Actingontheletterofthechairmanofthecommitteeonrevisionoftherulesofcourtsubmittingforthiscourts
consideration and approval the proposed rule on commitment of children, the court resolved to approve the
same.

TheruleshalltakeeffectonApril15,2002followingitspublicationinanewspaperofgeneralcirculationnot
laterthanMarch15,2002.

RULEONTHECOMMITMENTOFCHILDREN

SECTION 1. Objective, The objective of this Rule is to ensure that every effort is exerted to promote the
childs welfare and enhance his opportunities for a useful and happy life, Toward this end, this Rule seeks to
protect the child from all forms of neglect, abuse, cruelty, exploitation and other conditions prejudicial to his
development.

SEC.2.Interpretation.Thebestinterestsofthechildshallbetheparamountconsiderationinallactions
concerninghim,whetherundertakenbypublicorprivatesocialwelfareinstitutions,courtsoflaw,administrative
authoritiesandlegislativebodiesconsistentwiththeUnitedNationsConventionontheRightsoftheChild,
SEC.3.DefinitionofTerms.

(a)Childisapersonbeloweighteenyearsofage.

(b)DepartmentreferstotheDepartmentofSocialWelfareandDevelopment,

(c)Dependentchildisonewhoiswithoutaparent,guardianorcustodian,oronewhoseparents,guardianor
othercustodianforgoodcausedesirestoberelievedofhiscareandcustody,andisdependentuponthe
publicforsupport.

(d)Abandonedchildisonewhohasnoproperparentalcareorguardianship,orwhoseparentsorguardian
hasdesertedhimforaperiodofatleastsix(5)continuousmonths.

(e)Neglectedchildisonewhosebasicneedshavebeendeliberatelyunattendedtoorinadequatelyattended
to,physicallyoremotionally,byhisparentsorguardian.

(f)Physicalneglectoccurswhenthechildismalnourished,illcladandwithoutpropershelter.

(g)Emotionalneglectoccurswhenachildisraped,seduced,maltreated,exploited,overworkedormadeto
workunderconditionsnotconducivetogoodhealthmadetobeginthestreetsorpublicplaces,orwhen
placedinmoraldanger,orexposedtodrugs,alcohol,gambling,prostitutionandothervices.

(h)Disabledchildincludesmentallyretarded,physicallyhandicapped,emotionallydisturbedandmentallyill
children,childrenwithcerebralpalsyandthosewithsimilarafflictions.

(i)Mentallyretardedchildisonewhois(1)sociallyincompetent,thatis,sociallyinadequate,occupational^
incompetentandunabletomanagehisownaffairs(2)mentallysubnormal(3)intellectuallyretardedfrombirth
orearlyage(4)retardedatmaturity(5)mentallydeficientasaresultofconstitutionaloriginthroughheredity
ordiseasesor(6)essentiallyincurable.

(j)Physicallyhandicappedchildisonewhoiscrippled,deafmute,blind,orotherwisesuffersfromadefect
whichrestrictshismeansofactionorcommunicationwithothers.

(k)Emotionallydisturbedchildisonewho,althoughnotafflictedwithinsanityormentaldefect,isunableto
maintainnormalsocialrelationswithothersandthecommunityingeneralduetoemotionalproblemsor
complexes.

(I)Mentallyillchildisonewithanybehavioraldisorder,whetherfunctionalororganic,whichisofsucha
degreeofseverityastorequireprofessionalhelporhospitalization.

(m)CommitmentorsurrenderofachildisthelegalactofentrustingachildtothecareoftheDepartmentor
anydulylicensedchildplacementorchildcaringagencyorindividualbythecourt,parentorguardianorany
interestedparty.

(n)Involuntarilycommittedchildisonewhoseparentshavebeenpermanentlyandjudiciallydeprivedof
parentalauthorityduetoabandonmentsubstantial,continuous,orrepeatedneglectabuseorincompetence
todischargeparentalresponsibilitiesinaccordancewithSection4herein.
(o)Voluntarilycommittedchildisonewhoseparentsknowinglyandwillinglyrelinquishedparentalauthorityto
theDepartmentoranydulylicensedchildplacementorchildcaringagencyorindividualinaccordancewith
Section3herein.

