Privacy Policy

Flypan,Inc. (collectively referred to as “we”, “us” or “our”) sets forth this Privacy Policy (this “Policy”) regarding the handling of personal information acquired through the service provided by us (collectively referred to as our “Service”).

Article 1 (Definition of Personal Information)

The term "personal information" as defined in Japan's Act on the Protection of Personal Information refers to information about a living individual. Therefore, information containing a name, date of birth, address, phone number, contact information, or other identifier or the equivalent made by writing which can be used to identify a specific individual (this includes any information that can be easily collated with other information and thereby used to identify that specific individual) is included. Moreover, information that can be used to identify a specific individual by itself, such as appearance, fingerprints, voice prints, or data related to the insurer number on a health insurance card (personal identification information) is included as well.

Article 2 (Proper Acquisition of Personal Information)

We do not acquire personal information through deception or other improper means.

Article 3 (Purpose of Collecting and Using Personal Information)

The purposes for which we collect and use personal information are as follows:

  1. To accept and manage reservations at our operated stores (including confirmations of reservations, changes, cancellations, and other communications) and for other provision and operation of our Services.
  2. To perform rights or duties related to contracts, laws, and other regulations of our Services, including payment.
  3. When the processing of personal information is partially or wholly outsourced by other entities, to ensure the proper and secure provision and conduct.
  4. For research and development of products and services through market research, data analysis, and questionnaires.
  5. To organize and manage seminars, lectures, exhibitions, and other events hosted, co-hosted, or participated in by us.
  6. To provide proposals regarding our products and services through direct mail and other communication tools.
  7. To communicate with customers appropriately and smoothly, such as contact for business occasions and sending greeting letters or cards.
  8. To ensure security, including the use of information systems and management of access to facilities.
  9. To notify and announce the lecture presentations, and briefing sessions intended for the press, investors and analysts.
  10. For our recruitment purposes.
  11. For the purposes of managing our employees.
  12. To respond to opinions and inquiries (including identity verification and surveys)
  13. To send e-mails with information on new features, updates, campaigns, and other services provided by us.
  14. To identify users who have violated the terms of use or who are trying to use our Service for illegal or improper purposes, and to refuse their use.
  15. To allow users to view, change, or delete their registered information, and to view their usage status.
  16. In addition to the above, the purposes for attaining other purposes explicitly provided.

Article 4 (Change of Purpose of Use)

  1. We will change the purpose of use of personal information only when it is reasonably recognized that the purpose of use is related to the purpose before the change.
  2. If the purpose of use is changed, we shall notify the user of the changed purpose by the method prescribed by us or announce it on this website.

Article 5 (Provision of Personal Information to Third Parties)

We will not provide personal information to any third party without the prior consentof the user identifiable by such personal information (“Identifiable Person”), except inthe following cases. However, this shall not apply to the case where it is permitted bythe Act on the Protection of Personal Information or other laws and regulations.

  1. When it is necessary for the protection of the life, body, or property of an individual and it is difficult to obtain the consent of the Identifiable Person.
  2. When it is particularly necessary for improving public health or promoting the sound growth of children, and it is difficult to obtain the consent of the Identifiable Person.
  3. When it is necessary to cooperate with a national agency, a local government, or a person or organization entrusted by either of the foregoing in executing the affairs prescribed by laws and regulations, and obtaining the consent of the Identifiable Person is likely to impede the execution of the affairs concerned.
  4. When we entrust all or part of the handling of personal information within the scope necessary to achieve the purpose of use.
  5. When personal information is provided in connection with the succession of business due to a merger or other reasons.

Article 6 (Entrusting Personal Information)

We may, from time to time, entrust personal information to its contractors within the scope necessary to attain the purpose of use. We shall designate appropriate contractors who are well-equipped with proper personal information protection systems, and we will also conclude a personal information protection agreement.

Article 7 (Disclosure of Personal Information)

  1. Upon request by the Identifiable Person to notify the purpose of use, or to disclose retained personal data or third-party provision records held by us, we will disclose such information to the Identifiable Person without delay, to the extent permitted under the Act on the Protection of Personal Information and in accordance with the procedures prescribed by us. However, if the disclosure falls under any of the following cases, we may decide not to disclose all or part of the information. In the event of a decision not to disclose, we will notify the Identifiable Person of the decision without delay. Additionally, a fee of 1,000 yen (tax-included) per request will be charged for the disclosure of personal information.
    1. When it is likely to harm the life, body, property, or other rights or interests of the Identifiable Person or a third party
    2. When it is likely to seriously interfere with proper conduct of our business
    3. When it would violate other laws and regulations
  2. Notwithstanding the provisions of the preceding paragraph, we will not, in principle, disclose any information other than personal information, such as history and characteristics information.

Article 8 (Correction and Deletion of Personal Information)

  1. In the event that the Identifiable Person’s personal information held by us is incorrect, the Identifiable Person may request us to correct, add, or delete the Identifiable Person’s personal information (collectively referred to as "correction, etc.") in accordance with the procedures specified by us.
  2. Upon receiving a request as described in the preceding paragraph, if we determine that the request is necessary within the scope permitted by the Act on the Protection of Personal Information, we will promptly make the required corrections, etc. to the personal information.
  3. In the event that we make a correction, etc., based on the preceding paragraph, or if we decide not to make a correction, etc., we will promptly notify the Identifiable Person of this.

Article 9 (Suspension of Use of Personal Information, etc.)

  1. When we receive a request from the Identifiable Person to stop using or erase personal information because it is being handled beyond the scope of the purpose of use, or because it was obtained by wrongful means, we will promptly conduct the necessary investigation.
  2. If, based on the results of the investigation described in the preceding paragraph, we determine that there are found to be grounds for the request, within the scope permitted by the Act on the Protection of Personal Information, we will promptly stop using or erase of the personal information concerned.
  3. We will promptly notify the user of any stop using or erase based on the provisions of the preceding paragraph, or when we decide not to.
  4. Notwithstanding the preceding two paragraphs, in the event that it is difficult to stop using or erase of the information due to high costs or other reasons, and in the event that the necessary alternative measures to protect the Identifiable Person's rights and interests can be taken, such alternative measures shall be taken.

Article 10 (Changes to the Privacy Policy)

  1. The contents of this Policy are subject to change without notice to users, except as otherwise provided by law or in this Policy.
  2. Unless otherwise specified by us, the revised Policy will become effective when it is posted on our website.
