation as set out
in the First Schedule to this Constitution.
(5) The President, to the extent that he acts within the

provisions of this Constitution, shall not be
liable to proceedings in any court, for the performance
of his functions or for any act of commission or omission
related to the same, as specified by this
Constitution. The General Assembly shall approve all
appointments made by the President to boards, councils and
committees of the University as the case may
be.
(7) (a) The President shall give final authorisation to any

financial disbursement approved by the Executive
Committee.

(b) For the avoidance of doubt, the Executive Committee

shall agree on a minimum amount above which the
approval of the Committee shall be mandatory.
(c) Furthermore, all such disbursements shall have prior
approval of the General Assembly before they shall be
made.
(8) The President shall direct, for all intents and purposes,
in a disciplined manner, the day to day affairs of the SRC.
(9) The SRC President shall represent the SRC in any court
in which proceedings against or on behalf of the SRC
are heard.
(10) The President shall be one of the signatories to all

vouchers and requests made on behalf of the
SRC for funds.
18. Presidential Messages
(1) The President shall, acting on the advice of the

Executive Committee, at the beginning of each
semester and before the dissolution of the General
Assembly, deliver to the General Assembly an address
on the State of Affairs of the SRC.
(2) Issues raised in the address referred to in Clause (1)

above shall be subject to discussion by the General
Assembly, and the President shall provide such answers
as may be required by members during such
discussions.

19. The Vice President
(1) There shall be a Vice President of the SRC, who shall

perform such functions as provided for in clause (3) of
this article.
(2) A candidate for the office of Vice-President of the SRC

shall be designated by the candidate for the office of
President before the election of the President.
(3) The Vice President shall perform duties and functions

which shall include:
(a) Assisting the President in the performance of his duties;
(b) Acting in the absence of the President and when so

acting, shall be vested with all the powers of the
President, subject to the provisions of this Constitution.
(c) Acting as an ex-officio member of all committees of the

General Assembly, as provided for under Chapter 9 of
this Constitution, and shall co-ordinate the activities of
such committees provided for in this Constitution, and
or under a resolution of the General Assembly.
(d) Performing any other duties assigned by the President

or the Executive Committee
(4) The Vice President shall, on the assumption of office,

take and subscribe to, before the general students

body, at a public gathering the Presidential

oath set out in the First Schedule to this Constitution.
20. The Secretary
(1) There shall be a Secretary who shall be the Secretary to

the Executive Committee.
(2) The Secretary shall perform duties and functions which

shall include:
(a) Keeping and maintaining true and accurate minutes
and records of all proceedings of Executive Committee
meetings;
(b) Carrying out and taking responsibility for all

correspondence of the SRC, with the exception of the
correspondence of the General Assembly.
(c) Communicating to the general student body, at least

once every month when school is in session, the current
state of affairs with respect to business pertaining to
the SRC particularly and to student welfare in general.
(d) The performance of other duties assigned by the

President or the Executive Committee.
(3) Before assuming office, the Secretary shall take and

subscribe to, before the general student body at a
public gathering, the Executive Officers
Oath/Affirmation set out in the Third Schedule
of this Constitution.

21. The Treasurer
(1) There shall be a Treasurer of the SRC, who shall be a

student with a background in financial accounting, and
who shall perform duties and functions which shall
include:
(a) The receipt of all moneys and revenues accruing to the

SRC or committees or commissions of the SRC, and the
disbursement of such moneys as the Executive
Committee shall direct, subject to the approval of the
General Assembly.
(b) Carrying out, under the supervision of the President, all

financial transactions of the SRC in accordance with the
provisions of this constitution;
(c) Keeping and maintaining proper records of accounts of

all moneys, revenue and assets to which the SRC is
entitled;
(d) Being one of the signatories to vouchers and requests

made for funds on behalf of the SRC;
(e) Performing other duties assigned him by the President

or the Executive Committee.
(2) The Treasurer before assuming office shall take and

subscribe to, before the general student body at a
public gathering, the Executive Officers oath

set out in the Second Schedule to this Constitution.
22. Appointments by Executive Officers
(1) The Executive officers shall, in consultation with other

members of the Executive Committee and with the
approval of the General Assembly appoint:
(a) The Legal Advisor, who shall be the principal legal

advisor of the SRC, and shall be a student
pursuing in whole (full time student), studies at the Faculty
of Law of this University, and who should have spent at least
one year in such studies. A post first degree student of
the Faculty of Law appointed as a Legal Advisor shall
have undertaken his undergraduate studies in the
University of Ghana.
(b) The Chairpersons of:
I. The External Affairs Committee
ii. The Publications and Information Committee
iii. The Welfare Committee
iv. The Intelligence and Student Affairs Committee
v. The Disciplinary Committee
vi. The Academic Affairs Committee
vii. The Non-Resident Students Affairs Committee
viii. The Women's Commission

ix. The Finance Committee
x. The Judicial Board

xi. The Projects and Programmes Committee
xii. The Arbitration Committee and
xiii. Scholarship Committee
xiv. Any other committee as may be established by a

resolution of the General Assembly

CHAPTER FIVE
REMOVAL FROM OFFICE
23. Grounds for Removal from Office
(1) Any elected or appointed officer of the SRC may be

removed from office if found, in accordance with the
provisions of this article,
(a) To have acted in violation of the oath of office set out in

the First or Second Schedule to, or in violation of this
Constitution; or
(b) To have conducted himself in a manner:
iii. Which brings or is likely to bring the high office of

President or Vice President or Secretary or
Treasurer into disrepute, ridicule or contempt; or
iv. Prejudicial or inimical to the interests of students; or
(c) To be incapable of performing the functions of his

office by reason of infirmity of body or mind or
(d) To have embezzled funds or recklessly handled the

finances of the SRC; or
(e) To be inefficient or negligent in the discharge of his/her

duties.
45
24. Impeachment
(1) Any student or group of students may, by notice in

writing addressed to the Chairperson of the
Judicial Committee, commence impeachment proceedings
against an Executive Officer, provided that the officer
shall be served by the student(s) in question, with a
copy of the notice three (3) clear days before the start of
such proceedings.
(2) The Chairperson of the Judicial Board shall, within five

(5) days of receiving the notice of impeachment,
convene a sitting of the Judicial Board to determine the
validity of the grounds provided for impeachment.
(3) The decision of the Judicial Board shall be by a simple

majority and shall be communicated to an emergency
session of the General Assembly called for that purpose
by the Clerk of the General Assembly of the SRC within
forty-eight hours after receipt of the decision of the
Judicial Board.
(4) The General Assembly shall then debate thereafter,

vote on the issue, having granted fair hearing to all
parties involved as shall be stipulated in the notice of
impeachment.
(5) For impeachment purposes, the votes of at least two-

thirds of the General Assembly members for or against
shall be required to impeach the Executive Officer in
question.

(6) For the avoidance of doubt, any officer so impeached

shall forthwith cease to hold the office from which he
has
been impeached.
(7) Any vacancies created by virtue of any provision of this

Constitution shall be filled within twenty-one days
after such vacancies are created, in accordance with the
relevant provisions of this Constitution.
(8) In the event of impeachment of:
(a) The President, the Vice President shall act in his stead
(b) The Vice President, the President shall,

notwithstanding (a) of this clause, have the right to
appoint a new Vice President, in consultation with the
Executive Committee and with the approval of the
General Assembly.
(c) The Secretary, the Chairperson of the Information and

Publications Committee shall act in his stead.
(d) The Treasurer, the Chairperson of the Finance

Committee shall act in his stead.
25. Vote of No Confidence
(1) Without prejudice to article 24 of this Constitution, the

Executive Officers shall be removed from office on the
passing of a vote of no confidence by at least five (5)
JCRs of the Halls of residence in this University at a
special meeting called for such purposes,

provided that, within seven days of a JCR passing a vote

of no confidence two other JCRs shall pass a resolution on
the same.
(2) For the purposes of this article, it shall be the duty of a

JCR President of a Hall of residence, or in his absence, his
Vice President to convene such special meetings for
such purposes.
(3) A JCR President under clause (2) of this article,

convening a meeting for such a purpose shall be served
with a copy of the grounds for the vote of no confidence
seventy-two hours before such meeting is convened.
(4) The Executive Officers referred to in clause (1) of this

article shall have the right to attend any meeting
convened for the purpose of passing such a vote of no
confidence, and to respond to the allegations brought
against them for the purpose.
(5) A said JCR being the first JCR seeking to pass the vote of
no confidence shall furnish the Executive Officers with
the allegations in writing not less than three (3) clear
days and the said officers shall have a right of reply
within twenty-four hours before the first JCR
meeting is conducted.
(6) The JCR Secretary of the said JCR shall record minutes of
such a meeting, and shall, within twenty-four hours
after the said meeting, notify the Chairperson of the
Judicial Board and the Executive Officers, of the
outcome of the vote.
(7) (a) In the event of the removal from office en-block of the

Executive Officers under this article, the remaining

members of the Executive Committee shall nominate
and/or appoint:
(I) One of the JCR Presidents of the Halls of residence as

Acting SRC President;
(ii) One of the JCR Secretaries as Acting SRC Secretary,

provided that such a Secretary shall not be appointed
from the same JCR as shall be appointed from under (a)
of this clause.
(iii) The Chairperson of the Finance Committee as Acting

Treasurer of the SRC.
(b) Officers so appointed under (a) of this clause shall

constitute the Acting Executive Officers of the
SRC, and shall have such powers as pertain to the
respective substantive offices as provided for in this
Constitution.
(c) For the avoidance of doubt, (b) of this clause shall apply
in the event of a failure to elect Executive Officers under
this Constitution, subject to article (29) clause (2) (b).
26. Removal of the Leadership of the General Assembly
The Chairperson, Deputy Chairperson or Clerk of the

General Assembly shall, if found to have been
inefficient in the performance of their duties, be
removed from office by a two-thirds majority of the
General Assembly.