(p)Childplacingorchildplacementagencyreferstoaprivatenonprofitorcharitableinstitutionor
governmentagencydulylicensedandaccreditedby(heDepartmenttoprovidecomprehensivechildwelfare
services,includingbutnotlimitedto,receivingapplicationsforadoptionorfostercare,evaluatingthe
prospectiveadoptiveorfosterparentsandpreparingthehomestudyreport.

(q)Childcaringagencyreferstoaprivatenonprofitorcharitableinstitutionorgovernmentagencyduly
licensedandaccreditedbytheDepartmentthatprovidestwentyfourhourresidentialcareservicesfor
abandoned,orphaned,neglected,involuntarilyorvoluntarilycommittedchildren.

(r)Guardianadlitemisapersonappointedbythecourtwherethecaseispendingforachildsoughttobe
committedtoprotecthisbestinterests.

(s)CaseStudyReportisawrittenreportoftheresultofaninvestigationconductedbyasocialworkerasto
thesociocultural,economicandlegalstatusorconditionofthechildsoughttobecommitted.Itshallinclude
amongothershisdevelopmentalage,educationalattainment,familyandsocialrelationships,thequalityofhis
peergroup,hisfamilysstrengthsandweaknessesandparentalcontroloverhim.Thereportissubmittedtothe
FamilyCourttoaiditinitsevaluationofwhetherthechildoughttobecommittedtothecareoftheDepartment
oranydulylicensedchildplacementorchildcaringagencyorindividual.

SEC.4.

(a)Whomayfile.TheSecretaryoftheDepartmentorhisauthorizedrepresentativeoranydulylicensed
childplacement or childcaring agency having knowledge of a child who appears to be dependent,
abandonedorneglected,mayfileaverifiedpetitionforinvoluntarycommitmentofsaidchildtothecareof
anydulylicensedchildplacementorchildcaringagencyorindividual.

(b)Venue.ThepetitionshallbefiledwiththeFamilyCourtoftheprovinceorcityinwhichtheparentor
guardianresidesorwherethechildisfound.

(c)ContentsofVerifiedPetition.Thepetitionmuststate:

1. The names of the parents or guardian and their place of residence. If the childs parents are
unknown,petitionermustallegethatdiligenteffortshavebeenexertedtolocatethem.Itsaidparents
aredeceased,petitionershallattachacertifiedtruecopyoftheirdeathcertificate

2.Thefactsshowingthatthechildisdependent,abandoned,orneglected

3.Thefactsshowingwhohascustodyofthechildatthetimeofthefilingofthepetitionand

4.Thename,addressandwrittenconsentoftheDepartmentordulylicensedchildplacementorchild
caringagencyorindividualtowhosecarethecommitmentofthechildissoughttobeentrusted.
(d)SummonsCourttoSetTimeforHearing.Ifthecourtissatisfiedthatthepetitionissufficientin
formandsubstance,itsnaildirecttheclerkofcourttoimmediatelyissuesummonswhichshallbeserved
togetherwithacopyofthepetitionandanoticeofhearing,upontheparentsorguardianofthechildand
theofficeofthepublicprosecutornotlessthanfive(5)daysbeforethedateofthehearing.Theofficeof
thepublicprosecutorshallbedirectedtoimmediatelytransmitthesummonstotheprosecutorassignedto
theFamilyCourtconcerned.

Ifitappearsfromthepetitionthatbothparentsofthechildaredeadorthatneitherparentcanbefoundinthe
provinceorcitywherethecourtislocatedandthechildhasnoguardianresidingtherein,summonsmaynotbe
issuedandthecourtshallthereuponappointaguardianadlitempursuanttoSubsection(f)belowandproceed
withthehearingofthecasewithduenoticetotheprovincialorcityprosecutor.

(e)SocialWorker.AfterthecourtsetsthepetitionforhearinginaccordancewithSubsection(d)above,it
shalldirectthesocialworkertosubmit,beforethehearing,acasestudyreportofthechildtoaiditinevaluating
whethersaidchildshouldbecommittedtothecareoftheDepartmentoranydulylicensedchildplacementor
childcaringagencyorindividual.Thereportshallbearthesignatureofthesocialworkeroneverypage.

