APPLICATION FOR PROBATION

COMES NOW, accused ABC, through the undersigned counsel, and unto
this Honorable Court, most respectfully submits the instant application
and in support thereto alleges that:

1. That on 16 July 2019, accused ABC in relation to the above


captioned cases, availed the Plea Bargaining sanctioned by A.M.
No. 18-03-16-SC (Adoption of the Plea Bargaining Framework in
Drugs Cases) and was adjudged guilty to two (2) counts of
Violation of Section 12, Article II of Republic Act 9165. As
such, he was sentenced to suffer the penalty of
____________________________________ and to pay the fine of ten
thousand pesos (Php10,000.00) for each case.

2. That, it is maintained that the crimes accused-applicant are


found guilty of are not offenses against the security of the
State;

3. That the accused has been in detention in relation to the above-


captioned cases since ____________;

4. Furthermore, the accused-applicant is a first time offender as


defined by law, and has all the qualifications and none of the
disqualifications provided under the Probation Law of 1976, as
amended by RA 10707 (Probation Law) thus, legally qualified to
apply therefore;

5. Under the premises, accused-applicant hereby manifests his


ardent desire to apply for the privilege sanctioned by the
provisions of the Probation Law.

6. Accused-applicant further undertakes to faithfully and


religiously comply with the conditions of probation as provided
for by the Probation Law or as may be ordered by the Honorable
Court should his application for probation be granted.

WHEREFORE, all premises considered, it is most respectfully prayed
of this Honorable Court that the Probation Officer be directed to
conduct a post sentence investigation relative to the instant
application of the accused-applicant for probation.

Other reliefs just and equitable under the circumstances are


likewise prayed for.
