CH.551). The Hays County Commissioners Court will hold a meeting at 9:00 A.M. on the 21 day of June, 2016,
in the Hays County Courthouse, Room 301, San Marcos, Texas. An Open Meeting will be held concerning the

various donations for the Kyle Depot Project and amend the budget accordingly. All voting Aye.

AUTHORIZE THE COUNTY JUDGE TO ACCEPT A GRANT AWARD FROM THE


TEXAS VETERANS COMMISSION IN THE AMOUNT OF $15,000.00 AND AMEND
THE BUDGET ACCORDINGLY

On November 17, 2015 the Commissioners Court approved submission of a grant application to the Texas
Veterans Commission. The funds will be used to pay court fees associated with the expunction of the veteran
defendants' criminal records upon successful completion of the Veterans treatment court. The term of the grant
is July 1, 2016 to June 30, 2017. Attached is the award and the notice of grant award will be mailed to the
agency directly to execute contract. A motion was made by Commissioner Ingalsbe, seconded by
Commissioner Whisenant to authorize the County Judge to accept a grant award from the Texas
Veterans Commission in the amount of $15,000.00 and amend the budget accordingly. All voting Aye.

OFFICE FLEET TO THE DISTRICT ATTORNEY'S OFFICE

The following vehicles are being requested for transfer from the Sheriff's Office Fleet to the District Attorney's
Office. Equipment Transfer 2007 Dodge Charger - Fixed Asset #: 16112 2007 Dodge Charger - Fixed Asset #:
15614. A motion was made by Commissioner Whisenant, seconded by Commissioner Ingalsbe to
approve a transfer request of two vehicles from the Sheriff's Office Fleet to the District Attorney's Office.

AUTHORIZE COMMERCIAL OSSF PERMIT AT 131 COACHMAN DRIVE, SAN


MARCOS, TEXAS, 78666

Kutsher Holdings is proposing an OSSF to serve a new veterinarian clinic at 131 Coachman Drive. This design
will accommodate up to 60 animals and 8 employees. This property is Lot 1B of the Resubdivision of Lot 1 of
the Coachman Subdivision. The building will be served by a public water supply. The system designer, Andy
Grubbs, R.S., has designed a treatment system, which consists of a pretreatment tank, a flow equalization tank,
an aerobic treatment unit, and a pump tank. After treatment, the effluent will be dispersed to a drip irrigation
field. The system is designed for a daily usage rate of 600 gallons. A motion was made by Commissioner
Whisenant, seconded by Commissioner Ingalsbe to authorize Commercial OSSF Permit at 131
Coachman Drive, San Marcos, Texas, 78666. All voting Aye. MOTION PASSED

AUTHORIZE COMMERCIAL OSSF PERMIT AT 211 DARDEN HILL, DRIFTWOOD,


TEXAS, 78619

RMRB Properties is proposing an OSSF to serve two office/warehouse buildings. This design will accommodate
up to 12 employees and 8 visitors daily. This property is a 10.02 acre tract of land and will be served by a
private well. The system designer, Hugo Elizondo, P.E., has designed a treatment system, which consists of a
pump tank, a flow equalization tank, and an aerobic treatment unit. After treatment, the effluent will be dispersed
to a drip irrigation field. The system is designed for a daily usage rate of 280 gallons. A motion was made by
Commissioner Whisenant, seconded by Commissioner Ingalsbe to authorize Commercial OSSF Permit
at 211 Darden Hill, Driftwood, Texas, 78619. All voting Aye. MOTION PASSED

APPROVE BID AWARD FOR IFB TO TOTAL DEMOLITION/A-1 DEMOLITION,


AUTHORIZE THE DEVELOPMENT AND COMMUNITY SERVICES DIRECTOR AND
OFFICE OF GENERAL COUNSEL TO NEGOTIATE A CONTRACT AND AUTHORIZE
THE COUNTY JUDGE TO EXECUTE THE CONTRACT AND AMEND THE BUDGET
ACCORDINGLY