(f)GuardianAdLitemofChild.Ifneitheroftheparentsnortheguardianofthechildcanbelocatedordoes
notappearincourtdespiteduenotice,orifthecourtfindsthemincompetenttoprotectthebestinterestsofthe
child,itshallbethedutyofthecourttoappointasuitablepersonasguardianadlitemtorepresentthechild.In
makingtheappointment,thecourtshallconsiderthebackgroundoftheguardianadlitemandhisfamiliarity
withthejudicialprocess,socialserviceprogramsandchilddevelopment.AmemberofthePhilippineBarmay
beappointedguardianadlitem.

(g)ChildsRighttoCounsel.Thecourt,uponrequestofthechildcapableofforminghisownviewsorupon
requestofhisguardianadlitem,shallappointalawyertorepresenthimintheproceedings.

(h)DutyofPublicProsecutor.TheprovincialorcityprosecutorshallappearfortheStateandascertainif
therehasbeenduenoticetoallpartiesconcernedandthatthereisjustificationforthedeclarationof
dependency,abandonmentorneglect.

(i)Hearing.Thecourtshalldirectthepersonoragencywhichhascustodyofthechildtobringthelatterto
thecourtonthedateofthehearingofthepetitionandshallascertainthefactsanddeterminewhetherthechild
isdependent,abandoned,orneglected,andifso,thecauseandcircumstancesofsuchcondition.

(j)Judgment.If,afterthehearing,thecourtshallfindthechildtobedependent,abandoned,orneglected,it
shallrenderjudgmentcommittinghimtothecareandcustodyoftheDepartmentoranydulylicensedchild
placementorchildcaringagencyorindividualuntilhereachestheageofeighteen(18),Thejudgmentshall
likewisemakeproperprovisionsforthecustodyofthepropertyormoneybelongingtothecommittedchild.

IfthechildiscommittedtotheDepartment,itshallnotifythecourtwithinthirty(30)daysfromtheorderof
commitment,thenameandaddressofthedulylicensedandaccreditedchildplacementorchildcaringagency
orindividualwherethechildshallbeplaced.

However,ifthecourtfindsthattheabandonmentorneglectofthechildmayberemedied,thechildmaybe
allowedtostayinhisownhomeunderthecareandcontrolofhisparentsorguardian,subjecttosupervision
anddirectionoftheDepartment.
(k)VisitationorInspection.Anydulylicensedchildplacementorchildcaringagencyorindividualtowhom
achildhasbeencommittedbythecourtshallbesubjecttovisitationorinspectionbyarepresentativeofthe
courtoroftheDepartment,asthecasemaybeorofboth,todeterminewhetherthewelfareandinterestsof
thechildarebeingserved,

(I)ReportofPersonorInstitution.Anydulylicensedchildplacementorchildcaringagencyorindividualto
whomachildhasbeencommittedbyjudicialordermayatanytimeberequiredbythecourttosubmitareport,
containingallnecessaryinformationfordeterminingwhetherthewelfareofthechildisbeingserved.

(m)TemporaryCustodyofChild.Thedulylicensedchildplacementorchildcaringagencyorindividualto
whomachildhasbeencommittedmayfileaverifiedmotionwiththecourtwhichgrantedthepetitionfor
involuntarycommitmentofachildtoplacehiminthecareofanysuitableperson,uponthelattersrequest,for
aperiodnotexceedingonemonthatatime.Thecourtmayorderthesocialworkertosubmitacasestudy
reporttoaiditinevaluatingwhethersuchtemporarycustodyshallbeforthebestinterestsofthechild.The
periodoftemporarycustodyofthechildmaybeextendedbythecourtforaperiodnotexceedingonemonthat
atimeuponmotionofthedulylicensedchildplacementorchildcaringagencyorindividualtowhichthechild
hasbeencommitted.

Thecourt,motuproprio,oruponrequestofthechildassistedbyhisguardianadlitem,orattheinstanceofthe
agencyorpersontowhomthechildwascommitted,afterduenoticeandhearing,shalldiscontinuethe
temporarycustodyofthechildifitappearsthatheisnotbeinggivenpropercare.

Afteronemonthfromthedatetemporarycustodyofthechildwasgiventoanothersuitableperson,theagency
orindividualshallsubmittothecourtaverifiedreportonwhetherthetemporarycustodyofthechildhas
promotedhisbestinterests.

