Jeremy S. Goldman is a partner in the Litigation Group and Co-Chair of the Emerging Technology Group, focusing on intellectual property, entertainment, media, privacy, technology, and commercial law.
Jeremy is an accomplished media and entertainment litigator, focusing on copyright, trademark, privacy, intermediary liability, right of publicity, First Amendment, and business disputes. Jeremy draws on his sophisticated understanding of law, technology and industry, along with creative problem-solving and litigation skills, to help clients navigate complex legal challenges in and outside the courtroom. Best Lawyers in America ranks Jeremy for his entertainment litigation practice and The Legal 500 has recognized him for his work on high-profile copyright and privacy matters.
Beyond his litigation practice, Jeremy advises startups and established companies on intellectual property, commercial, licensing, and privacy matters, especially when transactions and projects intersect with emerging technologies like artificial intelligence, blockchain, and new media. - Representing virtual golf developer GSPro in IP infringement lawsuit brought by competitor Trackman, obtaining dismissal—on copyright preemption grounds—of competitor’s contract claim alleging breach of anti-reverse engineering clause. Trackman, Inc. v. GSP Golf AB, No. 23 CIV. 598, 2024 WL 4276497, at *10-14 (S.D.N.Y. Sept. 24, 2024).
- Represented Shake Shack in lawsuit against font company over restaurant chain’s logo and signage, obtaining dismissal with prejudice of font company’s counterclaim based on absence of enforceable contract and copyright preemption. Shake Shack v. House, No. 22 Civ. 7713, 2023 WL 9003713 (S.D.N.Y. Dec. 28, 2023).
- Serving as expert witness for OpenAI on U.S. and California privacy law in putative class action filed in Israel against leading AI developer. Nachum v. OpenAI, No. 1528-04-23 (Central District Court, Israel).
- Architected Yuga Lab’s groundbreaking commercial license agreement for owners of CryptoPunks, the world’s most prominent non-fungible token (NFT) project. https://licenseterms.cryptopunks.app/.
- Represented Scholastic and celebrated author Allen Say in lawsuit seeking to enjoin their publication of illustrated children’s book, defeating motion for TRO based on fair use. James Castle Collection & Archive v. Scholastic & Allen Say, No. 17 Civ. 437, 2017 WL 4896070 (D. Idaho Oct. 30, 2017).
- Represented talent managers for recording artist in lawsuit claiming they violated California’s Talent Scam Prevention Act, obtaining summary judgment based on res judicata. Conway v. Licata, No. BC 753980 (Super. Ct. L.A. County).
- Represented Hasbro and Wizards of the Coast in lawsuit and two-week trial over motion picture rights in Dungeons & Dragons, obtaining settlement that unified rights with client and cleared the path for production of tentpole D&D movie. Hasbro Inc. v. Sweetpea Entertainment Inc., No. 13 Civ. 3406 (C.D. Cal.).
- Represented The Authors Guild and foreign authors’ groups in lawsuits against Google and HathiTrust claiming their mass digitization of copyright-protected books and planned release of “orphan works” constituted copyright infringement, leading to suspension of orphan works program and landmark fair use decisions. Authors Guild, Inc. v. HathiTrust, 755 F.3d 87 (2d Cir. 2014); Authors Guild v. Google, Inc., 804 F.3d 202 (2d Cir. 2015).
In 2015, after spending eight years with the firm in New York, Jeremy moved across the country with his wife and two children to help launch Frankfurt Kurnit’s LA office. He is admitted to practice in New York and California.