27. Removal of a Member of the General Assembly
(1) A JCR, College, Faculty or School, campus and other

associations whose has representation on the General
Assembly shall have power to withdraw or remove any
or all of its representatives in the General Assembly
provided that such exercise shall be effected through a
resolution properly passed by the said body.
(2) The General Assembly of the SRC shall have power to

suspend or expel any member who is not an Executive
Officer upon stated misbehaviour, provided that such a
member shall have the right to appeal to the Judicial
Board, which suspension or expulsion shall be upheld
by a two-thirds majority of the entire membership of
(3) Without prejudice to any provision of this Constitution,

a person shall cease to be a member of the SRC.
(a) Where he is adjudged to have embezzled funds or

recklessly handled the finances of the SRC; or
(b) Where he is found to be inefficient or negligent in the

discharge of his duties, provided that the grounds so
adduced have not been appealed against at the
Judicial Board.
(4) A JCR, Faculty, College or School shall have power to fill

any vacancy created by virtue of this article in
accordance with the provisions of this Constitution.

28. Removal from Office of Chairpersons of Committees
(1) Shall any Chairperson of any Committee of the SRC be

found to:
(a) Be ineffective or inefficient in the performance of his

duties; or
(b) Have behaved in a manner that brings or has the

potential to bring the SRC into disrepute or is otherwise
inimical to the SRC, the said Chairperson shall be liable
to be removed from office by a simple majority of the
Executive Committee, which shall consider the matter.
(2) For the avoidance of doubt, the Chairpersons of the

Audit Board and the Judicial Board shall both be
liable to removal from office under clause (1) of this
article.

CHAPTER SIX
ELECTIONS AND QUALIFICATIONS
29. Election of Executive Officers
(1) A student shall not be a candidate in any election unless

he is nominated for election as President or Secretary or
Treasurer, evidenced by an accurately filled out
nomination form obtained from the Electoral
Commission, which:
(a) Is signed by him; and
(b) Is signed by not less than ten students from each JCR of
the Halls of residence, at least one student from each
Faculty, College and School; and
(c) Is delivered to the Electoral Commission on or before

the day fixed for the close of nomination in relation to
the election
(2) The election of the Executive Officers shall be on the

terms of secret popular vote and shall, subject to the
provisions of this Constitution, be conducted in
accordance with such regulations as may be prescribed
by constitutional Instrument issued by the Electoral
Commission. In pursuit of this, nominations shall be

opened and appropriate forms made available in the

sixth week after the beginning of the second semester.
In the event of a failure to elect any Executive Officer
under this Constitution, clause (7) of article (25) of this
Constitution
shall apply until such a time as elections are held to
elect the said Executive Officer(s), given there remain at
least three (3) months to the end of the tenure of
Executive Officers of that academic year.
30. Qualifications
(1) A student shall not be qualified for election to any

executive office unless:
(a) He is qualified to contest elections under his hall's

Constitution, except that a provision requiring
a student to be in at least his third year in this
University shall not disqualify such a person from
contesting for any office under this article.; and
(b) He has attained a Cumulative Grade Point Average

(CGPA) of 3.0 as at the time of filing his nomination.
(2) A person shall not be qualified to be an Executive

Officer if he / she
(a) Has been adjudged or otherwise declared by a judicial

or quasi-judicial body to have misappropriated funds
or conducted himself in such a manner as to cause
depreciation in respect of loss or otherwise in
any cash or property entrusted to him; or
(b) Has been found by any committee of inquiry in this

University to be incompetent to hold any office or is a

person in respect of whom a committee or commission
of inquiry in this University has found that while
holding any office he has acquired assets unlawfully or
defrauded the SRC or other body or misused or abused
his office, or
wilfully acted in a manner prejudicial to the
interests of students and the findings have not been set
aside on appeal or judicial review; or
(c) Has once been removed from any student office in this
University, on grounds that are inimical to the interests
of any group of students.
(d) Has previously held the position of an Executive Officer

under this Constitution.

a student shall qualify to stand and contest elections to
any Executive Office provided he is not a final year
student.
(4) Notwithstanding clause (3) of this article, candidates

duly approved by the Electoral Commission for
elections in accordance with the provisions of this
Constitution shall be eligible to contest in the
election for which he was approved, regardless of the
date on which it is held.
(5) A final year student shall be defined to include all who

receive a degree or diploma or certificate awards as the
end of the academic year in which elections are being
held.
(6) No student shall be elected as an Executive Officer

unless at such election, the number of votes

cast in his/her favour is more than fifty percent of the total
number of valid votes at the election.
(7) Where no candidate scores more than fifty percent of

the valid votes cast, there shall be a run-off election
between the first two candidates with the highest
number of votes within seven (7) days, after the
declaration of results, which shall be by a
simple majority of valid votes cast.
(8) An instrument which:
a. Is executed under the hand of the Chairman of the

Electoral Commission and under the seal of the
Commission; and
b. States that the person named in the instrument was

declared elected as an Executive Officer at the election
shall be prima facie evidence that the person was so
elected.
(11) The Electoral Commission shall, immediately after an

election, declare provisional results and unless or until
such results are challenged, as provided for under
article 31 of this Constitution, shall declare the
final results within seventy-two hours after the election.
(12) Any student pursuing in whole, a programme at any

campus of this University where a Students'
Representative Council is elected under any other
Constitution shall not be eligible to contest as
an Executive Officer under this Constitution.
31. Challenging Elections

(1) The validity of the election of an Executive Officer may

be challenged by a student of this University who may
present a petition for that purpose to the Judicial Board
within forty-eight hours after the declaration of the
result
of the position in respect of which the petition is

presented.
(2) The Judicial Board shall, without prejudice to any

provision in this Constitution, decide on t h e
validity of an election within seven days after the
petition has been received by the Chairperson
of the Judicial Board.
(3) The Chairperson of the Appeals Board, Chairperson of

the Judicial Board, Chairperson of the Electoral
Commission and two members of the General
Assembly nominated by the General Assembly shall,
within two months after the coming into force of this
Constitution, make rules for the practice and procedure
for petitions to the Judicial Board challenging the
election of a President or Secretary or
Treasurer; which rules shall be precedent for such
purposes as provided for in this article.
(4) The Electoral Commission shall by Constitutional

Instrument make regulations for the purpose of giving
effect to articles 29 and 30 of this Constitution,
provided that such regulations shall not be consistent
with any provision of this Constitution.
32. Tenure of Office of Executive Officers

(1) A student as an Executive Officer shall, subject to clause

(3) of this article, hold office for a term of one academic
year
(2) Notwithstanding clause (1) of this article, the Executive

Officers shall, hand over to newly elected Executive
Officers within fourteen (14) days after declaration of

the final election results or, where such results are
challenged under clause (1) and clause (2) of
article 31 of this Constitution, within five (5) days after
such declaration by the Judicial Board. Where the
Judicial Board invalidates the election(s), re-elections shall be
conducted at a time stipulated by the Judicial Board, for
the specific position or positions.
(3) The office of an Executive Officer shall become vacant
a. On the expiration of the period specified in clause (1) of

kthis article; or
b. If the incumbent dies or resigns from office or ceases to

hold office under articles 23, 24 and 25 of this
Constitution.
(4) An Executive officer may by writing, signed by him, and

addressed to the Chairperson of the Judicial Board and
copied to the General Assembly, resign from Office,
provided that such resignation shall not be valid unless
a twenty-one (21) days notice is given.
33. The Electoral Commission
(1) There shall be an Electoral Commission which shall

consist of:
(a) A Chairperson who shall also be the Electoral

Commissioner of the SRC; and
(b) Two Deputy Chairpersons
(2) The Electoral Commissioner and two Deputy