(n)ChangeofCustody.IfthechildiscommittedtotheDepartment,itshallhavetheauthoritytochangethe
custodyo!achildithadplacedwithanydulylicensedchildplacementorchildcaringagencyorindividualifit
appearsthatsuchchangeisforthebestinterestsofthechild.TheDepartmentshallnotifythecourtofany
changeincustodyofthechild,

Whenconflictinginterestsariseamongchildplacementorchildcaringagencies,thecourtwhichgrantedthe
involuntarycommitmentofthechild,uponmotionoftheDepartmentoranyoftheagenciesconcerned,shall
orderthechangeofcommitmentofthechild.

(o)RemovalofCustody.Amotiontoremovecustodyofachildmaybefiledbyanauthorizedrepresentative
oftheDepartmentwithknowledgeofthefactsagainstachildplacementorchildcaringagencyorindividualto
whosecustodyachildhasbeencommittedbythecourtonthegroundofneglectofsuchchildasdefinedin
Section3(e)ofthisRule.Thecourtshallsetthemotionforhearingwithnoticetothepublicprosecutorandthe
courtdesignatedsocialworker.Ifthecourtfindsafterhearingthattheallegationsofthemotionhavebeen
establishedandthatitisforthebestinterestsandwelfareofthechild,thecourtshallissueanorderremoving
himfromthecustodyofthepersonoragency,asthecasemaybe,andcommittinghimtothecustodyof
anotherdulylicensedchildplacementorchildcaringagencyorindividual.

Inthesameproceeding,thecourtmaysuspendorrevokethelicenseoftheagencyorindividualfoundguiltyof
suchneglectdependinguponthegravityorfrequencyoftheoffense.

(p)RestorationofParentalAuthorityAfterInvoluntaryCommitment.
(i) Who may file Ground. The parents or guardian of a child committed to the care of a person,
agencyorinstitutionbyjudicialordermayfileaverifiedmotionfortherestorationofhisrightsoverthe
child with the court which granted the involuntary commitment on the ground that he is now able to
takepropercareandcustodyofsaidchild,provided,however,thatthechildhasnotyetbeenadopted.

(ii)NoticeofHearing.Thecourtshallfixthetimeanddateforthehearingofthemotion,whichshall
notbeearlierthanthirty(30)daysnorlaterthansixty(60)daysfromthedateofthefilingofsaidmotion
andcausenoticeofthehearingtobesenttotheperson,agencyorinstitutiontowhichthechildhas
been committed, the public prosecutor and the courtdesignated social worker, at least five (5) days
beforethedateofhearing.

(iii)Hearing.Atthehearing,anypersonmaybeallowedtointerveneatthediscretionofthecourtto
contesttherighttothereliefdemanded.Witnessesmaybecalledandexaminedbythepartiesorby
thecourtmotuproprio.

(iv)Resolution.Ifitisfoundthatthecauseforthecommitmentofthechildnolongerexistsandthat
the movant is already able to take proper care and custody of the child, the court, after taking into
consideration the best interests and the welfare of the child, shall issue a resolution terminating the
parentalauthorityoftheperson,agencyorinstitutiontowhomthechildwascommittedbyjudicialorder
andrestoringparentalauthoritytothemovant.

q)JurisdictionforProsecutionofPunishableActs.TheFamilyCourtwhichgrantedtheinvoluntary
commitment shall have jurisdiction over the prosecution of a child who left without prior permission from
thepersonorinstitutiontowhichhehasbeenjudiciallycommittedorthepersonunderwhosecustodyhe
hasbeenjudiciallycommittedinaccordancewithSubsection(m)ofSection4ofthisRule.Itshalllikewise
havejurisdictionoverthepersonwhoinducedthechildtoleavesuchpersonorinstitution,exceptincase
of actual or imminent grave physical or moral danger to the child. The Family Court which granted the
involuntary commitment shall also have jurisdiction over the prosecution of parents or guardians of the
childwhomaybeheldliableunderArticles59and60ofP.D.No.603andSections9,10and31ofR.A.No.
7610.

