Dear Dr. Ziegler:

The Virginia Department of Education (VDOE) is in receipt of your letter requesting the
agency to reopen the 2020-2021 Discipline, Crime, and Violence (DCV) report. You indicated in
your letter that there had been an omission of a sexual assault in the 2020-2021 report due to the
school division not knowing the outcome of a criminal investigation by local law enforcement
prior to the VDOE DCV reporting deadline.

The VDOE will reopen the data collection so that the Loudoun County Public
Schools’ (LCPS) 2020-2021 DCV data report will include the sexual assault that took place on
May 28, 2021. It is important to note that the code of Virginia and VDOE DCV reporting
guidelines (see link: Comprehensive User Guide for DCV) requires Virginia school divisions to
include any incident that is reported to law enforcement to be reflected in the annual DCV report,
regardless of the outcome of criminal charges or adjudication of the crime. LCPS has shared
publicly that the incident that took place on May 28, 2021 was referred to local law enforcement
right after the incident was reported to school administrators near the end of the 2020-2021
school year. Consequently, the incident and referral to local law enforcement should have been
recorded and reported in the LCPS DCV report that was verified by the Superintendent/designee
and submitted to the VDOE on August 13, 2021.

You have committed LCPS to provide additional training for all LCPS administrators on
the timely reporting of discipline data. It is important to report all student discipline accurately
and timely and especially those that are considered severe or persistently dangerous offenses.
LCPS’ procedures and training should also include the timely entry of all offenses that are
reported to law enforcement as required. Extensive training on the new Student Behavior and
Administrative Response (SBAR) data collection that is replacing DCV this school year has been
provided to LCPS by the VDOE. The VDOE is available to assist you with any additional

clarification and/or training that LCPS may need to ensure SBAR data is reported timely and
accurately.

The VDOE is requiring LCPS to provide to the VDOE the date(s), agenda, training
materials, and certification that all school administrators and those responsible at the Central
Office for DCV (now SBAR) reporting have completed the additional training you have
committed to providing. This training should be completed as soon as possible to ensure
discipline events are recorded accurately and timely throughout the 2021-2022 school year. The
required documents can be submitted to Dr. Dave Myers at [email protected].

The VDOE Director of Data Services will collaborate with the LCPS data team to re-
open the 2020-2021 DCV data collection to ensure the change is recorded accurately. Please do
not hesitate to contact me for any additional assistance the VDOE may provide LCPS in this
matter.
