Criminals know no borders. It is time prosecutors do not either. The European Public Prosecutor's Office will be a game changer in fighting cross-border financial crimes.
The Office will complement the important work of Eurojust and OLAF, creating a unified European approach to fighting crimes that affect the Union's financial interests.
The European Prosecutors have a crucial job to do: they need to bring justice into an area where impunity is frequent and losses are significant for both the EU and national budgets. For this, they must be independent, determined and thorough in their investigations.
We are glad that, despite the challenges of the pandemic, together we still managed to achieve our goal of setting up the new office this year.”
The new European Public Prosecutor's Office (EPPO) will be the first supranational public prosecution office, operating across all EU countries participating in the enhanced cooperation and will combine European and national law enforcement efforts in a unified, seamless and efficient approach. It will investigate and prosecute fraud and other crimes affecting the EU's financial interests (so-called ‘PIF' offences as defined in Directive (EU) 2017/1371).
The EPPO will operate as a single office headed by a European Chief Prosecutor working with one European Prosecutor from each participating EU Member State. At least two European Delegated Prosecutors will operate in the judicial system of each participating Member State and work closely with the central office, located in Luxembourg.
The EPPO has been set up because every year billions of euro are lost in revenue because of fraud, including cross-border VAT fraud. This is no petty crime: criminals, including those practising transnational organised crime, are profiting enormously every year by evading criminal prosecution, which in turn fuels corruption and undermines the rule of law.
European Public Prosecutor's Office
The EPPO is an independent Union body competent to fight crimes against the Union budget.
The European Public Prosecutor’s Office will be an independent and decentralised prosecution office of the European Union, with the competence to investigate, prosecute and bring to judgment crimes against the EU budget, such as fraud, corruption or serious cross-border VAT fraud. The Regulation establishing the European Public Prosecutor’s Office under enhanced cooperation was adopted on 12 October 2017 and entered into force on 20 November 2017. At this stage, there are 22 participating EU countries.
Currently, only national authorities can investigate and prosecute fraud against the EU budget. But their powers stop at national borders. Existing EU-bodies such as Eurojust, Europol and the EU's anti-fraud office (OLAF) lack the necessary powers to carry out criminal investigations and prosecutions.
The European Public Prosecutor’s Office is currently being set up, with the aim of becoming operational at the end of 2020. The European Public Prosecutor’s Office will have its seat in Luxembourg.
The European Public Prosecutor’s Office will operate as a single office across all participating EU countries and will combine European and national law enforcement efforts in a unified, seamless and efficient approach. The European Public Prosecutor’s Office will be built on two levels: the central and the national level. The central level will consist of the European Chief Prosecutor, its two Deputies, 22 European Prosecutors (one per participating EU country), two of whom as Deputies for the European Chief Prosecutor and the Administrative Director. The decentralised level will consist of European Delegated Prosecutors who will be located in the participating EU countries. This is Choi's first public appearance after the allegations against her bubbled to the surface last week.
Choi, her face shielded under a dark hat and a thick scarf, was escorted through a huge crowd of reporters as she made her way into the prosecutor's office... and she did not take any questions.
But before getting on the lift, she reportedly pleaded for mercy and said she was truly sorry.
Choi's attorney held a press conference at around 4 p.m. but refused to give any clear answers regarding the charges against her.
"I am here to represent her throughout the investigation and I will fully cooperate with prosecutors."
Lee added that Choi's daughter, Chung Yoo-ra, who was with Choi in Germany,... will not be returning to Korea for a while.
Choi returned to Korea on Sunday at 7:30 a.m. from London, after nearly two months in Germany.
Choi, who did not have an official government position, is suspected of having used her ties to the president to interfere in state affairs... and accessing classified presidential office documents.
Prosecutors will also grill Choi on the allegation that she used her connections to the president to solicit and embezzle a massive amount of corporate donations for two government-linked foundations.
Choi will also likely face questions about the allegation that she used her connections to garner preferential treatment for her daughter when she was admitted to Ewha Womans University.
Choi's return came a day after prosecutors raided the homes of presidential aides suspected of being involved in the scandal.
The prosecutors' office said Monday that it is expanding the special investigative team working on the case,... as the investigation is widening at a rapid pace.
Roughly twenty more prosecutors will be added to the team,... bringing the number of investigators to about a hundred.

With the probe expanding rapidly, prosecutors said they would increase the number of investigative personnel on the case.

Choi Soon-sil, a confidante of President Park Geun-hye and the woman at the center of a growing abuse of power scandal,... appeared at the Seoul Central District Prosecutor's Office for questioning on Monday afternoon.

Korea's disgraced former president Park Geun-hye has arrived at the Seoul Central District Prosecutors' Office for questioning over the corruption scandal that has been gripping the nation for several months.
She left her home in southern Seoul a little after a quarter past nine,... whizzing through the streets of Seoul under heavy security protection and flanked by a fleet of police motorcycles.
Let's connect to our Hwang Hojun at the prosecutors' office.
Hojun, we've been watching her entrance,... but just describe the scene there and fill us in on what Park had to say before heading inside...
Absolutely.
As you said, Mark, Park Geun-hye arrived at 9:25 a.m.,... slightly earlier than scheduled.
Before entering the building, Park made a brief stop behind the press line, where reporters shouted out questions and camera flashes popped off around us.
And as expected,... Park Geun-hye delivered a prepared message there. It was one solitary sentence.
Here's what she said.
"I feel sorry to the public. I will faithfully go through the interrogation."
She's expected to have head to the 13th floor for a short meeting with ranking officials from the special probe team, before her actual interrogation.
The interrogation will likely take place in the investigation room on the 10th floor, equipped with video and audio recording facilities.
Park has been summoned as a criminal suspect so her Miranda Rights will be read as well.
The prosecution is expected to bombard Park with questions regarding the long list of charges facing her... and the questioning is likely to go past midnight.... so it's going to be a long day and night for the former president as well as the reporters and camera crew who have been out here well before the break of dawn..
The security is at its peak around the office as protesters from both sides, for and against Park's arrest, have gathered near the premises.
In fact, even though I'm at least 300 meters away from the demonstration, with a human barricade of police between us, I can still hear the chanting from the various sides.
As I said before, the big question is whether the state prosecutors will seek an arrest warrant by the end of the interrogation.
Some argue a warrant is unnecessary... as there's a low possibility of Park fleeing, since she's the former president.
On the other hand, others insist an arrest warrant is inevitable given the severity of the charges and Park's continued denial of them despite the arrests and indictments of most of her alleged accomplices.
But as the prosecutors haven't confirmed anything, we'll have to see what happens.