SEC.5.VoluntaryCommitmentofaChildtoanInstitutionorIndividual.Theparentorguardianofa
dependent,abandonedorneglectedchildmayvoluntarilycommithimtotheDepartmentoranydulylicensed
childplacementorchildcaringagencyorindividualsubjecttotherulesoftheDepartment.However,nochild
shall be committed unless he is surrendered in writing by his parents or guardian stating such voluntary
commitment and specifically naming the office, agency, or individual to whose custody the child is to be
committed. Such written instrument should be notarized and signed in the presence of an authorized
representative of the Department after counseling and other services have been made available to encourage
thechildsparentstokeepthechild.

(a)PetitionforRemovalofCustody.
(i) Who may file Ground. The parents or guardian who voluntarily committed the child, or in their
absenceorfailure,anypersonwithknowledgeofthefacts,mayfileaverifiedpetitiontoremovecustody
of the child against the childplacement or childcaring agency or individual to whose custody the child
hasbeenvoluntarilycommittedonthegroundofneglectofsuchchildasdefinedinSection3(e)ofthis
Rule. A child may also be removed from the custody of the childplacement or childcaring agency or
individualonthegroundthatthevoluntarycommitmentofthechildwasunjustified.

(ii) Venue. The petition shall be filed with the Family Court of the province or city where the child
placementorchildcaringagencytowhichthechildhasbeenvoluntarilycommittedislocatedorwhere
thechildmaybefound.

(iii)ContentsofVerifiedPetition.Thepetitionmuststate:

Thenameandaddressofthechildplacementorchildcaringagencyorindividualtowhosecustodythe
childhasbeenvoluntarilycommitted

The facts showing that the child has been neglected by the agency or in cases where the voluntary
commitmentwasunjustified,thattheparentsofthechildareactuallycapableoftakingcareandcustody
ofthechild

The name, address and written consent of the duly licensed childplacement or childcaring agency or
individualtowhosecarethechildmaybetransferred.

Thefactsshowingthatpetitionerhasexhaustedtheadministrativeremediesavailabletohim,

(iv)NoticeofHearing.Ifthepetitionissufficientinformandsubstance,thecourtshallsetthesamefor
hearing with notice to the Department, the public prosecutor, the courtdesignated social worker, the
agencyorindividualtowhomthechildhasbeencommittedandinappropriatecases,theparentsofthe
child.

(v)Judgment.Ifafterhearingthecourtfindsthattheallegationsofthepetitionhavebeenestablished
andthatitisforthebestinterestsandwelfareofthechild,itshallissueanorderremovingthechildfrom
the custody of the person or agency concerned, and committing him to the custody of another duly
licensedchildplacementorchildcaringagencyorindividual.

The court, in the same proceeding may, after hearing the comment or recommendation of the
Department, suspend or revoke the license of the agency or individual found guilty of such neglect
dependinguponthegravityorfrequencyoftheoffense.

(b) Restoration of Parental Authority After Voluntary Commitment. The restoration of rights of the
parent or guardian over the child who has been voluntarily committed shall be governed by the rules of the
Department,provided,however,thatthepetitionforrestorationisfiledwithinsix(6)monthsfromthedateof
voluntary commitment. In case the Department refuses to grant legal custody and parental authority to the
parentorguardianoverthechildwhohasbeenvoluntarilycommittedtoanagencyorindividual,theparentor
guardianmayfileapetitionincourtforrestorationofparentalauthorityinaccordancewithSection4(p)ofthis
Rule.
(c)JurisdictionforProsecutionofPunishableActs.TheFamilyCourtoftheplacewherethechildmaybe
foundorwherethedulylicensedchildplacementorchildcaringagencyorindividualislocatedshallhave
jurisdictionovertheprosecutionofachildwholeftwithoutpriorpermissionfromthepersonorinstitutionto
whichhehasbeenvoluntarilycommitted.Itshalllikewisehavejurisdictionoverthepersonwhoinducedthe
childtoleavesuchpersonorinstitution,exceptincaseofgraveactualorimminentphysicalormoraldanger,to
thechild.ThesameFamilyCourtshallalsohavejurisdictionovertheprosecutionofparentsorguardiansofthe
childwhomaybeheldliableunderArticles59and60ofP.O.No,603andSections9,10and31ofR.A.No.
7610.

SEC.6.PetitionforCommitmentofaDisabledChild.

