If we think of equal protection, we tend to think of discrimination based on race or gender. We don’t ordinarily think of discrimination based on drug use. But that was the issue raised in the 1979 case of New York City Transit Authority versus Beazer.
The New York City Transit Authority, or the authority, prohibited its employees from using a wide range of narcotics, tranquilizers, or amphetamines, even if they were lawfully prescribed. This list included methadone, a narcotic that can help heroin users overcome their addiction. Methadone users weren’t eligible for employment until they’d been off the drug for five years.
Former employees who’d been fired for being in methadone programs and job applicants who’d been denied employment because of methadone use sued the authority in federal court. The plaintiffs argued that classifying methadone program participants and graduates as drug users violated the Equal Protection Clause.
The district court found that the authority’s rule violated the Fourteenth Amendment’s Equal Protection Clause, and the court of appeals affirmed. The United States Supreme Court granted the authority’s cert petition.
