Dalton versus Educational Testing Service shows just what can happen if the test service breaches the contract.
Educational Testing Service, or ETS, is a standardized testing company that administers the Scholastic Aptitude Test, or SAT. Brian Dalton took the SAT in May of 1991. He took it again in November of 1991 and increased his combined score by four hundred ten points. When he registered for the test, Dalton signed a statement agreeing to abide by the conditions contained in the registration bulletin, which granted ETS the right to cancel any test score if it believed there was any question about the score’s validity.
The size of the discrepancy between Dalton’s scores triggered an ETS review. ETS compared the two answer sheets and concluded the handwriting didn’t match. ETS then gave the score sheets to a document examiner, who concluded that two different individuals had completed them. ETS notified Dalton that it had preliminarily decided to cancel his November score based on the significant score discrepancy and the handwriting dissimilarity. ETS told Dalton that the evidence suggested that someone else might’ve completed the November answer sheet and that the score was therefore invalid. The company advised Dalton of his options, which under the bulletin’s conditions included the opportunity to provide additional relevant information.
Dalton submitted additional information to ETS, including witness statements confirming that he attended the November test. Dalton also submitted a statement from a different document examiner opining that Dalton had written both answer sheets. ETS representatives admittedly ignored Dalton’s documentation, deeming it irrelevant. After ETS consulted another document examiner, who supported the first examiner’s conclusion, ETS still refused to validate the November score.
Dalton’s father sued ETS on Dalton’s behalf to compel ETS to release Dalton’s November test score immediately. The trial court ruled for Dalton, ordering ETS to release the score. The appellate court affirmed. ETS appealed to the New York Court of Appeals.