Commissioners shall be appointed by the General
Assembly after a vetting conducted by a seven
(7) member committee set up by the General
Assembly, which vetting shall be held in the presence of,
but without the participation of the General
Assembly, at the second sitting of the same.
(3) The Electoral Commissioners of the JCRs of the Halls of

residence shall be members of the Electoral
Commission provided for in this article.
34. Qualification of Electoral Commission

Chairpersons
(1) A student is not qualified to be appointed Chairperson

or Deputy Chairperson unless he/she is qualified to be
elected as an Executive Officer.
(2) The out-going Electoral Commissioner shall hand over

to the incoming commissioner within five (5) days after
the second sitting of the General Assembly, provided
that he General Assembly approves of the
appointment of the Chairperson on the new
Electoral Commission

35. Removal of Electoral Commissioners
Any member of the Electoral Commission, if he is found

to be incompetent or otherwise unsuitable for the said
office, he shall be removed from office by an order to
that effect by the Judicial Board, which shall consider
the case brought against the said officer.
36. Functions of the Electoral Commission
(1) The Electoral Commission shall be responsible for

conducting and supervising all SRC elections.
(2) The Electoral Commission shall perform such other

functions as may be prescribed by a resolution of the
General Assembly not inconsistent with the provisions
of this Constitution.
37. Independence of the Commission
Except as provided in this Constitution or in any

resolution of the General Assembly not inconsistent
with this Constitution, in the performance of its
functions, the Electoral Commission shall not be
subject to the direction or control of any person or
authority.
38. Rules and Regulations for Elections
The Electoral Commission shall, by Constitutional

Instrument, make rules and regulations for the
effective performance of its functions under this
constitution or any other resolution of the General Assembly.
Such rules and regulations shall be approved by the General
Assembly.

39. Expenses of the Commission
The administrative expenses of the Electoral

Commission shall, be charged on the Students' Fund.
40. Vetting Committee
There shall be a Vetting Committee which shall be

chaired by the Electoral Commissioner and be
responsible for ensuring that candidates for
any election under this constitution satisfy the
requirements provided for in this Constitution,
or a resolution of the General Assembly, or regulations of
the Electoral Commission set out under schedule six, as
provided for in article 38 of this Constitution.
41. Composition of Vetting Committee
The Vetting Committee shall comprise
a. The Chairperson of the Electoral Commission
b. One Deputy Chairperson of the Electoral Commission
c. Two members of the General Assembly
d. The Legal Advisor of the SRC; and
e. Any other student may apply to be a member of the

Vetting Committee to the Chairperson of the General
Assembly, three of which shall be appointed by the
General Assembly after a vetting by the committee that

shall vet applications to the position of the Electoral

Commissioner.
CHAPTER SEVEN
THE JUDICIAL BOARD
(1) There shall be a Judicial Board which shall comprise the

Judicial Board Chairpersons of the various JCRs of the
Halls of residence in this University. The members of the
Judicial Board shall be called Justices.
(2) The Chairperson of the Judicial Board shall be

appointed by the Executive Officers acting on the
advice of other members of the Executive
Committee, subject to the approval of the General
Assembly, provided that the Chairperson shall be
appointed from amongst the substantive Chairpersons of the
Judicial Boards of the JCRs of the Halls of residence at the first
sitting of the General Assembly. The Chairperson shall
be called the Chief Justice.
(3) No student shall be qualified as a member of the

Judicial Board unless he is of high moral character and
proven integrity and provided that he is pursuing
wholly a course in legal studies at the Faculty of
Law in this University.
43. Independence of the Judicial Board
(1) In the exercise of its functions, the Judicial Board shall

be subject to this Constitution only and shall not be

subject to the control or direction of any person or
authority.
(2) Neither the Executive Committee nor the General

Assembly nor any other person whatsoever
shall interfere with the Justices in the exercise of
their functions, and all students, JCRs of the Halls of
residence and committees of the General
Assembly shall accord the Judicial Board such assistance
as the Judicial Board may reasonably require to protect the
independence, dignity and effectiveness of the Judicial
Board, subject to this Constitution
(3) A member of the Judicial Board shall not be liable to any

action or suit for any act or omission by him in the
exercise of judicial power.
44. Jurisdiction of the Judicial Board
(1) The Judicial Board shall have jurisdiction in
a. All matters relating to the enforcement or

interpretation of this Constitution
b. All matters arising as to whether a resolution was made

or, a person or authority has acted in excess of the
powers conferred on it by this Constitution or
any other provision made thereunder;
c. All matters relating to elections under this Constitution;

d. Impeachment proceedings against any members of

the Executive Officers;
e. An appeal from the Judicial Board of a JCR provided

that the Chairperson of the Judicial Board of the said
JCR shall
not be empanelled to hear such an appeal; an
f. An appeal from a College, Faculty, School or

Department association.
g. A dispute between or amongst any two or more JCRs of

the Halls of residence in this university.
(2) For the purposes of hearing and determining for a

cause or matter within its jurisdiction the
Judicial Board shall, have power to do such things as shall be
reasonably necessary thereto including the
issuing of prerogative writs or orders of mandamus,
certiorari, prohibition, quo warranto, declaration and
injunctions and issue directions for the purpose of
enforcing or securing the enforcement of its powers.
(3) Without prejudice to any provision in this Constitution,

the decisions of the Judicial Board on matters of
interpretation of this Constitution shall be final and
conclusive.
45. Laws of Ghana
Notwithstanding clause (1) and (2) of article 43 of this

Constitution, in the exercise of its functions, the Judicial
Board shall be guided by the Constitution of the

Republic of Ghana, the laws of Ghana and the Statutes

of this University.
46. Mode of Exercising Judicial Power
(1) Except in impeachment proceedings, the Judicial

Board shall be duly constituted for its work by
not less than five members of the Judicial Board.
(2) The Chairperson of the SRC Judicial Board shall preside

over sittings of the Judicial Board, and in his absence,
the member nominated by other members of the
Judicial Board shall preside.
(3) In all matters unless specifically provided to the

contrary, the decision of the Judicial Board shall be by
simply majority.
(4) The Judicial Board shall, in the exercise of its functions,

be bound to give written reasoning for its decisions.
47. Tenure
(1) The Chairperson and other members of the Judicial

Board shall hold office for a period of one academic
year.
(2) Without prejudice to clause (1) of this article, the term

of office of the members of the Judicial Board shall
expire five days after the first sitting of the
General Assembly and provided that the

General Assembly approved the student nominated as

the Chairperson of the Judicial Board.
(3) Pursuant to clause (1) of this article, the out-

going members of the Judicial Board including the
Chairperson shall hand-over to the new
members of the Judicial Board within five days after the
approval of the student
nominated as the Chairperson of the SRC
Judicial Board.
(4) The Chairperson and other members of the Judicial

Board shall before assuming office, take and subscribe
to, the Judicial Oath/Affirmation provided for in the
Sixth Schedule to this Constitution before the General
Assembly at a special sitting called for that purpose not
later than forty-eight hours after the expiration of the
term of the out-going members.
(5) A member of the Judicial Board shall cease to hold

office:
a. If he ceases to be the Chairperson of the Judicial Board

of his JCR; or
b. If he resigns by writing signed by him and addressed to

the Executive Committee through the President
provided that at least twenty-one (21) days' notice is
given; or
c. If he is unable to perform the functions of his office

whether arising from infirmity of body or mind; or
d. For stated misbehaviour or incompetence, provided

that in (c) and (d) the member against whom the
petition is made is entitled to be heard in his defence by

himself or by a counsel or other expert of his choice

before the Appeals Board.
48. The Appeals Board

an appeal shall lie as of right from a judgement or order
of the Judicial Board to the Appeals Board whose
decision shall be final.
(2) The Appeals Board shall consist of:
a. The Dean of Student Affairs
b. The Registrar of this University or his representative
c. The Chairperson of the Judicial Board, or in his absence,

a member nominated by other members of the Judicial
Board; and
d. All Legal Secretaries to the various JCRs of the Halls of

residence.
(3) The Appeals Board shall be duly constituted for its work
by five members, including the Dean of Student Affairs,
the Chairperson of the Judicial Board or in his absence a
member nominated by other members of the Judicial
Board and three legal secretaries of the various JCRs of
the Halls of residence.
(4) The Appeals Board shall be chaired by the Dean of

Student Affairs.
(5) The decisions of the Appeals Board shall be by a simple

majority, and in the exercise of its functions, the
Appeals Board shall be bound to give written reasoning
for its decision.