Work will be performed at County owned properties located off of Civic Center loop and Clovis Barker in
Precinct 1. A motion was made by Commissioner Ingalsbe, seconded by Commissioner Whisenant to
approve bid award for IFB to Total Demolition/A-1 Demolition, authorize the Development and
Community Services Director and Office of General Counsel to negotiate a contract and authorize the
County Judge to execute the contract and amend the budget accordingly. All voting Aye. MOTION

AUTHORIZE THE COUNTY JUDGE TO SIGN A GRANT ADJUSTMENT NOTICE


(GAN) FROM THE TEXAS DEPARTMENT OF PUBLIC SAFETY, 2014 HOMELAND
SECURITY GRANT PROGRAM (HSGP) TO ADJUST THE BUDGET AND CLOSE OUT
THE GRANT

The grant adjustment notice is to reduce the final grant amount from $23,396.78 to $23,316.63 and to close the
project effective May 31, 2016. All necessary items have been purchased. The grant funds support the Hays
County Community Emergency Response Teams (CERT) as well as regional CERT needs. A motion was
made by Commissioner Jones, seconded by Commissioner Whisenant to authorize the County Judge to
sign a Grant Adjustment Notice (GAN) from the Texas Department of Public Safety, 2014 Homeland
Security Grant Program (HSGP) to adjust the budget and close out the grant. All voting Aye. MOTION
PASSED

ACCEPT BOND NO.76122809 FOR STREET AND DRAINAGE IMPROVEMENTS


FOR BELTERRA SUBDIVISION SECTION 15 IN THE AMOUNT OF $529,175.62

The final plat for the Belterra Subdivision Section 15 has been reviewed under the Interlocal Cooperation
Agreement with the City of Dripping Springs and has been approved by County staff. While the plat has been
approved administratively, formal acceptance of fiscal surety is required by Commissioners Court action. A
motion was made by Commissioner Whisenant, seconded by Commissioner Jones to accept Bond
No.76122809 for street and drainage improvements for Belterra Subdivision Section 15 in the amount of
$529,175.62. All voting Aye. MOTION PASSED

NAME A PRIVATE ROAD LOCATED AT 1240 ELDER HILL ROAD AS BRONCO


LANE

A motion was made by Commissioner Whisenant, seconded by Commissioner Ingalsbe to name a


private road located at 1240 Elder Hill Road as Bronco Lane. All voting Aye. MOTION PASSED
HOLD A PUBLIC HEARING RELATED TO THE IMPROVEMENTS OF ROADWAYS WITHIN THE
RIVER MOUNTAIN RANCH SUBDIVISION (SECTIONS 1-7) AND THE HERMOSA PALOMA
SUBDIVISION, WHICH HAS BEEN INCORPORATED INTO THE RIVER MOUNTAIN RANCH
SUBDIVISION, IN PRECINCTS 3 AND 4 OF HAYS COUNTY, PURSUANT TO CHAPTER 253 OF
THE TEXAS TRANSPORTATION CODE
Judge Cobb opened public hearing. Input was received from: James McNeal Kellar, William M. Brown, Estelle
Murchison, Patricia Krov, Kirby Hicks, Bart Behrhorst, and Marvin Bottera. Judge Cobb closed public hearing.
The HOA of River Mountain Ranch appointed a roads committee that has been working on the Chapter 253
proposal for some time. The subdivision(s) propose improvement and adoption of all or a portion of
approximately 11 roads within the subdivision(s). The attached map reflects the affected area, under the
proposal. The Director of Transportation will be providing an updated estimate of cost for the improvements
needed to bring the roadways up to County road standards. This will be brought back at a later date.
Clerks Note Court took a break at 10:59 a.m. and reconvened into open session at 11:13 a.m.

