The presumption of innocence, sometimes referred to by the Latin expression Ei incumbit probatio qui dicit, non qui negat (the burden of proof is on the one who declares, not on one who denies), is the principle that one is considered innocent unless proven guilty.
In many nations, presumption of innocence is a legal right of the accused in a criminal trial, and it is also regarded as an international human right under the UN's Universal Declaration of Human Rights, article 11. The burden of proof is thus on the prosecution, which has to collect and present enough compelling evidence to convince the trier of fact, who is restrained and ordered by law to consider only actual evidence and testimony that is legally admissible, and in most cases lawfully obtained, that the accused is guilty beyond reasonable doubt. If reasonable doubt remains, the accused is to be acquitted. Under Justinian Codes and English Common law, the accused is presumed innocent in criminal proceedings, and in civil proceedings (like breach of contract) both sides must issue proof. Under Anglo-American Common Law, the accused is always presumed innocent in all types of proceedings; proof is always the burden of the accuser. Under Islamic Law, a tradition had not been solidified but doubtful evidence should be rejected upon moral principles.

Presumption of Innocence
Today, we’re talking about the presumption of innocence, and it is one of the most important legal principles on which the criminal justice system is based.

My wife, Tammy, and I toured Australia and New Zealand in February. I was lecturing about the topics covered in my book, 12 Rules for Life (and also Maps of Meaning, my first book). I had a number of the lectures professionally filmed. This is a highlight from my lecture in Auckland on the fundamental necessity of the presumption of innocence.

In Victoria we protect the presumption of innocence through:
• The burden of proof – you must be proven guilty you don’t have to prove yourself innocent
• The standard of proof – you have to be proven guilty beyond reasonable doubt (which is a pretty high bar to clear)
• Police must reasonably believe that a person has committed a crime before arresting them
• You have a right to legal representation
• You have a right to silence
• You have the right to appeal a wrongful conviction
• A person’s previous convictions must not be factored into the judicial process until sentencing has begun.

Heart Of Innocence Sometimes I wake up in the dark of night And in my mind there's a picture of you I know someday this dream will come alive So for now your shadow will do I've never seen your face But I know your in my heart Maybe someday some place I'll hold you in my arms [CHORUS] I have a gift for you Something that I've held on to Waiting for your sweet caress The ribbon has beed on tight For all that I hold inside And only you will possess This heart of innocence I lay my head down on a pillow of white Your in the dark I am cradled in peace No thoughts from yesterday to haunt me at night No tears to dry, no sad memories It isn't hard to hold And now I'll safely keep The strength that's in my soul Until you come to me [CHORUS] Every night I make a wish before I fall asleep That destiny will take your hand And lead you to me [CHORUS] [spoken] I love you
