aforesaid builders duly Complete in all respect in good conditions.
While taking over the physical possession, I/ We have fully inspected the aforesaid Flat and have
fully satisfied myself/our-self with the nature of construction, quality of fitting and fixtures
provided therein and further satisfied myself with the boundaries / area of the Flat.
The said Flat is well furnished and fitted with all necessary fixtures as per terms of agreement and
the area / dimensions of the said entire property are also found to be correct by’ me.
However, the said colony of the builders is still under development and therefore, as Goodwill the
said builder have provided water supply from their own sources, therefore, I/We hereby expressly
agree that till completion of the said development work, and after completion of the said
development work I/We shall continue to pay the necessary charges for such water consumption as
may be demanded by the builders from time to time.
Further, the arrangement of road, drainage lines and other infrastructure facilities are to my
satisfaction and thus 1 am/ we are fully satisfied with the said property purchased by me in the said
colony of the builders.

AND WHEREAS the seller-1 for the purpose of development of a residential
Multistoried Complex on the said land has obtained colonizing licence which
was issued by the Sub-Divisiona! Officer, Tehsil-Huzur, District-Bhopal, on
06.05.1999 having Licence No. 09/99, and same has been renewed up to
31.07.2620 on 13.08.2015 by the Sub-Divisional Officer, Tehsil-Huzoor,
Distt-Bhopal,
AND WHEREAS the seller with intention to develop and construct APARTMENTS
of various types in the Complex, to be developed and Constructed under
name "SHR! KRISHNA HEIGHTS" on the said land, has obtained the approval of
the Map and Development permission from the joint Director, Town &
Country Planning Department, Distt. Bhopal, vide their Order No. 338 dated
30.04.2010, and the Seller has also obtained the DEVELOPMENT PERMISSION
from the competent authority i.e. the Sub-Divisional Officer, Tehsi!-Huzoor,
Distt-Bhopal,vide their Order No.07/2010 dated 17.06.2010 and Building
Permission from the GRAM PANCHAYAT, RAPADIA, Vikas khand, PHANDA,
Tehsil-Huzur, District-Bhopai, Vide Order dated 09.01.2012, as the said Land
is situated out of the limits of Municipal Corporation, Bhopal.
AND WHEREAS the seller has agreed to sell a FLAT Fully described
hereinabove, in favour of the purchaser upon terms and condition, as
enumerated in written Allotment Order dated- 20.02.2018 and in
furtherance of the said Allotment Order the seller hereby executed this deed
of sale in favour of the purchaser.
NOW THIS INDENTURE WITNESSTH AS UNDER :
1. That the seller company has fully assured the purchaser with respect to
title and it further says that it is competent to sell the said Flat in favour of

shall be subject to the fulfillment of “all the terms-and conditions as agreed
between the parties,
3, That the seller has delivered the physical possession of the said Flat to the
purchaser, who shall hereinafter use & occupy the said Flat for residential
Purposes only without any hinderance caused by the seller or any other person
of its behalf,
4. That the aforesaid’ Flat is sold by the seller in favour of the
purchaser as free from encumbrances.
5. That the seller has indemnified to the purchaser that if the title of
the seller is found defective and due to that purchaser looses the title or
Possession of the said FLAT or part thereof, then the seller shall be liable to
pay and reimburse to the purchaser, the sale consideration aiong with all other
costs & damages as having been sustained by the purchaser.
6. That the purchaser is fully aware that the Flat is situated ina complex,
under development, and for its proper and adequate use, the seller has
undertaken to provide the facilities as agreed _ which shall require day to day
‘maintenance. For proper maintenance a co-operative Society shall be
constituted by all the respective owners of respective plots, which shall carry
out the maintenance work of the said common areas & facilities, until & uniess
the same is handed over to any local body for maintenance, The purchaser
shail be liable to pay and contribute his share of maintenance and till
Constitution of said society, the purchaser shail pay the maintenance charges
to the seller, as agreed.
7. That the purchaser shall obtain the water connection from the seller/ or its
successors & shall pay the monthly charges for the same as per bills issued by
them.
8. That henceforth the purchaser shall from time to time and at all times pay
and discharges all taxes, charges, additional development charges, rates etc
of every description which are now charged or which might be chargeable or
imposed on the FLAT in future.

neither use nor allow its use for any other aurpose whatsoever.
10. That purchaser shall not transfer or assign his rights with respect to the
said Flat with out obtaining the previous permission in writing from the seller.
However, he may mortgage the said oroperty without delivery of possession
for raising loan from financial institutions.
11. That the we, seller hereby declare that the property which Is being sold by
us through this instrument, has not been sold’or transferred in any manner, by
way of sale, mortgage, or gift etc, by us, our co owner, or our attorney, till
date. We will be fully responsible for the consequences, if it is found so, we
are not committing any breach of Section 22(A) of Registration Act 1908.