CLARIFY AND ADOPT A PROCEDURE FOR ESTABLISHING A LIST OF APPROVED


FIRMS TO PERFORM PROFESSIONAL SERVICES FOR HAYS COUNTY, ON A PER
PROJECT BASIS

A motion was made by Commissioner Ingalsbe, seconded by Commissioner Conley to adopt a


procedure for establishing a list of approved firms to perform Professional Services for Hays County, on
a per project basis. All voting Aye. MOTION PASSED

AUTHORIZE THE COUNTY JUDGE TO EXECUTE A RESOLUTION AND SUBMIT A


GRANT APPLICATION TO THE TEXAS WATER DEVELOPMENT BOARD FOR
FUNDING TO SUPPORT THE FLOOD MONITORING SYSTEM PROJECT

Hays County Commissioners Court recently approved a contract with Halff and Associates to draft the grant
application to the Texas Water Development Board for Low Water Crossing Sensors and the infrastructure to
support the system. This system will allow emergency services personnel to monitor weather events more
closely through low water crossing sensors and detention basin gauges, provide data to the National Weather
Service to provide more timely and accurate predictions, and overall improve the safety of the citizens and
visitors of Hays County. This resolution demonstrates the support that Hays County Commissioners Court have
for the implementation of this project. This will be a 50/50 matching grant. A motion was made by
Commissioner Conley, seconded by Commissioner Ingalsbe to authorize the County Judge to execute a
Resolution and submit a grant application to the Texas Water Development Board for funding to support
the Flood Monitoring System Project. All voting Aye. MOTION PASSED

Garza from GSMP (Economic Development), and Diana Blank from the City of Kyle. No action taken.

A motion was made by Commissioner Ingalsbe, seconded by Commissioner Jones to authorize the
County Judge to execute an agreement between Hays County and Turner Construction Company, as
modified by General Counsel and approved by Chief of Staff and Commissioner for Precinct 1. All voting

DISCUSSION OF ISSUES RELATED TO THE HAYS COUNTY JAIL, AND THE PLANNING OF
PROJECTS PERTAINING TO THE PUBLIC SAFETY FACILITIES NEEDS WITHIN THE COUNTY
Judge Cobb gave the Hays County Jail report. Hays Countys current maximum jail capacity is 362 inmates. Jail
Standards recommends holding approximately 10% of capacity open. That lowers our capacity to 311.The jails
daily average was 260 and peak was 270 on June 2nd for the week of May 29 to June 4, 2016.The maximum
female capacity is 76 inmates. Last weeks average was 59 and peak was 68 on 6/4/2016.The maximum male
capacity is 256 inmates. Last weeks average was 201 and peak was 213 on 6/2/2016. Inmate at Guadalupe
County: 117; Inmate at Bastrop County: 0; Inmate at Caldwell County: 29; Inmate at Walker County: 0

Training in Hoover, Alabama on July 17-August 19, 2016. This course is a five week course designed to train Law
Enforcement officers how to process a computer crime scene in a home or business environment. Detective Opiela
will receive hands on training with computer hardware and forensic analysis tools and will also become familiar with
techniques for search and seizures, evidence processing and handling and media imaging. Having Detective Opiela
attend this training will also provide the Sheriff's Office with an additional person to investigate these types of crimes
that occur in Hays County. All fees (registration, hotel and per diem) with the exception of fuel will be funded by the
US Secret Service.

Install 6 interior IP camera domes in office area. Install 9 Exterior IP Vandal Resistant wall mounted
cameras on the outside of the building to cover the Employee entrances and Visitor entrance. Back
parking lot and front parking lot will have cameras as well.
All cameras will be connected to a Network Video Recorder. The NVR will provide storage for 30 days of
video storage. Multiple viewing stations can be connected to the NVR for remote viewing of the cameras.
The NVR will record all camera video. Live video will be viewed from the video review station. Recorded
video can be viewed and exported from the Video Review Station.
Camera cabling will be run free air concealed where ever possible above the ceiling or building
supports.

