EMPLOYMENT AGREEMENT

This AGREEMENT is entered into this ___________________, at the City of Davao, by and
between:

RUGENE N. BERATO WELL LABORATORY DIAGNOSTIC CENTER, a clinical laboratory


duly organized and registered under the laws of the Philippines, with principal address
at J. Saavedra St., Toril, Davao City, represented by RUGENE N. BERATO, RMT, who
holds the following position: PROPRIETOR/MANAGING DIRECTOR, hereinafter
referred to as the EMPLOYER

-AND-

SALMAN P. JOHAYR, RMT, Filipino, of legal age, single, and with postal address at
Davao City hereinafter referred to as the EMPLOYEE

WITNESSETH:

WHEREAS, the EMPLOYER is engaged in the business of Clinical Laboratory;

WHEREAS, the EMPLOYEE has qualified in the pre-employment requirements of the


EMPLOYER;

WHEREAS, the EMPLOYER hereby offers and EMPLOYEE hereby accepts probationary
employment in the following rank-and-file position: MEDICAL TECHNOLOGIST-STAFF

NOW THEREFORE, in consideration of the foregoing, the parties hereby agree as


follows:

1. PERIOD OF PROBATIONARY EMPLOYMENT

The probationary period of the PROBATIONARY EMPLOYEE shall be for a period


not longer than Six (6) months starting from the first day of work of the
EMPLOYEE.

2. DUTIES AND RESPONSIBILITIES

The EMPLOYEE shall perform the following duties and responsibilities:

2.1 Collect blood or tissue samples from patients, observing principles of aseptic
technique to obtain blood sample.
2.2 Delivers test result to physicians or patients.
2.3 Prepares standard solutions and reagents to be combined with samples,
following standardized formulas or experimental procedures.
2.4 Perform related work as required.

3. EVALUATION

The EMPLOYEE acknowledges and understands that regularization of


employment with the EMPLOYER is conditioned on satisfactorily meeting the
standards set forth as follows:

The standards upon the EMPLOYEE will be evaluated on has likewise been
explained to the EMPLOYEE by the EMPLOYER at the time of engagement.

The EMPLOYEE shall be evaluated by the immediate manager of the EMPLOYEE.

4. REGULARIZATION

By or before the end of the Six (6) month period, the EMPLOYEE may acquire
regular status upon evaluation and recommendation of the immediate manager.

Upon regularization, the EMPLOYEE shall be entitled to all company benefits and
privileges enjoyed by all regular employees of similar rank and tenure.

5. COMPENSATION

The EMPLOYEE shall be paid a gross rate of FIVE HUNDRED PESOS (P500.00)
per day, subject to government-mandated deductions to be borne by the
employee, every 15th and 30th/31st day of the month.

The EMPLOYER may, as its discretion, grant bonuses, allowances, or benefirs not
defined in this contract. Such exercise of discretion shall not be considered as
established practice or precedent and shall not be demandable under this
Employment Agreement or any other written or unwritten agreement.

6. WORK HOURS

The EMPLOYEE shall work with the following schedule:

First Shift: 6:00 AM to 2:00 PM


Second Shift: 10:00 AM to 6:00 PM

The work schedule may be changed by the EMPLOYER Or irs management as it


may deem necessary meet its operational requirements.

The EMPLOYEE may be required to work more than her regular work schedule
due to the demands of the business or the requirements of the EMPLOYER.

7. PLACE OF WORK

The primary place of work of the EMPLOYEE shall be in WELL LABORATORY


DIAGNOSTIC CENTER, J. Saavedra St., Toril, Davao City

The EMPLOYEE may be transferred or assigned to other locations as may be


required by the needs of the EMPLOYER.

The EMPLOYEE may be required to travel from time to time.


8. COMPANY RULES AND REGULATIONS

The EMPLOYEE shall follow all company rules and regulations, written or
otherwise. All existing and future company rules and regulations shall be
deemed incorporated in this AGREEMENT.

It shall be the duty and responsibility of the EMPLOYEE to be aware of and


comply with the EMPLOYER’S rules and regulations.

The EMPLOYER undertakes to provide and updated version of said document


every time it is updated.

9. TERMINATION OF EMPLOYMENT

The EMPLOYER may terminate the probationary employment prior to the


expiration of the probationary period upon failure of the EMPLOYEE to
satisfactorily meet the standards provided in this AGREEMENT or for any of the
just or authorized causes provided by law, including analogous causes specified
in the company ruels and regulations or policy.

10. RESIGNATION OF THE EMPLOYEE

The EMPLOYEE shall give a written notice of their intention to resign from their
employment at least thirty (30) days prior to the effective date of their
resignation.

11. NON-DISCLOSURE

The EMPLOYEE shall not divulge to any third party any part of this AGREEMENT,
including salaries and other remunerations unless legally required by law,
statute, or any competent authority.

12. CONFIDENTIALITY

The EMPLOYEE understands and acknowledges that all records, documents, and
other information, written or otherwise, are confidential and shall not be
disclosed during and after employment with the EMPLOYER.

13. ENTIRETY OF AGREEMENT

This AGREEMENT represents the entire agreement between the EMPLOYER and
EMPLOYEE and supersedes all prior negotiations, representations, agreements,
either oral or written.
IN WITNESS WHEREOF, the parties have hereunto affixed their signatures on the date
and place first stated above.
