Operate of Air Pollution

Installation/Equipment
and Discharge Permit
relative to RA 8749 and
RA 9275.
What are the requirements? (New application)
1. Duly accomplished and notarized application form
(downloaded from OPMS site)
What are the requirements? (New application)
2. Engineer’s Report prepared and signed by Professional
Mechanical Engineer (PME)/Chemical Engineer and Pollution
Control Officer duly endorsed by the Managing Head
• Description of processes including the amount of raw materials and finished
products, all emissions into the atmosphere and/or material balance.
• Process Flow Diagram indicating all possible sources of air emission
• List of Air Pollution Sources Installations (APSI) and its corresponding Air
Pollution Control Facilities (APCF) with complete specifications
• Discussion of each APSI showing the process/mode of operations, design
criteria and efficiencies of the APCF including the types and quantities of
pollutants emitted.

3. Plant Layout and specification duly signed and sealed by
PME/ChE or any appropriate engineer and Pollution Control
Officer
• Plans and specifications of the proposed Air
Pollution Source and Control Installation (APSCI)
• Plant and Machinery layout showing the
connection of the APSI to the APCF

Note: For stand-by Generator Sets with less than 300 kW capacity submit
copy of manual/picture of the name plate of generator set
What are the requirements? (New application)
4. For APSI emitting regulated pollutants equal or more than
100 tons per year, an Air Quality Modeling is required to be
submitted for evaluation.

Head or Copy of Certificate of PCO
Accreditation
6. Copy of ECC or CNC
7. Penalties/fines and/or arrears paid
What are the requirements? (New application)
8. Proof of Compliance with RA 9003 (ESWM ACT)
• Photo of designated temporary storage area/MRF for recyclables,
electronic wastes, BFLs, batteries and other special wastes.
• Photo of backyard composting area/facility (if applicable) or proof of
collection of compostable/biodegradable wastes.
• Copy of Contract/MOA with the LGU as hauler and with Contract/MOA
with accredited Sanitary Landfill (SLF)/Co-Processing/TSD
Facility operators for disposal of residual wastes.
• Copy of Certificate of Disposal/Treatment issued by
accredited SLF and TSD Facility operators
9. Copy of Tenure Instrument (e.g. Original Certificate Title, TCT,
CLOA, Deed of Absolute Sale, FLAg, FLAgT)

2. Source Emission Test requirements (if required)


• LARGE:
Boiler w/ a capacity of 251 Hp or greater
Gen-Set w/ a capacity of 1250 kW or greater
Any other source w/ potential to emit 100 tons/yr
(twice per year emission test results)
What are the requirements? (Renewal application)
• MEDIUM:
Boiler w/ a capacity of 100-250 Hp
Gen-Set w/ a capacity of 600-1249 kW
Any other source w/ potential to emit 30-99 tons/yr
(once per year emission test results)
• SMALL:
Boiler w/ a capacity of 50-99 Hp
Gen-Set w/ a capacity of 300-599 kW
Any other source w/ potential to emit 10-29 tons/yr
(once per 2 years emission test results)
• EXEMPTED FROM STACK TESTING:
Boiler w/ a capacity of less than 50 Hp
Gen-Set w/ a capacity of les than 300 kW
Any other source w/ potential to emit less than 10 tons/yr
(NOT REQUIRED)

Order of Payment will be downloaded from the OPMS site. Copy of official
receipt of the required fees will be uploaded to the OPMS site.
a) Filing Fee = P 600.00
b) PD1856 = P 10.00
c) Documentary Stamp Tax = P 30.00
d) Permit Fee will be computed by the system pursuant to DAO 2016-28 : Providing for
New Fees and Charges
for Various Services of the Environmental
Management Bureau

Processing of the Application

⚫ The Regional Office shall act on the application for Permit to Operate within
twenty (20) working days from the receipt of all the requirements.

What does archived meant?
• These are applications that are found to
be exempted from securing PTO.
• Dormant application or applications
wherein the proponent did not update for
more than 30 days, it will be archived in
the system.
• A notification will be sent to the proponent
whenever this happens.