Replace 3 existing exterior door panic bar locks and replace with electric release panic bar locks. Install 4
new Card Readers on exterior and hall entrance doors. Provide wire mold to encase the control wire
running down for the new exterior electric panic bar locks and card readers. Electric panic bar locks will
provide free egress from the building.
Install new maglock at the front entrance. Install lock release button at front door and at the Reception
Desk. Provide new card reader at the front entrance door on the hallway side.
Provide Intercom station at the entrance door on the hallway side. Install intercom master stations at the
reception desk and office.
Cut in new window frame in Exterior Employee entrance door. Viewable glass area will be 7 inches wide
by 31 inches tall. Glass will be wire mesh type.
Card Access Software will match the software used at the County Government Center. Cards used at
Government Center can be programmed into the system at the Transportation Center. Card Access
Software will be installed on the same computer used to View the camera NVR system.

Exclusions and Clarifications


Installation Requirements:
Argyle will provide the necessary installation, termination and programming for the new cameras and door
modifications
Conduit and Cable:
Conduit installation is excluded from this quotation.
Warranty:
Argyle offers a standard one (1 year) (365 days) warranty on all labor and material included in this project.
Components noted to have more than one year of warranty will be warranted by the manufacturer with a [3] year
warranty. All system components provided in this proposal are warranted against all defects in material and
workmanship. Any existing wire, components, devices or conditions will not be covered in the agreement.
Sales Tax:
Sales Tax is not included in this proposal, if the facility is Tax Exempt please forward exemption letter for our records.
Training:
Argyle will provide training to the facility for Administration, Operator and Maintenance

On May 10, 2016 the court authorized the OES department to execute a bailment agreement with the Wimberley
Fire & ESD #4 and to research options for a High Profile Vehicle to be maintained by the Wimberley Fire & ESD #4
and used throughout the County for emergency situations. The OES Director has researched options and found a
5 Ton 6x6 Military Cargo Truck through the Federal Surplus Program. Funds were encumbered and the purchase
order sent to the Texas Facilities Commission on 6/14 in order to hold the vehicle until court approval could be
obtained. This equipment will be beneficial during search and rescue/recovery as well as natural disasters such as
fire/flooding events.

replacement dishwasher (upgraded) and Kitchen Drain Line repairs, leaving an available balance of $4,469 for this
repair. Salary savings within the Jail Operating budget will fund the difference needed.

Scope:

Replace the Cast Iron Tee in the Wall for the Lavatory Drain

TDI proposes to replace the cast iron tee in the wall for the lavatory drain.
TDI also proposes to jack hammer up the floor and repair the drain for the toilet from the cast iron 90
upwards.
This is in the restroom behind the reception area. TDI will reset the fixtures after the repairs to the walls
and floor are made.
The concrete slab is to be poured back by us. TDI will not repair any walls or repaint the floor, or any
other repairs. TDI will not repair floors outside the restroom.
TDI will use the existing toilet, flush valve, and lavatory.
TDI will do our best to keep the dust to a minimum, but do to where we are working it's going to be very
difficult.

NOTE: Work will be performed during normal hours.

Electrical temperature control, interlock, disconnect and power wiring.
Motor starters for mechanical equipment and air handling units.

TDIndustries, Inc. warrants its workmanship for sewer & drain cleaning for a period of 24 hours from the date of completion. Any foreign
material retrieved from sewer or drain will discharge warranty and incur additional costs for clearing stoppage.

Standard Terms and Conditions


THIS PROPOSAL IS EXPRESSLY CONDITIONED UPON THE TERMS AND CONDITIONS CONTAINED OR REFERRED TO HEREIN, INCLUDING
THOSE CONTAINED IN ANY ATTACHMENTS HERETO.

