Hey, sup guys, in this video, I made a video on the Malaysian Legal System and Constitutional Law. I know that most law schools in Malaysia have this subject, be it during foundation years and degree. Therefore, I intend to help everyone to learn about our legal system and constitutional history.
This begins with Malaccan laws, adat temenggong to adat perpatih, to the Charter of Justice applied to Penang, Malacca and Singapore with the advent of the common law and British Colonialism into the Malay rulers states, until the creation of the Civil Law Act 1956, to the abolition of the Malayan Union, to the Reid Commission, our Federal Constitution and the creation of Malaysia through MA63 with the combination of Malaya, Sabah, Sarawak and Singapore until the modern constitution that we have today.
Without the Federal Constitution which is the Supreme Law of the Land, Malaysia would not exist and there would be no Malaysians.
Islam is the official religion of the country, but we are actually a secular nation with the Islamic law only applicable to personal or family matters, such as divorce, inheritance, dowry, marriage and offences against the precepts of Islam.
I touched upon the three branches of government, which are the Executive, Legislative and Judiciary. Is there completely the separation of powers?
The executive basically consists of the Yang Di-Pertuang Agong and the Prime Minister. However, the YDPA has to follow the advice of the PM and to become a PM, he must command the majority of the House of Representatives or Dewan Rakyat.
The legislative consists of the Dewan Rakyat and Dewan Negara and the powers to create laws between the Federation and States. There must be 222 MPs and they are responsible for legislating las. This is because, Malaysia is a federalist country and power to create laws are divided.
The judiciary is the court hierarchy from the magistrate, to sessions, high court, court of appeal and federal court. We also have a separate court hierarchy for the Syariah courts and other courts, such as the natives courts and court for children. Therefore, a person may appeal from the lower courts to the appellate courts.
We also have the fundamental liberties or our domestic version of human rights, between article 5-12, for freedom of liberty, slavery, retrospective crime or double jeopardy, equality, freedom of movement and from banishment, speech and expression, religion and education.
I also touched upon the bumiputra article 153, the national language, the courts for the Malay rulers as well. Article 149 is for the creation of laws against subversion, acts prejudicial to public order and terrorism. Article 150 is for the declaration of emergency, especially the one proclaimed during the COVID-19 pandemic.