49. Right to Counsel
Any person appearing before the Judicial Board or the

Appeals Board shall have a right to a legal counsel.
CHAPTER EIGHT
FINANCE
50. The Students' Fund
(1) There shall be paid into a Students Fund, subject to the

provisions of this article as well as the management of
the Dean of student Affairs:
a. All revenues or other moneys raised or received for the

purposes of, or on behalf of, the SRC or committees of
the General Assembly; and
b. Any other monies raised or received in trust for , or on

behalf of, the SRC
(2) The revenues or other monies referred to in clause (1) of

this article shall not include revenues or other monies:
a. That are payable by or under a resolution of the General

Assembly into some other fund established for specific
purposes; or
b. That may, by or under a resolution of the General

Assembly, be retained by a committee or commission
of the General Assembly that received them for the
purposes of defraying the expenses of that committee
or commission.

(3) For the avoidance of doubt, it is hereby declared that

any committee or commission of the General
Assembly, shall, within forty-eight hours of raising or
receiving any revenue or other moneys for the
purposes of, or on behalf of or in trust for that
committee or commission, unless the General
assembly by a resolution states otherwise, pay through
the Treasurer such revenue or moneys into the
Students Fund.
(4) Notwithstanding clause (3) of this article, a committee
or commission or board may with the prior approval of
the General Assembly and the management of the ean
of Student Affairs, retain a percentage of revenues or
monies received or had in accordance with clause (2) of
this article.
51. Withdrawal from Students' Fund
(1) No monies shall be withdrawn from the Students' Fund

except to meet expenditure that is charged on that
fund by this Constitution or by a resolution of the
General Assembly and approved by the Dean
of Student Affairs.
(2) Any receipt into or withdrawal from the Students Fund

by any document whatsoever shall be authenticated by
the signatures of the Chairperson of the Finance
Committee, the Treasurer and the President or the Vice-
President.

52. Budgets
(1) The President shall cause to be prepared and presented

to the General Assembly, at the beginning of each
semester, estimates of revenues and
expenditure of the SRC or committees of the General
Assembly for that semester.
(2) Without prejudice to clause (1) of this article the

President shall within twenty-one days after
assumption of office, present to the General Assembly,
the proposed programmes or projects or activities to
be undertaken by the Executive Officers during their
tenure of office.
(3) The proposed estimates of expenditure of any

committee or commission or boards shall be classified
under programmes or activities of the SRC and shall be
presented to the General Assembly to provide for the
issue from the Students Fund or such other appropriate
fund, of the sums of money necessary to meet that
expenditure and the appropriation of those
sums for the purposes specified.
(4) The General Assembly shall prescribe the procedure for

the presentation of such estimates

(5) Where, in respect of the semester, it is found that the

amount of monies appropriated for any purpose is
insufficient or that a need has arisen for expenditure for
a purpose for which no sum of money has been
appropriated, a supplementary estimate showing the
sum of money required, shall be presented to the
General Assembly for its approval.
(6) Notwithstanding the provision of the preceding

clauses of this article, the President may cause to be
prepared and presented to the General Assembly,
estimates of revenue and expenditure of the
SRC for periods of over one semester for development or long
term purposes.
53. Expenditure in Advance of Appropriation
Where it appears to the President that the estimate in

respect of any semester will not come into operation by
the beginning of the semester he may, with the prior
approval of the General Assembly, authorize the
withdrawal of monies from the Students Fund for the
purpose of meeting expenditure necessary to carry out
the activities of the SRC.
54. Projects and Programmes Exceeding Tenure
(1) Any transactions, projects or programmes that may

exceed the tenure of office of the Executive Officers
shall not be entered into, except with the prior approval
of two-thirds majority of all members of the General
Assembly present and voting.
(2) The General Assembly shall have power to modify the

terms of, or rescind any transaction or contract which in

the opinion of two-thirds
Majority of members present and voting, is not in the

best interests of the general student body or
inconsistent with the provisions of this Constitution.
55. Financial Reporting
(1) The SRC Treasurer shall at the last sitting of the General
Assembly for the first semester, present a statement of
accounts to the General Assembly, and at the last
sitting of the second semester, a detailed and
audited financial statement, which shall comprise all
transactions carried out in the name of the SRC
within the given tenure.

CHAPTER NINE
COMMITTEES OF THE GENERAL ASSEMBLY
56. Committees
(1) The General Assembly shall appoint standing

committees and other Committees as may be
necessary for the effective running of the SRC
(2) The standing committees shall be appointed at the first

sitting of the General Assembly and shall be charged
with such functions assigned by this Constitution or
any other decision of the General Assembly.
(3) A committee appointed under this article shall have the

powers, rights and privileges for:
(a) Enforcing the attendance of witnesses and examining

them on oath, affirmation or otherwise;
(b) Compelling the production of documents; and
(c) Issuing a commission or request to examine witnesses

outside the campus.
57. Finance Committee
72
(1) There shall be a Finance Committee which shall pre -

audit all financial transactions of the Executive Officers
or commissions or committees involving amounts in
excess of an amount that shall be determined by the
General Assembly.
(2) The Finance Committee shall comprise:
(a) One representative from each JCR of the Halls of

residence nominated, elected or appointed to serve on
the finance committee provided that such a
representative shall have an academic background in
finance and accountancy; and
(b) Three persons nominated by the General Assembly.
(c) The SRC treasurer shall be a Secretary of the Finance

Committee.
(3) Within four weeks before the end of each semester, the
Finance Committee shall, inform the general student
body by publishing on all notice boards, details of all
financial transactions of the SRC or commissions or
committees or boards of the General Assembly in the
preceding semester or the current semester.
(4) The quorum for Finance Committee meeting shall be

five members including the Chairperson or Secretary.
58. Default by Finance Committee
(1) Where there is a default on the part of the Finance

Committee and such a default is found by the

Judicial Board to be due to the wilful neglect or refusal or

incompetence or both of the members of the Finance
Committee or refusal to comply with this part of the
Constitution every such member of the committee
shall cease forthwith to be a member of the Finance
Committee.
(2) Where the default is found to have been caused either

wholly or in part by any member of the Executive
Committee such a member shall suffer the
penalty as may be determined by the Judicial Board,
based on recommendations of the Audit Board.
59. Non – Compliance
Any person who, intentionally or otherwise, fails to

comply with the provisions of this Chapter shall, be
liable to account for such non - compliance, or to any
other punishment prescribed by the General Assembly
or determined by the Judicial Board.
60. Duties of Finance Committee
(1) The Finance Committee shall:
(a) Encourage and promote the efficient utilization of the

resources of the SRC through effective and efficient
finance measures;
(b) Do all other things not inconsistent with this Chapter as

may be prescribed by a resolution of the General
Assembly not inconsistent with this Constitution;
(c) Be responsible for monitoring the receipts and

payments out of the Students Fund and shall report to

General Assembly at least twice every semester.
(2) The Finance Committee shall, not later than four weeks
before the last sitting of the General Assembly in each
semester, submit to the Audit Board for audit, a
statement of receipts and payments into and from the
Students Fund.
(3) The Finance Committee shall report to the General

Assembly on all other contributions, their sources,
dates of receipt and all other particulars of such
contributions to the SRC or committees or
commissions or boards of the General
Assembly.
(4) (a) The Audit Board shall publish its transitional report, on
all available media including notice boards of all JCRs of
the Halls of residence, at least 24 hours before it is
submitted to the General Assembly under
clause (1) of this article.
(b) The approved report shall then be published in the

same manner as provided in sub-clause (a) of this
clause, within 72 hours after the approval of
(c) Notwithstanding (b) of this clause, where a committee

is set up under clause (5) of this article, the approved
report shall be published within such time as shall be

specified by the General Assembly, after the

recommendations of the said committee have been
approved.
(5) The Chairperson of the Audit Board shall, not later than
two weeks after the submission of the statement
referred to in clause (2) of this article, submit a report to
the General Assembly on the statement.
(6) The General Assembly shall debate the report of the

Audit Board and appoint, where necessary, in the
interest of students, a committee to deal with
any matters arising from the report.
(7) A committee set up by the General Assembly under

clause (5) of this article shall, present its report to the
Audit Board within seven days after the said committee
has been appointed.
(8) The Audit Board shall thereafter, publish the report of

its findings on all notice boards in the halls of residence
within seventy-two hours after the General Assembly
has debated on the report of the committee set up by
the General Assembly under clause (5) of this article
whichever is earlier.
61. The Audit Board
(1) There shall be an Audit Board which shall comprise five

members appointed by the General Assembly at its first
sitting provided that three of the persons so appointed
shall be persons professionally qualified or having a
reasonable degree of knowledge in auditing and
accounting and provided also that there are not two
persons on the Board from one and the same hall of

residence on campus.
(2) The accounts of the SRC and all committees,

commissions or institutions established under this
Constitution or by a resolution of the General Assembly
shall be audited and reported on by the Chairperson of
the Audit Board to the General Assembly.
(3) For the purposes of clause (2) of this article, the

