The Broadcasting Act 1990 is a law of the British parliament, often regarded by both its supporters and its critics as a quintessential example of Thatcherism. The aim of the Act was to reform the entire structure of British broadcasting; British television, in particular, had earlier been described by Margaret Thatcher as "the last bastion of restrictive practices". The act came about after the finding from the Peacock Committee.
It led directly to the abolition of the Independent Broadcasting Authority and its replacement with the Independent Television Commission and Radio Authority (both themselves now replaced by Ofcom), which were given the remit of regulating with a "lighter touch" and did not have such strong powers as the IBA; some referred to this as "deregulation". The ITC also began regulating non-terrestrial channels, whereas the IBA had only regulated ITV, Channel 4 and British Satellite Broadcasting; the ITC thus took over the responsibilities of the Cable Authority which had regulated the early non-terrestrial channels, which were only available to a very small audience in the 1980s.
The Act was given royal assent on February 1, 1991. A prior version of the Broadcasting Act received royal assent on June 23, 1936; it was subsequently updated in 1958 and 1968.
The current federal Broadcasting Act is based on the 1968 Act with amendments in 1991. The stated goal of the Act is to maintain Canada’s cultural fabric — thereby strengthening its economic, political and social structures.
Structure
The Broadcasting Act covers three main sections: a broadcasting policy for Canada; the regulatory powers of the CRTC; and the operating procedures and policies for the Canadian Broadcasting Corporation.
The Broadcasting Act 2009 (Number 18 of 2009) is an Act of the Oireachtas of Ireland. It was signed into law on 12 July 2009, although the provisions relating to the establishment of the new Broadcasting Authority of Ireland did not come into force until a Statutory Instrument was made giving them effect on 30 September 2009.
The Act covers mainly regulation and broadcasting and digital switchover in Ireland.
Proposals
The Act provides for the establishment of a single content regulator, the Broadcasting Authority of Ireland (BAI), which will take over the roles currently held by the Broadcasting Commission of Ireland (BCI) and the Broadcasting Complaints Commission (BCC) in as well as a range of new functions and was constituted during 2009 and the existing bodies were wound up on the same date. There will continue to be an element of separation, with a Contract Awards Committee and Compliance Committee being constituted as committees of the BAI's main board.
The BAI will have power to award programme contracts (as at present, the Commission for Communications Regulation will continue to issue the broadcasting licences proper) in the independent sector and ensure that all broadcasters, public and private, comply with contract conditions and standard. It will regulate enforcement of sound broadcasting conditions and public service broadcasters for the first time as well as commercial broadcasters, with RTÉ and TG4 becoming semi state companies and will take on a greater role in terrestrial television regulation as new Irish channels emerge on the new more spectrum capacity extensive DTT platform.