(a) Who may file. Where a child appears to be mentally retarded physically handicapped, emotionally
disturbed, mentally ill, with cerebral palsy or with similar afflictions and needs institutional care but his
parentsorguardiansareopposedthereto,theDepartment,oranydulylicensedchildplacementorchild
caring agency or individual may file a verified petition for commitment of the said child to any reputable
institutionprovidingcare,trainingandrehabilitationfordisabledchildren.

Theparentsorguardianofthechildmayfileasimilarpetitionincasenoimmediateplacementcanbearranged
forthedisabledchildwhenhiswelfareandinterestsareatstake,

(b)Venue.ThepetitionforcommitmentofadisabledchildshallbefiledwiththeFamilyCourtoftheplace
wheretheparentorguardianresidesorwherethechildisfound.

(c)ContentsofVerifiedPetition.Thepetitionforcommitmentmuststalethefollowing:

(1) The facts showing that the child appears to be mentally retarded, physically handicapped,
emotionallydisturbed,mentallyill,withcerebralpalsyorwithsimilarafflictionsandneedsinstitutional
care

(2)Thenameoftheparentsandtheirresidence,ifknown,orifthechildhasnolivingparent,thename
andresidenceoftheguardian,ifanyand

(3)Thefactthattheparentsorguardianoranydutylicenseddisabledchildplacementorchildcaring
agency,asthecasemaybe,hasopposedthecommitmentofsuchchild

(4)Thenameandwrittenconformityoftheinstitutionwherethechildistobecommitted.

(5)Anestimateofthecostsandotherexpensesofmaintainingthechildintheinstitution.

Theverifiedpetitionshallbesufficientifbaseduponthepersonalknowledgeofthepetitioner.

(d)OrderofHearingNotice.Ifthepetitionfiledissufficientinformandsubstance,thecourt,byanorder
recitingthepurposeofthepetition,shallfixthedateofthehearingthereof,andacopyofsuchordershallbe
servedonthechildallegedtobementallyretarded,physicallyhandicapped,emotionallydisturbed,mentallyill,
withcerebralpalsyorwithsimilarafflictionsandonthepersonhavingchargeofhimoranyofhisrelatives
residingintheprovinceorcityasthecourtmaydeemproper.
Theordershallalsodirectthesherifforanyotherofficerofthecourttoproduce,ifnecessary,thealleged
disabledchildonthedateofthehearing.

(e)HearingandJudgment.Ifthecourtfindsthattheallegationsofthepetitionhavebeenestablishedandthat
institutionalcareofthechildisforhisbestinterestsorthepublicwelfareandthathisparents,orguardianor
relativesareunableforanyreasonwhatsoevertotakepropercareofhim,thecourtshallorderhiscommitment
totheproperinstitutionfordisabledchildren.Thecourtshalllikewisemakeproperprovisionsforthecustodyof
thepropertyormoneybelongingtothecommittedchild.

Theexpenseofmaintainingadisabledchildintheinstitutiontowhichhehasbeencommittedshallbeborne
primarilybytheparentsorguardianandsecondarily,bysuchdisabledchild,ifhehaspropertyofhisown.

Inallcaseswheretheexpensesforthemaintenanceofthedisabledchildcannotbepaidinaccordancewith
theimmediatelyprecedingparagraph,theDepartmentshallbeartheexpenses,orsuchpartthereofasmay
remainunpaid.

Thecourtshallfurnishtheinstitutiontowhichthechildhasbeencommittedwithacopyofitsjudgment,
togetherwithailthereportsandotherdatapertinenttothecase.

(f)DischargeofJudiciallyCommittedDisabledChild.Uponmotionoftheparent,guardianorinstitutionto
whichthechildhasbeenjudiciallycommittedunderthisRule,thecourt,afterhearing,shallorderthedischarge
ofsuchchildifitisestablishedandcertifiedbytheDepartmentthat:

(1)Heisnolongeradangertohimselfandthecommunity

(2)Hehasbeensufficientlyrehabilitatedfromhisphysicalhandicaporifofworkingage,isalreadyfitto
engageingainfuloccupationor

(3)Hehasbeensufficientlyrelievedofhispsychological,mentalandemotionalproblemsandisready
toassumenormalsocialrelations.

SEC.7.Effectivity.ThisruleshalltakeeffectonApril15,2002afteritspublicationinanewspaperofgeneral
circulationnotlaterthanMarch15,2002.