TDIndustries, Inc. liability on any claim for loss or


damage arising out of this contract or from the
performance or breach thereof or connected with the
supplying of any labor, equipment, goods or material
hereunder, or their sale, resale, operation or use,
whether based on contract, warranty, tort (including
negligence) or other grounds, shall not exceed the price
allowable to such labor, equipment, goods or material, or
part thereof involved in the claim. TDIndustries, Inc.
shall not, under any circumstances, be liable for any
labor charges without the prior written consent of
TDIndustries, Inc. TDIndustries, Inc. shall not, in any
event, be liable, whether as a result of breach of
contract, warranty, tort (including negligence), or other
grounds, for special, consequential, incidental or penal
damages, including, but not limited to, loss of profits,
revenues, loss of the product or any associated product,
cost of capital, cost of substitute products, facilities or
services, downtime costs or claims of the Customer for
such damages. If TDIndustries, Inc. furnishes Customer
with advice or other assistance which concerns any
labor, equipment, goods, or material furnished
hereunder, or any system or equipment in which of such
equipment, goods or material may be installed, and
which is not pursuant to this contract, the furnishing of
such advice or assistance will not subject TDIndustries,
Inc. to any liability, whether based on contract,
warranty, tort (including negligence) or other grounds.
If TDIndustries, Inc. encounters asbestos, polychlorinated
biphenyl (PCB) or other hazardous substances on the site,
TDIndustries Inc. will stop work and report the condition to the
owner or owners representative. TDIndustries, Inc. will not
resume work in the affected area until the asbestos, PCBs or
other hazardous substances has been removed or otherwise
controlled so that it does not pose a health or safety threat.
Any installation dates given in advance are estimated.
Installation will be made subject to prior orders with
TDIndustries, Inc.. TDIndustries, Inc. shall not be liable for
failure to perform or delay in performance hereunder resulting
from fire, labor difficulties, delays in usual sources of supply,
major changes in economic conditions, or, without limitation by
the foregoing, any cause beyond TDIndustries, Inc. reasonable
control.

On arrival of any equipment, goods or material at the shipping


address specified on the reverse side hereof, Customer shall
assume all risk of loss or damage to such equipment, goods or
material.

5.

In the event Customer requires TDIndustries, Inc. to delay


shipment or completion of the work under this proposal, payment
pursuant to this proposal shall not be withheld or delayed on
such account. TDIndustries, Inc. shall have the right to deliver
any portion of the equipment, goods or material to be furnished
hereunder and to bill Customer therefore, and Customer agrees
to pay for the same in accordance with terms of the payment
hereof upon notification that such shipment is ready for delivery,
notwithstanding the fact that Customer may be unable to receive
or provide suitable storage space for any such partial delivery. In
such event, such portion of the equipment, TDIndustries, Inc.
may store goods or material ready for shipment at Customers
risk and expense.

The amount of any past, present or future occupation, sales, use,


service, excise or other similar tax which TDIndustries, Inc. shall
be liable for, either on its own behalf or on behalf of Customer, or
otherwise, with respect to any equipment, goods, material or
service covered by this proposal, shall be in addition to the prices
set forth herein and shall be paid by Customer.

If the equipment, goods or material furnished hereunder requires


the use of water or steam, recirculated or otherwise,
TDIndustries, Inc. shall not be liable for the effect of its physical
or chemical properties upon said equipment, goods or material.

8.

All skilled or common labor which may be furnished by the


Customer shall be considered and treated as Customers own
employees, and Customer agrees to fully protect and indemnify
TDIndustries, Inc. against all claims for accidents or injuries to
such employees in the course of the work, or to any person or
persons through the negligence of such employees.

9.

No oral representations are binding upon TDIndustries, Inc.


unless reduced to writing and signed by an authorized
representative of TDIndustries, Inc. All changes to this contract
must be in writing.