Chairperson of the Audit Board or any person
authorized or appointed for such purpose by the
Chairperson of the Audit Board shall have access to all
books, records, returns and other documents relating
or relevant to those accounts.
(4) The accounts of the SRC and of all other committees or

commissions referred to in clause (2) of this article shall
be kept in such forms as the Audit Board shall approve.
(5) For the purpose of its work, it shall be lawful for the
Audit Board to subpoena any person,
including members of the Executive Committee
to appear before it.
(6) Any person who, knowingly or recklessly makes either

orally or in writing to the Audit Board, any statement,
conveying any information or explanation required by
the board or to which the board is entitled and which is
misleading, false or deceptive shall, be liable to any
sanctions approved by the Judicial Board or the
General Assembly upon the recommendation of the
board whichever may be appropriate.
77
62. Independence and Powers of the Audit Board
(1) In the performance of its functions under this

Constitution or any other resolution of the General
Assembly not inconsistent with this Constitution, the
Audit Board:
a. Shall not be subject to the direction or control of any

other person or authority;
b. Shall disallow any item of expenditure which is contrary

to the provisions of this Constitution or a resolution of
the General Assembly and surcharge
I. The amount of any expenditure disallowed upon the

person responsible for incurring or authorizing the
expenditure or
ii. Any sum which has not been duly brought into
account, upon the person by whom the sum ought to
have been brought into account; or
iii. The amount of any loss or deficiency, upon any person

by whose negligence or misconduct the loss or
deficiency has been incurred.
(2) A person aggrieved by a disallowance or surcharge

made by the Audit Board may appeal to the Judicial

Board
(3) The General Assembly may by a resolution, through the

Dean of Student Affairs request the Academic Board of
the University, through the Registrar of the University
of Ghana to withhold the results and awards of any such
student who refuses to comply with the provisions of
this article.
63. Administrative Expenses of the Audit Board
(1) The administrative expenses of the Audit Board shall be

charged on the Students' Fund.
(2) The accounts of the Audit Board shall be audited and

reported upon by an auditor appointed by the General
Assembly.
64. Dues and Other Amounts Paid by Students
(1) No amount shall, unless by a resolution of the General

Assembly introduced by the Executive Committee, be
imposed on any student.
(2) (a) For the avoidance of doubt, it is hereby declared that

the SRC dues to be paid by the students shall be
debated upon at the General Assembly before its
imposition or the imposition of any other charge on the
Students Fund in the payment, issue or withdrawal
from the Students' Fund.
(b) Furthermore, dues to the NUGS and USAG shall be paid

before the end of the second semester of each
academic year, provided that the SRC retains
membership of the said unions.
79
65. External Affairs Committee
(1) There shall be an External Affairs Committee which

shall be responsible for the organization of student's
travels outside Ghana and other external affairs of the
SRC or the co-ordination of the SRC relationship with
NUGS or other organizations or institutions.
(2) Appointment to serve on the External Affairs

Committee shall be made by the Executive Officers
provided that some of the appointments come from
the General Assembly
(3) The External Affairs Committee shall be the same as the

Local NUGS Secretariat.
(4) A person shall not be eligible for appointment as a

Chairperson, Secretary or Treasurer to the
External Affairs Committee unless he/she is a member
of the General Assembly.
(5) The Chairperson of the External Affairs Committee shall

be the local NUGS President.
(6) The Secretary and Treasurer of the External Affairs

Committee shall be the Local NUGS Secretary
and Treasurer respectively and shall be appointed

by the Executive Officers from within the General Assembly

and with the prior approval of the same.
66. Publications and Information Committee
(1) There shall be a Publication and Information

Committee which shall be charged with the
responsibility for:
(a) Ensuring the effective and efficient running of the SRC

FM Station, Radio Univers, Voice of Legon; and
(b) Carrying out effective publicity and advertisement of

all SRC activities.
(2) A person shall not be eligible for appointment to the

Publications and Information Committee unless he is a
member of the General Assembly
(3) The composition of the Publication and Information

Committee shall be:
(a) The Editor-In-Chief who shall be the Chairperson,

appointed by the Executive Committee with
the prior approval of the General Assembly;
(b) Two Editors
(c) Two Sub-Editors

(d) Legal Advisor;
(e) Treasurer
(f ) One member from each JCR of the Halls of residence.
(4) Publications made by the Committee may be sold to

students and the general public at a price to be
determined by the Publications and Information
Committee.
(5) The Chairperson of the Publications and Information

Committee shall submit the accounts of the Committee
to the Finance Committee or the Audit Board in
accordance with the provisions of this Constitution.
(6) The Chairperson of the committee shall be the Press

Secretary to the SRC and shall oversee all the public
relation issues of the SRC including preparations for
Press Conferences and the release of relevant
information required by the general student body as
the Executive Committee or Executive Officers may
direct. The Committee shall make use of all available
media to actively inform students on issues relevant to
their welfare, including the Internet, print and audio-
visual media, according to best practices and standards
as they may apply.
(7) The Publications and Information Committee shall at

the beginning of every semester, notify members of the
General Assembly of all vacancies on all committees as
provided for in this Constitution including committees

in this University on which the SRC is required to send

representatives.
67. Welfare Committee
(1) There shall be a Welfare Committee that shall be

responsible for:
(a) Ensuring the welfare of the members of the General

Assembly and students at large;
(b) Ensuring the highest standard of hygiene as well as

product and service quality at all centres where food
and/or other products and services are produced
and/or rendered to students, as the case may be.
(c) Working with the appropriate bodies or units to ensure

the continuous and optimum functioning of all student
facilities, including but not limited to lecture rooms,
wash rooms and residential quarters and utilities.
(d) Working with the relevant bodies or units of the

University to ensure the maintenance of security, road
and general safety, efficient campus – wide
transportation, and health, as well as all other sectors in
which the welfare of students may be directly or
indirectly affected.
(e) Working together with the Welfare Committee of the

JCRs of the Halls of residence to ensure the best

possible conditions of residence and affiliation for all

affiliates.
(f ) The performance of any other duties assigned to it by

the General Assembly or the Executive Committee
(2) Appointment to serve on the Welfare Committee shall

be made by the Executive Committee provided that the
said appointments are made either wholly or partly

from the General Assembly.
(3) The Chairperson of the Welfare Committee shall be

appointed by the Executive Officers at the first sitting of
the General Assembly subject to the approval of the
General Assembly.
68. Projects and Programmes Committee
(1) There shall be a Projects and Programmes Committee

which shall have the responsibility for:
(a) Taking proper and true record of all assets of the SRC
(b) Implementing and seeing to the successful execution

of all projects or programmes of the SRC.
(2) The Committee shall, at the beginning of each

semester, draw up a programme of activities and
present it to the General Assembly for approval which
shall be published on the notice boards of the JCRs of
the Halls of residence.
(3) Members of this Committee shall be appointed by the

Executive Committee with the prior approval of the
General Assembly from amongst members of the

General Assembly or persons nominated by

each JCR, except that majority of members of this
Committee shall be appointed from among members of
the General Assembly, at the first sitting of the
General Assembly.
(4) The Chairperson, Secretary and Treasurer of this

Committee shall be appointed by the Executive
Officers at the first sitting of the General Assembly, with
prior approval of the General Assembly.
79. Stock Taking
Without prejudice to any provision in this Constitution,

the Programmes and Projects Committee shall, within
three weeks of appointment or within three weeks of
the coming into force of this Constitution, take stock of
all the assets of the SRC and shall report to the General
Assembly forthwith.
70. Intelligence Committee
(1) There shall be an Intelligence and Students Affairs

Committee which shall be the investigative
and research body of the SRC
(2) Membership of this committee shall comprise:
(a) The Press Secretary
(b) The Legal Advisor
(c) Eight other members appointed by the Chairperson

such that JCRs, Faculties, Colleges and Schools shall be

adequately represented to the extent possible.
(3) The Chairperson, of this Committee shall be appointed

by the Executive Officers, in consultation with the
Executive Committee, subject to the approval
(4) The Intelligence and Students Affairs Committee shall,

subject to the provisions of this Constitution, have the
responsibility to:
(a) Conduct research and collate data and other

information affecting the welfare of students of this
University and Students in Ghana as a whole;
(b) Collate and analyse information on various issues of

national interest for purposes aimed at contributing to
debates and discussions on issues of national
importance, including writing of articles and
comments in the media.
(c) Committee with respect to the provision of analysed

research information in accordance with this
Constitution or a resolution of the General Assembly, so
as to fulfil the aims and objectives set out in article 4 of
this Constitution; and
(5) Pursuant to the provisions of this article, the

