Hello Everybody! In this video, we are going to discuss about the Fundamental Right to Privacy - How did it evolve in India, what is the current status of this right in a very simple manner.
Important Cases and Development of Right to Privacy:
M.P. Sharma v. Satish Chandra - 8 Judge Bench
Kharak Singh v. State of U.P. - 6 Judge Bench
Both of these larger Supreme Court Benches clearly stated that Indian Constitution does not guarantee a Fundamental Right to Privacy.
The scope of the right of privacy to be extended from Article 21 came up from Kharak Singh’s case (1962).
The judgment in Justice KS Puttaswamy v. UOI (2018) held that Indian citizens enjoy a fundamental right to privacy that it is intrinsic to life and liberty which comes under Article 21 of the Constitution.

Ben Dutton Professor of Law at Indiana University. He specializes in information security and privacy law and has testified before numerous congressional committees and served on many advisory groups for companies and governmental and international organizations. He served as the founding director of IU’s Center for Applied Cybersecurity Research from 2003 to 2014, where he is now a senior fellow. He is also a senior policy advisor to the Centre for Information Policy Leadership and one of the founding editors of the Oxford University Press journal, International Data Privacy Law.
He is the author of more than 200 articles and books, including most recently "Bulk Collection: Systematic Government Access to Private-Sector Data" (with Jim Dempsey) published in 2017 by Oxford University Press. Professor Cate attended Oxford University and received his J.D. and his A.B. with Honors and Distinction from Stanford University. A former Senator and President of the Phi Beta Kappa Society, he is a fellow of Phi Beta Kappa and the American Bar Foundation, and an elected member of the Council on Foreign Relations and the American Law Institute. In this video Heimler walks you through Unit 3 Topic 9 of the AP Government curriculum which is all about the Constitution's provision for the right to privacy. If you're scratching your head because you don't remember a right to privacy included in the Bill of Rights, you're not wrong.
However, through a series of cases, the Supreme Court established the right to privacy as an implicit right, a shadow of the explicit rights enumerated in the first ten amendments.
The most controversial application of this right to privacy was in the landmark case Roe v. Wade which relied on this precedent to rule on a woman's right to abortion.
