SUBJECT: Dismissal Request - OPR Case #21-008

BACKGROUND:

On January 9, 2021, the QPR received an email from Lieutenant Chad Beckett, Threat
Assessment Section (TAS) in regards to Officer • • • • • personal Instagram page. This
email was forwarded to Beckett from Investigator Samantha Kilbride (T AS):

"On 12/28/2020 the attached screenshots were takenfi·om the Jnstagram sto,y ofa
current Capitol Division officer. His information is as follows:

The screenshots were originally submitted to me by an FRU-3 officer who felt the images
were concerning in nature. "

The email contained nine screen shots found on lnstagram story. (See attached)

On January 11, 2021, an QPR Case number was assigned to the incident and Sergeant Dawn
Smith was assigned as the investigator. On January 12, 2021, Inspector Michael Shaffer
suspended all investigations related to cases generated from the January 6, 2021 insurrection at
the U.S. Capitol building until reviewed by Criminal Investigations Section. It was determined
that • • • actions did not warrant a formal criminal investigation and on January 17, 2021,
the OPR proceeded with its administrative investigation.

OPR Case# 21-008

On January 26, 2021, the QPR contacted Kilbride, who confirmed that the originating
complainant wished to remain anonymous.

DISCUSSION:

Upon reviewing the Instagram screen shots the OPR determined that did not violate
Directive 2053.013, Rules of Conduct, specifically Directive 2053.19, Employee Use of
Electronic Social Media.

• did not display Department logos, uniforms, or similar identifying items.


• • • did ... "not engage in any conduct that constitutes neglect of duty, conduct
unbecoming, discrimination and/or harassment, improper remarks, or any other
act that is likely to adversely affect the discipline, good order, or reputation ofthe
Department or any of its employees. "
• • • • did not post, create, transmit, " ... any content that ridicules, disparage, or
otherwise expresses bias ofany race, any religion, or any protected class of
individuals. "
• • • • did not post, create, transmit " ... any content that reflects behavior that
reasonably would be considered unlawful or unethical. "

The complaint was reviewed by TAS and no concerns of criminal or nefarious activity was
disclosed to the QPR. Complainant who wished to remain anonymous and unable to be
contacted, failed to disclose sufficient information to further the investigation.

RECOMMENDATION:

That the investigation into this matter be classified as DISMISSED and case CLOSED.
