In civil cases, the plaintiff – the party that brings the lawsuit or action – is a private party, such as an individual or a business.
In criminal law, the plaintiff – also called the complainant - is the government or the state, which acts as the prosecution.

Criminal Law - Chapter 1: Actus Reus & Mens Rea (Degree - Year 1)
Crime = actus reus + mens rea
The Latin maxim "actus non facit reum nisi mens sit rea" is a traditionally used shorthand for this equation.
Its usual translation is "an act is not criminal in the absence of a guilty mind"; or, more analytically, "criminal liability requires the accused to have done something criminally wrong (actus reus) with an accompanying blameworthy state of mind (mens rea)".
In Woolmington v DPP, Viscount Sankey LC stated that it is the duty of the prosecution to prove both actus reus and mens rea.