Intelligence and Students Affairs Committee shall have:
(a) No restrictions as to the files, books and records

available at any JCR or the SRC, and shall exercise the
right to information as enshrined in the Constitution of
Ghana including any information at the Registry of the

University which affects, either directly or indirectly, the

welfare or interests of the students in this University.
(b) The right to summon any student to appear before it for

purposes incidental to the efficient performance of its
duties.
(6) Notwithstanding anything contained in this article, in

the performance of its duties, the Intelligence and
Students affairs Committee shall be subject to
the provisions of this Constitution, including a
resolution of the General Assembly not inconsistent with
the provisions of this article or the supervisory
powers of the Judicial Board, and shall report directly to
the Executive Committee through the President.
71. Arbitration Committee
(1) There shall be an Arbitration Committee which shall be

composed of five members appointed by the Executive
Officers in consultation with the Executive Committee
and subject to the approval of the General Assembly,
provided that such members shall be heads of religious
denominations of students in this University.
(2) The Arbitration Committee shall:
(a) Advise the Executive Officers and the Executive

Committee periodically on issues affecting students;
(b) Be a facilitator of the maintenance of tranquillity and

social harmony within the University, as well as of the
resolution of conflicts between and/or among
students, JCRs of the Halls of residence or the SRC and

the administration of this University.
(c) In the event of a dispute between any given parties, the

Arbitration Committee may arbitrate on the matter, as
the Judicial Board may recommend or as the parties
may opt for. Settlements made under such arbitration
shall be binding on all parties involved.
(d) Settlements arrived at from all such arbitrations shall be

reported in writing to the Judicial Board.
(3) In the performance of its functions, the Arbitration

Committee shall be accorded all the recognition,
respect and audience by the General Assembly,
Executive Committee and any student or body of
students of this University.
(4) Any person or body of persons wishing to appear

before the Arbitration Committee shall submit
a petition addressed to the Chairperson of the
Committee who shall convene a meeting of
such parties within seventy-two hours after receipt
of the petition provided that where the Arbitration
Committee is seized of a matter no other person or
group of persons hall take up the matter.
(5) Settlements arrived at under this Committee shall be

binding on parties appearing before it unless an appeal
is made to the Judicial Board on grounds of bias or error.
72. Disciplinary Committee
(1) There shall be a Disciplinary Committee whose

members shall come from the General Assembly, and
shall have a Chairperson and Secretary appointed from

among its members by the Executive Committee

subject to the approval of the General Assembly.
(2) The Disciplinary Committee shall have the power to

deal with all acts of indiscipline on the part of any
member of the General Assembly or student
referred to it by the General Assembly or any member of
the Executive Committee or any JCR.
(3) Notwithstanding any provision to the contrary, the

General Assembly shall, acting on the advice of the
Disciplinary Committee have power to recommend
appropriate punishments to the Dean of Students, the
Registrar or the Vice-Chancellor for implementation,
except where the recommendation of the Disciplinary
Committee is on appeal to the Judicial Board.
73. Academic Affairs Committee
(1) There shall be a seven – member Academic Affairs

Committee which shall be appointed by the
Executive Officers in consultation with the Executive
Committee, subject to the approval of the General
Assembly.
(2) The duties of the Committee shall include:
(a) The pursuance and implementation of all resolutions of

the General Assembly concerning academic

endeavour in this University or that are directed to the

Committee.
(b) The receipt of all complaints and observations made by

students on their academic pursuits and the pursuance
of the appropriate resolution(s) of the same.
(c) Working with all relevant bodies to ensure the highest

level of academic standards in the University.
(d) The provision, upon request, of substantiated and

reliable information on procedures or other
relevant aspects of the academic structure of the
University.
(e) Carrying out, on a consistent basis, research to inform

the prudent development of academic facilities,
resources and conditions in the University, as well as
the timely mitigation of the threats to the academic
quality and integrity of the University.
(3) The Chairperson of the Committee shall present a

report to the General Assembly on the work of
the Committee at least twice every semester.

Assembly may request the Chairperson of the
Academic Affairs Committee to report on any issue
incidental to the discussions of the General Assembly.
(5) For the avoidance of doubt, presentations made under

clause (3) of this article shall not include reports
rendered under clause (4) of this article.

74. Non-Resident Students Affairs
(1) There shall be a seven (7) member Non-Resident

Students Committee which shall consist entirely of
non-resident students of this University, and shall be
appointed by the Executive Officers, in consultation
with the Executive Committee, subject to the Approval
(2) The duties of the Non-Resident Students Committee

shall include:
(a) The pursuance and resolution of issues relevant to the

welfare of non-resident students of this University;
(b) Working with relevant bodies to enhance services

directed towards non-resident students, such
as transportation and alternative residential
services.
(c) The receipt, pursuance and resolution of complaints

and observations made by non-resident students on
issues affecting their well-being, provided that such
issues are related to their status as non-resident
students.
(3) A non-resident student, for the purposes of this article,

shall be a student who does not have residence in any
such facility located on the campuses of this University.
75. Women's Commission
(1) There shall be a Women's Commission which shall be

appointed by the Executive Committee, with the prior

approval of the General Assembly.
(2) The membership of the Women's Commission shall

comprise:
(a) A Chairperson;
(b) A Deputy Chairperson;
(b) A Secretary;
(c) A Treasurer;
(d) An Organising Secretary; and
(e) Five other members
(3) The Chairperson shall be appointed by the Executive

Committee from among the membership of the
Commission.
(4) The duties of the Women's Commission shall include:
(a) Pursuing the harnessing, distillation and employment

of the intellectual and other appropriate capacities of
female students for the advancement of society.
(b) Carrying out educational and other capacity building

programs and activities aimed at improving the social,
economic and academic circumstance of women in the
University and in Ghana.
(c) Pursuing actively the agenda of ensuring the cessation

of all discriminatory and harmful practices against

women in Ghana.
(d) Actively working towards the appropriate and

acceptable exercise, in accordance with this
Constitution, and the Laws of Ghana, the rights of
women, especially in cases where such rights
are or have the propensity to be infringed upon, denied or
abused,
(e) Work towards greater participation among women in

affairs incidental to the advancement of the University
and Ghana as a whole.
76. Scholarship Committee
(1) There shall be a Scholarship Committee which shall

work in conjunction with the Welfare Committee and
the Academic Affairs Committee
(2) Membership shall comprise
a. The Chairperson
b. The Heads of the Welfare Committee and the Academic

Affairs Committee
c. Three other members appointed by the executive

officers, one of whom shall be the
Chairperson.
3. The duties of the Scholarship committee shall include
a. They shall work with the publications and information

committee to ensure adequate advertisement of the
scholarship to students each semester

b. The head will be represented on the board of managers

of the scholarship committee
c. They shall develop ways of raising funds to complete

the efforts of the board of managers
d. They shall regularly in conjunction with the office of the

students with the financial aid office, report to the
general assembly the number of beneficiaries
of the scheme each semester, and the general running of the
scheme
e. They shall perform any other duty assigned to them by

the board of managers, the executive committee and
the president
77 Ad-hoc Committees
(1) Notwithstanding the provisions of this Chapter, the

General Assembly shall have the power to create sub or
ad-hoc Committees to deal with any mater in the
pursuit of its aims.
(2) Without prejudice to any provisions in this

Constitution, the General Assembly shall have the
power to co-opt any student(s) of this
University to serve on such committees and/or on any
University standing committee as it deems fit.
78. Reports to the General Assembly
(1) Any person appointed by the General Assembly, the

Executive Committee or the Executive Officers to serve
on any Committee in this University to which the SRC
has representation shall report to the General
Assembly at least twice every semester.
(2) The President shall, at the first sitting of the General

Assembly, after assumption of office, bring to the

notice of the General Assembly, such councils,
committees and boards in this University on which the
SRC has representation.
(3) The General Assembly shall approve nominees for such

committees, councils and boards.
79. Presentation of Report
Every committee of the General Assembly shall submit

a written report on its activities to the General
Assembly once every two months or at the beginning
of each semester and at the end of a session of the
General Assembly.
80. Procedure of Committees
Every committee shall, subject to the provisions of this

Constitution or a resolution of the General Assembly,
regulate its own procedure for its activities, and this
shall not be inconsistent with the provisions of this
constitution.
81. Responsibility of Committee Members
Any person appointed to any committee or office who:
(a) Misappropriates any funds; or

