What Does a Personal Representative Do?
If you've been named as the executor (called a personal representative in some states) of an estate, you may not know where to start. If you've been appointed by someone's will or trust, you at least know they did some estate planning to spell out their wishes. There are likely documents left behind that will spell out what the person wanted to do with their assets and who should take care of their children if they are underage. It creates a path forward for you to manage and distribute their estate.
If you've been appointed as the executor by a court, then your job may be a bit more challenging. This happens when a person dies without a will (called intestate) and the executor's role is to carry out the distributions according to the law. You've got a set of court rules to follow and oft...

Probate 101: Personal Representative and Notice
When a probate petition is filed, notice is given to heirs and interested parties. If there are no objections, the court appoints a personal representative to administer the estate, locate assets, settle debts, file taxes, and distribute property. The personal representative must file an estate inventory within one to three months of appointment, which becomes public and informs parties about the assets in the estate.

How Much Power Does Personal Representative Have Over Distribution of Assets? | EPTV 042
How Much Power Does the Personal Representative Have When Distributing Assets?
This definitely falls under the "estate planning attorney frequently asked questions category" so I wanted to take a few minutes to talk about at and put your fears to rest.
One of the common questions I am asked surrounds the Personal Representative's (also called Executor in some places) power to distribute assets when they take on the role.
Many people are worried the personal representative is simply going to determine the assets would be better distributed according to their own plan and go rogue.
Let me put your fears to rest.
The personal representative doesn't have any power to go rogue on your estate.

If you've been appointed as the executor by a court, then your job may be a bit more challenging. This happens when a person dies without a will (called intestate) and the executor's role is to carry out the distributions according to the law. You've got a set of court rules to follow and oftentimes, you'll be forced to ask for the court's permission before you are able to conduct certain transactions. If the heirs are hard to find, you may find yourself with much more work than you anticipated. And if they are easy to find, but unhappy with how the law says to distribute the property, you may also end up with a lot more work.
Regardless of how you found yourself in this role, there are resources and professionals out there who can help you through the process.

The rules require them to follow the rules as you lay them out in the will, whether they like it or not.
Now, that doesn't mean you shouldn't take special care to name someone you trust and someone organized enough to take on the task.
After all, they will have access to your assets.
Hope this helps!
If you don't have an estate plan yet, and you want to learn more about your options, book a time to talk to me. I'd love to learn about your family, give you some options, and see what works for you.
