In common lawlegal systems, a precedent or authority is a principle or rule established in a previous legal case that is either binding on or persuasive for a court or other tribunal when deciding subsequent cases with similar issues or facts. Common law legal systems place great value on deciding cases according to consistent principled rules so that similar facts will yield similar and predictable outcomes, and observance of precedent is the mechanism by which that goal is attained. Black's Law Dictionary defines "precedent" as a "rule of law established for the first time by a court for a particular type of case and thereafter referred to in deciding similar cases."Common law precedent is a third kind of law, on equal footing with statutory law (statutes and codes enacted by legislative bodies), and Delegated legislation (in U.K. parlance) or regulatory law (in U.S. parlance) (regulations promulgated by executive branch agencies).
Case law or common law is the set of decisions of adjudicatory tribunals that can be cited as precedent. In most countries, including most European countries, the term is applied to any set of rulings on law which is guided by previous rulings, for example, previous decisions of a government agency.
Binding Precedents and the Doctrine of Judicial precedent
This video explains the doctrine of judicial precedent. The court's hierarchical structure is explained and the reasons why some precedents are binding and why some are persuasive are explained.

What is Legal "Precedent"?
Today we’ll look at the definition of precedent, an important concept in understanding how the law works.
Precedent refers to a court decision that is considered as authority for deciding future cases involving identical or similar facts and similar legal issues. The goal is to ensure that people in similar situations are treated the same.
If the facts or issues of a case differ from those in a previous case, the previous case can not be “binding” precedent.
The Supreme Court has said that “questions which merely lurk on the record, neither brought to the attention of the court nor ruled upon, are not to be considered as precedent”
Therefore, a prior decision serves as precedent only for issues and facts that the court explicitly considered in reaching its decision. That is a critica...

The Supreme Court has said that “questions which merely lurk on the record, neither brought to the attention of the court nor ruled upon, are not to be considered as precedent”
Therefore, a prior decision serves as precedent only for issues and facts that the court explicitly considered in reaching its decision. That is a critical point.
Related…Just because a court ‘says’ something in an opinion does not make it binding precedent. The precedent is limited to the specific facts and issues decided in the case.
And when there is precedent it is only for lower courts in the “chain of command” of the precedent setting court. For example, the Supreme Court of Texas does not have to follow the Supreme Court of Florida but both have to follow the US Supreme court.
Likewise, a federal district court in Alabama, does not need to follow a federal district court in Wyoming, as they are located in different federal circuits. We’ll talk more about the federal court systems in a future episode. For now, lets remember that precedent is important but it may also have limitations depending on the court rendering the decision.
That’s today’s legal minute. Please share and subscribe.
Have a great day and stay out of trouble.

This video explains the doctrine of judicial precedent. The court's hierarchical structure is explained and the reasons why some precedents are binding and why some are persuasive are explained.
Have a great day and stay out of trouble.

hi everyone jennifer from tarle speech with your pronunciation question our question today is how do i say precedent which is an example and president which is a leader so here are two words precedent and president so both of these words are going to have three syllables the middle syllable is going to be the schwa and the ending syllable dunt will be exactly the same these words also both begin with the pre and those are exactly the same the difference is this s sss and z zzzz which is voiced that is the main difference in these two words just one little sound so to say precedent what you're going to do is you're going to start with that pr prr prr
and to do this get your lips ready for that r sound and your tongue is either going to be pointed down or flipped back for that r you're going to be ready for the r when you get your lips together for the p sound right so prr prr you can see my lips are a little tenser and a little um square when i start that p sound typically i would just say p p but i'm going to have my lips together for that r sound so that i don't add a sound between those two sounds prrr prrr
then i'm going to move to that short eh sound to do that your mouth is going to be open and tongue is about middle of the mouth and then we're going to add the s to do this the tip of the tongue pointed down to the bottom of the mouth and the voice box is not on the air is going to be moving out of our mouth sss press press now if you are saying president all you're going to do instead of having the voice box off here is you're going to turn the voice box on and it is going to move and vibrate zzzz zzzz it's the only difference so we have press and prez press prez some people will say that the vowel sounds a little bit stronger and that is true because of that voicing that e is going to be a little tiny bit longer then we're going to move to the short uh sound relaxed mouth and then end with dunt to do this touch the tip of the tongue to the back of the top front teeth super short uh sound again put the tongue back to the back of the top front teeth air moves out of your nose for the n and then we're going to pull the tongue down for the t press dunt precedent precedent precedent president president president precedent president and now for a sentence the council president likes to use precedent when making decisions so give it a try people are going to notice the difference if you found this helpful please share this with a friend and give us a like don't forget to check out all of our products and course options and you can find those all at tarle speech thanks everyone have a great week
