ENDORSING THE IMPLEMENTATION OF THE METROPOLITAN MANILA


DEVELOPMENT AUTHORITY - METRO MANILA FLOOD MANAGEMENT PROJECT
(MMDA-MMFMP) AT BARANGAY 905 IN SUPPORT OF THE BARANGAY’S SOLID
WASTE MANAGEMENT PROGRAM AS MANDATED BY REPUBLIC ACT NO. 9003

WHEREAS, Section 15, Article II of the 1987 Philippine Constitution, provides that the State
shall protect and promote the right to health of the people and instill health consciousness among
them;

WHEREAS, Section 16, Article II of the 1987 Philippine Constitution, provides that the State
shall protect and advance the right of the people to a balanced and healthful ecology in accord with
the rhythm and harmony of nature;

WHEREAS, R.A. 7924 was enacted to create the Metropolitan Manila Development
Authority (MMDA) which shall perform planning, monitoring and coordinative functions, and in the
process exercise regulatory and supervisory authority over the delivery of metro-wide services within
Metro Manila without diminution of the autonomy of the local government units concerning purely
local matters.

WHEREAS, Sec. 3 of RA 7924 provides the Authority’s scope of services which includes
Solid waste disposal and management which include formulation, and implementation of policies,
standards, programs and projects for proper and sanitary waste disposal. It shall likewise include the
establishment and operation of sanitary landfill and related facilities and the implementation of other
alternative programs intended to reduce, reuse and recycle solid waste;

WHEREAS, pursuant to its mandate, the Metropolitan Manila Development Authority is


implementing the Metro Manila Flood Management Project, particularly “Minimizing Solid Waste in
Waterways.”

WHEREAS, the development objective of the Metro Manila Flood Management Project for
the Philippines (“MMFMP”) of the Authority is to improve flood management in selected areas of
Metro Manila;

WHEREAS, the MMFMP is comprised of four (4) components. The first of which shall be
for the modernization of drainage areas through the construction and innovation of pumping stations
and appurtenant infrastructure, and the improvement of waterways and drainage channels. The second
shall be for the minimization of solid waste in waterways. The third shall be for participatory housing
and resettlement and the fourth shall be for the project management and coordination;

WHEREAS, MMDA is implementing the second component of its program: Minimizing


Solid Waste in Waterways. MMDA will assist in improving the management of solid wastes along
major waterways and drainage channels as well as in the land based, updating of the Barangay SWM
Plan, conduct of community-based capacity building and behavioral change communication
campaigns, and possible provision of results-based incentives, and piloting innovative ways in
improving solid waste management;

WHEREAS, Section 16 of R.A. 7160 otherwise known as the Local Government Code of the
Philippines also provides in its General Welfare clause that: “Every local government unit shall
exercise the powers expressly granted, those necessarily implied therefrom, as well as powers
necessary appropriate, or incidental for its efficient and effective governance, and those which are
essential to the promotion of general welfare. Within the irrespective territorial jurisdictions, local
government units shall ensure and support, among other things . . . promote health and safety,
enhance the right of the people to a balanced ecology, maintain peace and order, and preserve the
comfort and convenience of their inhabitants.”

WHEREAS, it is the responsibility of the local government unit to effectively and efficiently
implement the Solid Waste Management System under Republic Act No. 9003 in its territorial
jurisdiction;

WHEREAS, Rule VI of the Implementing Rules and Regulations (IRR) of R.A. 9003
provides for the creation of a Local Solid Waste Management Board wherein the composition,
functions and responsibilities of the Provincial, City/Municipality. and Barangay Solid Waste
Management Boards are enumerated;

WHEREAS, among the responsibilities of the Barangay Solid Waste Management


Committee as provided in Section 7 of the IRR is the segregation and collection of biodegradables,
compostable and reusable wastes and the establishment of a Materials Recovery Facility;

WHEREAS, the poor and unsystematic waste disposal by households and


commercial/industry establishments causes unsightly surroundings and spread of communicable
diseases;

WHEREAS, the practice of waste segregation to facilitate reuse and recycling does not only
reduce the cost of collection and disposal of garbage but conserves the natural resources of materials
and avoid wasteful consumption of goods; 

WHEREAS. improperly managed solid waste can also result in clogged waterways and
drainage channels, compromised flood control functions of pumping stations, and eventually in
increased magnitude of flooding and destruction of infrastructures, residences and commercial
establishments.

increased magnitude of flooding and destruction of infrastructures, residences and commercial
establishments.

WHEREAS, Barangay 905, Zone 100, District VI of the City of Manila is mandated by the
1987 Constitution and the Local Government Code to protect, preserve and conserve the ecosystem
and shall remain committed for the purpose;

NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, that


Barangay 905 shall extend its full support to the successful implementation of the MMDA-Metro
Manila Flood Management Project within the territorial jurisdiction of Barangay 905.