(b) Conducts himself in such a manner as to cause

depreciation, whether in respect of loss or otherwise, in
any cash property entrusted to him; or
(c) Conducts himself in a manner inimical to the

functioning of the committee, or that brings or has the
potential to bring the SRC into disrepute
Shall be liable to be removed from office by the

respective appointing body or officer, and/or to make
good the loss and/or be liable to any punishment
prescribed by the General Assembly.
CHAPTER TEN
COMMISSION OF INQUIRY
82. Appointment of Commission
(1) The General Assembly shall appoint a Commission of

Inquiry into any matter of interest to students
whenever:
(a) The Executive Officers are satisfied that a Commission

of Inquiry should be appointed; or
(b) The Executive Committee advises that it is in the

interest of students so to do; or
(c) The General Assembly, by a resolution requests that a

Commission of Inquiry be appointed to inquire into any
matter specified in that resolution as being a matter of
importance to students.
(2) A commission appointed under clause (1) of the article

may consist of a sole commissioner or two or more

persons one of whom shall be appointed the

Chairperson of the Commission.
(3) A person shall not be appointed a sole commissioner or

the Chairperson of a Commission of Inquiry under this
article unless he:
(a) Is qualified to be appointed as an Executive Officer

under this Constitution; and possesses special
qualifications, knowledge or expertise in
respect of the matter being inquired into.
83. Duties of the Commission
(1) A Commission of Inquiry shall:
(a) Make a full, faithful and impartial inquiry into any

matter specified in the instrument of
appointment;
(b) Report in writing to the Chairperson of the General

Assembly, the result of the inquiry; and
© Furnish in the report the reasons leading to the

conclusions stated in the report.
(2) Where a Commission of Inquiry makes an adverse

finding against any person, an appeal shall lie
as of right from the findings of the commission to the
Judicial Board which shall be exercisable within seven days
after the finding is made and announced to the general
student body
(3) A person whose conduct is the subject of inquiry by a

Commission of Inquiry, or who may in any way be

implicated or concerned in any matter under
inquiry, is entitled to be assisted by such expert as may
reasonably be necessary for the purpose of
protecting his interests in the inquiry.
CHAPTER ELEVEN
HONORARIUM
84. Certificates or Awards
(1) (a) Certificates of honour or other awards shall be

presented to the Executive Officers, members
of the Executive Committee, the General Assembly, and the
Judicial Board upon the successful completion of their
tenure of office at a handing over ceremony to be held
in public. All committee, commission and board
members shall be entitled to certificates or awards.
(b) Awards to other individuals who have contributed to

the cause of the SRC shall be approved by the Executive
Committee before they shall be awarded.
(2) The determination of the honorarium to be given to the

Executive Officers as vacation residence fees including
cost of meals and other living expenses, and the sitting
allowances of the student members of the Judicial

Board shall be made by the General Assembly.
(3) An Elder Statesman may, whenever it shall be deemed

necessary, provided he shall be available, be consulted
on issues incidental to the work of the SRC or issues
concerning students in General.
(4) Any person who has been a member of the Executive

Committee or a leader of the General Assembly under
article 7 of this Constitution, and has successfully
completed his tenure of office shall be called an Elder

Statesman.
(5) A citation enumerating his contributions to the

interests of students may be awarded to each of at most
such five (5) persons in a particular year.

no special privileges shall go with the status of an Elder
Statesman except that recognition, audience and
honour shall be accorded to such a person.
(7) A book of Honours of Elder Statesmen shall be kept in

the office of the SRC in which the names and other
particulars together with citations of Elder
statesmen shall be recorded and preserved. Such records
shall date back to the 1978 academic year.

CHAPTER TWELVE
AMENDMENTS
85. Amendments and Reviews
(1) No amendment of this Constitution shall be proposed

unless notice of such amendment has been given, in
writing to the Judicial Board signed by at least one
hundred supporters from among the students
provided that five (5) such signatories shall be
from each JCR of the Halls of residence.
(2) There shall be a preliminary hearing on the proposals

for amendment by the Judicial Board within seven (7)
days of receiving such a proposal, and where it is
satisfied that conditions required an amendment of
this Constitution, it shall give permission for the
amendment
(3) The Judicial Board shall issue an order directing the

Executive Committee to appoint a commission in

accordance with article 80 of this Constitution

with such terms of reference as to reflect the proposal for
amendment.
(4) A Commission appointed in accordance with clause (3)

of this article shall present draft proposals of the
requested amendments to the General Assembly for
consideration.
(5) For the purpose of consideration and debating on the

draft proposals referred to in clause (4) of this article, at
least, half of the total membership of the General

Assembly shall be present and the vote of two-thirds of
such members shall be required to continue the
process of the amendment.
(6) The Commission responsible for the amendment shall

publish the provisions intended to be amended
together with the proposals for amendment and the
draft provisions on all notice boards for at least twenty-
one days and provided that within the said twenty-one
days there shall be a deliberation in each appropriate
legislative body of the JCRs of the traditional Halls of
affiliation on the proposals.
(7) No amendment shall be deemed to have been made

unless after the vote of the General Assembly, at least
seven JCRs of the Halls of residence voted in support of
the proposals.
(8) Where the proposals are approved, the new

constitution shall come into effect with seventy-two

hours after the last JCR has voted on the proposals for
amendment.
(9) The Commission charged with the responsibility for the

purposes of this article shall, present at a public forum,
copies of the new constitution together with a report to
the Executive Committee
(10) Amendments to this Constitution shall be listed and

annexed to this Constitution in the nature of
amendments and shall be numbered in their order of
creation dated and gazette.
(11) For the purposes of this article, the Electoral

Commission shall supervise the vote on the question of
amendment at any JCR meeting of the Halls of
residence, called for that purpose.

CHAPTER THIRTEEN
MISCELLANEOUS
86. Copies of the Constitution
(1) Copies of this Constitution shall be made available to

every member of the General Assembly at the
beginning of the tenure of office of such members of
the General Assembly. Judicial Board members shall
also be given copies of the Constitution and copies of
the Statutes of the University at the same period as
General Assembly members are given copies of this
Constitution.
(2) Without prejudice to clause (1) of this article, the SRC

Secretary shall cause to be kept in each Hall Library and
the Balme Library, and shall make available, copies of
this Constitution for reference by any student.
(3) Every member of the General Assembly, upon

assuming office, shall be oriented adequately on the

provisions of this Constitution.
87. Indemnity
(1) Members of the General Assembly, Executive

Committee or other committees, commissions and
boards of the General Assembly shall be indemnified
out of the assets and funds of the SRC against any legal
or other liabilities as may be incurred for and on behalf
of the SRC, provided that such liabilities shall have been
incurred in the course of lawful execution of duties
assigned to them under this Constitution or by a
decision of the General Assembly.
(2) In the event of any legal proceedings being instituted

against the SRC, the President shall represent the SRC.
88. Invitations to Programmes

(1) The Executive Officers, in consultation with other
members of the Executive Committee shall have power
to nominate delegates, representatives or participants
to any conferences, seminars or projects to which the
SRC has been invited
(2) The delegates, representatives or participants shall
present written reports to the General Assembly
through the President, seventy-two hours after such
conferences, seminars or projects
(3) The report shall be published by the Secretary on all
available media, including all JCR notice boards in the
Halls of residence within a reasonable period of time
after its submission to the General Assembly.
89. Representation at NUGS Programmes

(1) Without prejudice to any provision in this Constitution,

delegations to NUGS Central Committee meeting,
Annual Congresses and other functions shall
include members of the General Assembly.
(2) Without prejudice to clause (1) of this article, the
capitation fee of delegates to the Annual NUGS
Congress shall be a charge on the Students' Fund of the
SRC.
90. Reports and Archives

There shall be kept in the SRC offices, on suitable media,
records of succeeding committees, commissions and
boards of the General Assembly or any other
committee established under a resolution of the
General Assembly.

SCHEDULE ONE
TRANSITIONAL PROVISIONS
(1) Notwithstanding any provision in this Constitution, the

person duly elected or appointed under any
Constitution or law in force immediately before the
coming to force of this Constitution shall be taken to
have been duly elected for the purposes of this
Constitution.
SCHEDULE TWO
THE PRESIDENTIAL OATH/AFFIRMATION

office of President (or Vice President) of the Student

Representative Council do hereby solemnly affirm/in
the name of God swear (solemnly affirm) that I will be
faithful and true to the SRC; that I shall strive at all times
to preserve, protect and defend the Constitution of the SRC and
I hereby dedicate myself wholly, without fear nor favour, to the
service and welfare of the students of the University of Ghana in
particular and of Ghana in general.
I further solemnly swear/affirm that I will conform to t h e

principle of strict accountability financially and o t h e r w i s e
and that should I at any time break this oath/affirmation of
office, I shall submit myself to the dictates of the SRC
Constitution and suffer the penalty therefore (SO HELP ME
GOD).
To be affirmed/sworn before the Chairperson of the

Judicial Board at a public ceremony at which the
officials of the University and the student body shall
be present.
SCHEDULE THREE
EXECUTIVE OFFICERS OATH/AFFIRMATION
I …………………………….. having been elected

Secretary / Treasurer to the SRC, do hereby solemnly
affirm/in the name of God swear (solemnly affirm) that I
will at all times faithfully and truly serve the SRC in my
capacity as Secretary / Treasurer, that I will support and
uphold the principle of meticulous accountability financially
and otherwise, that I will seek the welfare of the students of the
University of Ghana in particular and the welfare of the student
of Ghana in general.

