Legal Writing 101
What is it about the term Legal Writing that makes law students cringe? If you are a first-year law student, you're most likely enrolled in a Legal Research and Writing Class (LRW). This is a class that can strike fear into the heart of some law students. Others approach it with an "I got this" attitude only to be shocked when they realize they actually don't. The same writing skills that scored you a spot in law school do not always transfer when it comes to legal writing. It's just another class - what is everyone so afraid of?
You have to get comfortable with writing in a different way.
The exams and papers can be incredibly time-consuming and challenging.
It's hard to "unlearn" a style of writing you became comfortable with in your prior education.
In this episode we talk about...

Here's a short extract of our world-class materials banks for the world-famous Legal Darfting Basics: Three Key Skills workshops designed by Chris Jensen, LL.M and published by LexisNexis:
1. Correct usage
“Usage” means punctuation, grammar, and vocabulary. Here are 25 common usage errors to look for in your writing.
1.1 Punctuation: Common errors
1.1.1 Usage Error 1: Commas and semicolons in complex/compound sentences
Incorrect: The biggest firms missed out on the revolution which was led by small- and medium-sized independent firms then they tried to get in but it was already too late.
Correct: The biggest firms missed out on the revolution, which was led by small- and medium-sized independent firms; then they tried to get in, but it was already too late.
1.1.2 Usage Error 2: Commas and semicolons for complex lists
Use commas and semicolons for clarity if you have a complex list – especially a list within a list. Separate items in the big list with semicolons and items in the small list with commas.
Original: …in particular information relating to this Agreement and its subject matter, the businesses or financials of the Principal and its affiliates, the Customer, buyers and other contractors of the Principal as well as information relating to prices, sales, developments and know-how of the Principal.
Revision: …in particular information relating to this Agreement and its subject matter; the businesses or financials of the Principal and its affiliates, the customer, buyers and other contractors of the Principal; and information relating to prices, sales, developments, or know-how of the Principal.
2.1.3 Usage Error 3: Commas with restrictive and non-restrictive clauses
Don’t use commas if the information in relative clause modifying the noun (i.e., beginning with “who,” “that,” “which,” “whose,” etc.) is key information (called “restrictive” information). Do use commas if it’s just extra information (“non-restrictive”).
Non-restrictive: The Defendant ,who has expressed remorse, is well on his way to rehabilitation. (This means we know who the Defendant is, so “who has expressed remorse” is just extra information.)
Restrictive: A defendant who has expressed remorse is well on his way to rehabilitation. (This refers to any defendant who has expressed remorse – “the defendant who has expressed remorse” is the subject.)
Incorrect: Anti-competitive agreements are agreements between competitors, which have as their object or effect the restriction of competition.
Correct: Anti-competitive agreements are agreements between competitors that have as their object or effect the restriction of competition.
Incorrect: Flexibility is one of the keywords of the new Hungarian Labor Code which entered into force on 1 July 2012.
Correct: Flexibility is one of the keywords of the new Hungarian Labor Code, which entered into force on 1 July 2012.
Tip: If removing the information would create confusion about the subject = restrictive = no commas.

This is the first of a series of online webinars targeted to practicing lawyers and advanced students who need to work in legal contexts in English. The session begins with Jeff Keiser, JD who is also part of the Legal Writing Coach team at Advanced Language Institute.
How it Works: Buy 10 sessions for just over €19 each and use them anytime within six months. Just drop-in when you can or give unused sessions to another lawyer at your firm.
These sessions cover all aspects of Legal English, with a focus on excellent writing skills. Discussion is in English with other lawyers, so you should have B2 level or higher to fully participate. Meet us every Wednesday, 12-1:30 p.m. Central Europe Time (CET) on Zoom and there will be a different theme each week. Find the list of sessions in the full description.
Price is €199 for 10 session vouchers. You use one voucher each time you attend. Vouchers last for six months. If purchased by a law firm, vouchers are transferable to other lawyers in the firm. With Drop-in sessions, lawyers never lose!
He overviews the core issues with writing numbers, which lawyers from different countries and contexts use differently, then proceeds to cover nine more target areas where lawyers seem to miss - mostly related to concision - lawyers need to write in a clear, short, and precise way.
The concept of concision is oftentimes overlooked and creates communication barriers between lawyer and client. Nowadays, with inboxes full and quick, constant communication styles, the need for concision and cutting words is even more apparent. Nevertheless, that is not the only thing you'll gain from these top tips. Through watching the whole hour you will learn many of the key style, grammar, usage, and plain English writing techniques that the 'legal writing gurus' teach privately for thousands of dollars.
This is an excerpt from one of ALI's "Legal English Lunch" drop-in sessions open to lawyers from our partner firms. Our partner firms consist of 20 of the top Legal500 firms. Expert “Drop-in” sessions are open to any lawyer or law firm. Each session engages participants through activities and examples on a specific theme of legal writing or speaking skills. Practice and feedback throughout the session.

In this episode we talk about:
What makes legal writing so difficult?
The different types of legal writing
How your academic background can affect your success in your legal writing class
Improving your legal writing skills
How to handle legal writing if English isn't your first language
Tools and tricks to stay organized
Why legal writing is important to your future career (and passing the bar exam)