PROFESSIONAL SERVICES AGREEMENT

HAYS COUNTY, a political subdivision of the State of Texas
(hereinafter the County) with administrative offices at 111 E.
San Antonio, Suite 300, San Marcos, Texas 78666, and Dannenbaum
Engineering Comp[any Austin, LLC hereinafter Contractor),
whose primary place of business is located at 3409 Executive
Center Drive, Suite 129, Austin, Texas, 78731 , hereby enter

agree as follows:
1. OVERVIEW

2. SERVICES
Contractor agrees to perform services for the County in
accordance with the Countys instructions and, in particular,
the instructions of County Engineer and/or legal counsel for the
Hays County Commissioners Court; and in conformance with the
descriptions, definitions, terms, and conditions of this
Agreement.
The Scope of Services shall be limited to those
services and terms attached hereto as Exhibit A, and any
subsections of Exhibit A, if as and when they are attached
hereto and signed by the parties (collectively the Work). If
the parties to this Agreement amend the Work required under this
Agreement (by adding or removing specific services and/or terms
enumerated in Exhibits A and/or C), the Compensation cited
in Section 5 of this Agreement may also be amended to conform
with the change in Scope of Services, as agreed by the parties.
3. ADDITIONAL TERMS
Additional Terms and Obligations of the parties to this
Agreement, if any, are stated in Exhibit C, attached hereto.
4. DURATION
The parties agree that the Work shall be completed three hundred
sixty five (365) days after commencement date. (hereinafter the
Completion Date).
In the event that Contractor is unable to
complete the Work by the Completion Date, Contractor shall
request an extension of the Completion Date in writing no later
than fifteen (15) business days prior to the Completion Date.
The County may grant extensions of the Completion Date for all

basis, the terms of which are cited in Contractors rate
schedule, which is attached hereto as Exhibit B. Despite any
reference to Contractors rate schedule, which shall be used to
calculate monthly invoice amounts under this Agreement or a
change in the Scope of Services (i.e. Amendment), the parties
agree that the County shall pay Contractor a total fee not to
exceed five hundred forty seven thousand, three hundred fifty
three and 68/100 dollars ($547,353.68 USD) for the Work under
this Agreement.
6. PAYMENT
Contractor shall invoice the County for the Work performed under
this Agreement on a monthly basis, beginning at the end of the
first full month following the Effective Date.
The County
agrees to promptly pay all invoices by sending payment to
Contractors address stated in Section 8, below.
The County
shall owe Contractor an additional one percent (1%) per month on
any unpaid balance, beginning at the end of the first full month
following the Countys receipt of said invoice(s) and accruing
monthly thereafter.
7. NOTICE OF COMPLETION
Upon completion of the Work, Contractor shall send a Notice of
Completion to the County in writing, and the County shall have
the option to inspect the Work (or the product thereof) before
it is considered complete under this Agreement.
If the County
is satisfied that the Work under this Agreement is complete, the
County shall send Contractor an Acceptance of Completion in
writing.
If, after inspection, the County does not agree that
the Work is complete or believes that the Work is of deficient
quality, the County shall send Contractor a Deficiency Letter,
stating the specific aspects of the Work that are incomplete
and/or deficient.
If, after ten (10) business days from the
Countys receipt of Contractors Notice of Completion, the
County does not send Contractor either an Acceptance of
Completion or a Deficiency Letter, the Work under this Agreement
shall be considered complete.
8. NOTICE (GENERAL)