I further solemnly swear/affirm that should I at any time break

this oath/affirmation of office, I shall submit to the penalty
prescribed by the SRC Constitution.

To be affirmed/sworn before the Chairperson of the Judicial

SCHEDULE FOUR
THE EXECUTIVE COMMITTEE OATH/AFFIRMATION

strive at all times to preserve, protect and defend the SRC
Constitution, especially the principles of meticulous

service and welfare of the students of the University of Ghana.
I further solemnly swear/affirm that, I shall not be found

wanting in the discharge of my responsibilities as a member of
the Executive Committee of the SRC nor place myself in such a
position as to frustrate the efficient functioning of the said
Executive Committee of the SRC. (SO HELP ME GOD)

God swear (solemnly affirm) that I will bear true faith of
allegiance to the SRC Constitution and uphold, preserve,
protect and defend the SRC Constitution and expose with
faithful zeal any act, commission or omission or any other
matter that would undermine the said SRC Constitution.
To be affirmed/sworn at the first general meeting of the

Assembly and administered by the Chairperson of the Judicial
Board.

SCHEDULE SIX
THE JUDICIAL OATH/AFFIRMATION
I ……………………….. having been appointed as a member of

the SRC Judicial Board, do hereby solemnly affirm/in the name
of God swear (solemnly affirm) that I will interpret the SRC
Constitution without fear nor favour, and I will defend and
uphold the Constitution, and adjudicate on all matters that shall
be brought to the Judicial Board without affection, ill-will nor
personal interest.
I further solemnly swear/affirm that I shall not be found wanting

in the discharge of any responsibilities as a member of the SRC
Judicial Board nor place myself in such a position as to frustrate
the efficient functioning of the said Judicial Board of the SRC.

and administered by the out-going SRC Judicial Board

SCHEDULE SEVEN
RULES AND REGULATIONS GOVERNING THE SRC AND NUGS

ELECTIONS
1. NOMINATIONS
a. All nomination forms shall be received from the

Electoral Commissioner or the deputies.
b. Nominations shall be filled in respect of the posts of the

Executive Officers to the SRC, to wit; President shall
have a column for the name of the Vice-President
he/she intends to appoint, who also qualifies
to be elected as an Executive Officer, provided that the
President and the Vice-President are not from one and
the same hall.

c. The Electoral Commissioner shall have power to issue

Nomination Papers to the Deputies who in turn shall
issue them to prospective Candidates who shall return
them within a period to be fixed by the Electoral
Commission.
d. For such nominations to be valid, they must be

supported by ten (10) genuine student signatories
from each Hall of Residence as well as the Medical
School, the Accra City Campus and Continues
and Distance Education Students Association,
provided however that each student signatory, shall not
support the nomination of any other candidates for the
same post. Provided further, that if such situation should
arise, the Electoral Commissioner shall give the
Prospective Candidates involved 48 hours to secure

fresh signatories or forfeit their candidature.
2. QUALIFICATION
Qualification for the post of Executive Officers under

the Constitution are contained in Chapter Six of the SRC
Constitution
3. APPOINTMENT OF POLLING AGENTS
Each Candidate, fully certified as duly nominated by the

Electoral Commission, shall appoint one (1) polling
agent per each polling station whose names should
reach the Electoral Commissioner one (1) clear week
before voting. The polling agents of all the candidates
together with the members of the Electoral
Commission shall be responsible for collectively for
removing all ballot boxes to a central point and also

shall be collectively responsible for the counting of the

ballot.
4. OTHER RULES AND REGULATIONS
a. A person can be deemed a Candidate only after he has

been vetted and has been so put up by the Electoral
Commission
b. A person put up as a Candidate may withdraw his

Candidature before the start of the various
face-to-face at the halls
c. A candidate who by the start of the face-to-face is yet to

put up a campaign poster shall be deemed to have
withdrawn his Candidature
d. A Candidate who wishes to withdraw after face-to-face

has commenced, may do so my formally writing a
withdrawal letter to the Electoral
Commissioner. Any such withdrawal however shall be
granted on terms that the Electoral Commission deems
fit.
e. A Candidate cannot withdraw his candidature a week

to the voting day.
f. No candidate, his representatives nor supporters

should campaign while voting is in progress
g. There shall not be any campaign material within 100m

radius of the polling stations on the voting day.
h. Complaints of electoral fraud and allegations of

electoral malpractices should be lodged with the
Electoral Commission within 24 hours after voting.

SCHEDULE EIGHT
STANDING ORDERS OF THE GENERAL ASSEMBLY
A. Motions
I. All members of the General Assembly shall have the

right to file a motion. Observers can only file motions
when such motions are seconded by five other General
Assembly members.
II. All procedural motions shall be submitted in writing

and must be handed over to the chairperson
whereupon the motion must be read immediately.
III. Without prejudice to II above, no matter shall be

discussed unless it concerns an approved subject on

the agenda.
IV. A motion shall only be ripe for discussion after the

mover and seconder have been given the
opportunity to justify such motion.
V. After the mover and seconder have spoken for the

motion, the Chairperson shall invite members
to debate in the following order:
a. For the Motion;
b. Against the Motion.
VI. The mover of the original motion shall have the right of
reply at the close of the debate upon his/her motion. No
further discussion on the question shall be allowed
once a decision has been taken by the House.
VII. A motion may be amended by one or other of the

following:
a. Striking out word(s);
b. Inserting word(s);
c. Substituting new word(s) for other(s);
d. Any combination of the above, a motion thus amended

shall be put first.
e. Any amended motion may be amended in the same

way as an original motion.
VIII. No amendment shall be moved which by the

Chairperson's ruling rescinds negates or destroys the
original motion.
IX. No other amendment shall be moved until the first

amendment has been disposed of, but notice of further
amendments may be given.
X. An amendment like a motion must be moved,

seconded and discussed, the amendment first tabled
and supported will be voted upon first. However,
discussions on subsequent amendments will be open
before a vote is taken on the first amendment.
XI. A motion once submitted to the Chairperson cannot be
withdrawn without the consent of the majority of

members present at such a sitting.
XII. Discussion of a motion may be curtailed in time by a

procedural motion from the Floor, with the approval of
the members.
XIII. The Chairperson shall limit debates in all such motions

provided that the mover and one speaker against the
motion shall in all cases have the right to speak if they
wish to do so.
B. Voting
I. Only General Assembly members shall have voting

rights. Each General Assembly member shall be
entitled to a single vote.

II. In voting, decisions would generally be deemed to

have been made by a simple majority, unless the
contrary is provided for in this Constitution.
III. If the number of votes for and against a motion are

equal, the motion shall be deemed lost.
C. Interventions
I. In addition to discussions on a motion, the Chairperson

shall allow the following points in order of precedence:
a. Point of Information;
b. Point of Correction;
c. Point of Order.
II. A Point of Order must be heard at all times and the

Chairperson shall give his/her ruling before the
issue is further discussed. Point of Order shall deal with the
conduct or procedure of the debate. The member rising
on a Point of Order shall prove one or more of the
following:
a. That the speaker is travelling outside the scope of the

motion under discussion;
b. That the speaker is using abusive language;
c. That the speaker is infringing upon the Constitution or

Standing Orders.
III. A Point of Correction shall be a factual presentation

seeking to correct a statement made by the last
speaker. It must be strictly related to the subject under

immediate discussion.
IV. A Point of Information is a question or a brief statement

of a relevant fact concerning the matter under
discussion. It should be directed to either the last
speaker or the Chairperson.
D. Conduct of Meetings
I. A speaker on the Floor of the House must first address

the Chair and the House before proceeding with
his/her statements.
II. A speaker on the floor of the House shall direct his/her

speech strictly to the subject on the agenda under
discussion if there is no motion on the Floor.
III. Every member shall address himself/herself solely on

the Floor.
IV. No member shall be allowed to speak more than once

on a motion so long as a member who has not spoken
on that motion desires to have the Floor.
V. No member shall speak for more than five minutes

without the permission of the Chairperson.
VI. As and when necessary, more Standing Orders may in

case of urgency or after notice is duly given, be
suspended or changed at any sitting of the General
Assembly so far as there is two-thirds majority in favour
of same.
