Process to be followed for transfer of property to Natural Heirs/Legal
Heirs based on Registered will/Unregistered Will
Steps involved and maximum time at each step
On receiving the application in performa at Annexure 1, 2 or 3 alongwith
declaration of natural heirs and envelopes hearing current address of natural
heirs and other specified documents Superintendent will convey in any
shortfall to the applicant through registered post. (7 days)
2. Applicant will resubmit the rectified case. 00 clays).
3. On receiving the complete application and documents Estate Officer will write
a letter to applicant within 7 days, by registered for publication of Public
Notice in authorised newspapers seeking objections from anyone concerned
within 15 days of publication. Estate Officer will also send by registered post
the copy of the Public Notice to all natural heirs. (List of authorised news
agencies Annexure-V). (7+ 15= 22 days)
4. During these 15 clays EQ. may call the applicant to see the original will (which
will be returned) / any legal heir/witness br personal hearing if needed.
5. In case an objection is received from a natural heir or a person who is able to
establish a claim on the property by way of documentary evidence, the EO will
not decide the case and direct the applicant to get succession decided from
Civil Court.
6. After the expiry of 15 days of public notice published in news papers if no
written objection of any type is received then orders of transfer of house/
plot/commercial site in the name of legal heirs will be issued by the EO and
sent to the applicant through registered post. (Total Processing time in all
cases = 45 days)
7. These instructions supersede all instructions/letters issued on this subject in
the past.
8. Any violations of building bye laws in construction will not be linked while
processing such succession cases.
