For a seditious conspiracy charge to be effected, a crime need only be planned, it need not be actually attempted. According to Andres Torres and Jose E. Velazquez, the accusation of seditious conspiracy is of political nature and was used almost exclusively against Puerto Ricanindependentistas in the twentieth century. However, the act was also used in the twentieth century against communists and radicals (United Freedom Front, the Provisional IRA in Massachusetts), white supremacists, and Islamic militants including Omar Abdel-Rahman. This is irrespective of the state sedition laws, used to persecute hundreds of communists, socialists and labor leaders.
Background
The federal government has never won a sedition case against militia-types, white supremacists, or neo-Nazis. Since World War I, they have won numerous seditious conspiracy cases against Puerto Rican independentistas, communists and others on the left, but no one on the radical right has ever been convicted of plotting to overthrow by force of arms the government of the United States.
Oath Keepers is an American organization associated with the anti-government patriot movement. It encourages members—some of whom are current and former U.S. military and law enforcement officers,—not to obey orders which they believe would violate the United States Constitution. The group is best known for its controversial presence in Ferguson, Missouri during protests and unrest in the city, and during which its members were armed with semi-automatic rifles and were described as a far-right militia group by the media. The group espouses a number of false conspiracy theories and scam legal theories associated with the sovereign citizen movement and the white supremacist posse comitatus movement's Richard Mack.
The organization describes itself as a non-partisan association of current and formerly serving military, police, and first responders, who pledge to fulfill the oath all military and police take to “defend the Constitution against all enemies, foreign and domestic.” The Anti-Defamation League describes the group as "heavily armed extremists with a conspiratorial and anti-government mindset looking for potential showdowns with the government".

Seditious Conspiracy: Oath Keepers Founder Stewart Rhodes Gets 18 Years in Prison for Jan. 6
Stewart Rhodes, founder of the far-right Oath Keepers group, has been sentenced to 18 years in prison for his role in the attack on the U.S. Capitol. It is the longest sentence handed down so far to any participant in the January 6 insurrection, when thousands of Trump supporters stormed the halls of Congress to stop the certification of Joe Biden's 2020 presidential victory. One of Rhodes's associates, Kelly Meggs, who led the Florida chapter of the Oath Keepers, was sentenced Thursday to 12 years in prison. A jury had convicted both men of seditious conspiracy in November. The sentences are a "substantial win for democracy," says Kristen Doerer, who reports on right-wing extremism and followed the case.

Jury reaches a verdict in Oath Keepers Jan. 6 trial
After deliberating for nearly three days, the jury has reached a verdict in the trial of the Oath Keepers leader and four associates who have been charged with seditious conspiracy.

Long before he assembled one of the largest far-right anti-government militia groups in U.S. history, before his Oath Keepers stormed the U.S. Capitol on Jan. 6, 2021, Stewart Rhodes was a promising Yale Law School graduate.
He secured a clerkship on the Arizona Supreme Court after his time as an Army paratrooper was cut short by a training accident. The job was one more rung up from a hardscrabble beginning. But rather than fitting in, Rhodes came across as angry and aggrieved.

Stewart Rhodes, founder of the far-right Oath Keepers group, has been sentenced to 18 years in prison for his role in the attack on the U.S. Capitol. It is the longest sentence handed down so far to any participant in the January 6 insurrection, when thousands of Trump supporters stormed the halls of Congress to stop the certification of Joe Biden's 2020 presidential victory. One of Rhodes's associates, Kelly Meggs, who led the Florida chapter of the Oath Keepers, was sentenced Thursday to 12 years in prison. A jury had convicted both men of seditious conspiracy in November. The sentences are a "substantial win for democracy," says Kristen Doerer, who reports on right-wing extremism and followed the case.

Stewart Rhodes is headed for a long stretch in federal prison and his ex-wife is breathing a sigh of relief. Tasha Adams says she's been living in fear of the Oath Keepers founder, who was a ringleader during the January 6 assault on the U.S. Capitol. She married Rhodes back in 1994 but they later divorced in 2018. Rhodes faces up to 60 years behind bars. However, Adams says she worried about the possibility of a pardon for Rhodes if Donald Trump returns to the White House.
Oath Keepers founder Stewart Rhodes has been sentenced to 18 years in prison. A jury convicted Rhodes last November on several felony counts, including seditious conspiracy. CBS News congressional correspondent Scott MacFarlane has more.