Notices from one party to another under this Section may be made

9. INSURANCE
Contractor agrees that, during the performance of all terms and
conditions of this Agreement, from the Effective Date until the
Countys acceptance of Contractors Notice of Completion or
until this Agreement is otherwise considered completed as a
matter of law, Contractor shall maintain Commercial General
Liability insurance that meets or exceeds the industry standard
for professional services providers in Contractors field of
employment and for the type of services that are being performed
by Contractor under this Agreement.
10. MUTUAL INDEMNITY
Contractor agrees, to the fullest extent permitted by law, to
indemnify and hold harmless the County, its officers, directors
and employees against all damages, liabilities or costs,
including reasonable attorneys' fees and defense costs, to the
extent caused by Contractors negligent performance of the Work
under this Agreement and that of its subcontractors or anyone
for whom the Consultant is responsible or legally liable.
The County agrees, to the fullest extent permitted by law, to
indemnify and hold harmless Contractor, its officers, directors,
employees and subcontractors against all damages, liabilities or
costs, including reasonable attorneys' fees and defense costs,
to the extent caused by the County's negligent acts in
connection with this Agreement.
Neither the County nor Contractor shall be obligated to
indemnify the other party in any manner whatsoever for the other
party's negligence.
11. COMPLIANCE WITH LAWS
Each party agrees to comply with all laws, regulations, rules,
and ordinances applicable to this Agreement and/or applicable to
the parties performing the terms and conditions of this
Agreement.
12. SURVIVAL
Notwithstanding any termination of this Agreement, the following

Sections, and the terms and conditions contained therein, shall


remain in effect: 3, 5, 8, 10, 12, 14, 15, 16, 17, 18, 20, 21
and 22.
13. FORCE MAJEURE
Either of the parties to this Agreement shall be excused from
any delays and/or failures in the performance of the terms and
conditions of this agreement, to the extent that such delays
and/or failures result from causes beyond the delaying/failing
partys reasonable control, including but not limited to Acts of
God, Forces of Nature, Civil Riot or Unrest, and Governmental
Action that was unforeseeable by all parties at the time of the
execution of this Agreement. Any delaying/failing party shall,
with all reasonable diligence, attempt to remedy the cause of
delay and/or failure and shall recommence all remaining duties
under this Agreement within a reasonable time of such remedy.
14. SEVERABILITY
If any Section or provision of this Agreement is held to be
invalid or void, the other Sections and provisions of this
Agreement shall remain in full force and effect to the greatest
extent as is possible, and all remaining Sections or provisions
of this Agreement shall be construed so that they are as
consistent with the parties intents as possible.
15. MULTIPLE COUNTERPARTS
This Agreement may be executed in several counterparts, all of
which taken together shall constitute one single Agreement
between the parties.
16. SECTION HEADINGS, EXHIBITS
The Section and Subsection headings of this Agreement, as well
as Section 1, Entitled Overview, shall not enter in the
interpretation of the terms and conditions contained herein, as
those portions of the Agreement are included merely for
organization and ease of review.
The Exhibit(s) that may be
referred to herein and may be attached hereto, are incorporated
herein to the same extent as if fully set forth herein.
17. WAIVER BY PARTY
Unless otherwise provided in writing by the waiving party, a
waiver by either of the parties to this Agreement of any
covenant, term, condition, agreement, right, or duty that arises
under this Agreement shall be considered a one-time waiver and
shall not be construed to be a waiver of any succeeding breach
thereof or any other covenant, term, condition, agreement,
right, or duty that arises under this Agreement.

18. GOVERNING LAW AND VENUE


THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE
WITH THE LAWS OF THE STATE OF TEXAS.
Any lawsuit, claim, or
action, whether in law or in equity, arising from this Agreement
will be brought in Hays County, Texas.
19. ASSIGNMENT
Neither party to this Agreement may assign it duties, interests,
rights, benefits and/or obligations under this Agreement, in
whole or in part, without the other partys prior written
consent thereto.
20. BINDING EFFECT
Subject to any provisions hereof restricting assignment, this
Agreement shall be binding upon and shall inure to the benefit
of the parties hereto, and their respective successors,
permitted assigns, heirs, executors, and/or administrators.
21. ENTIRE AGREEMENT; AMENDMENT
This Agreement (including any and all Exhibits attached hereto)
constitutes the entire agreement between the parties hereto with
respect to the subject matter hereof.
Any amendments to this
Agreement must be made in writing and signed by the parties to
this Agreement prior to the performance of any terms or
conditions contained in said amendments.
22. WORK PRODUCT
Any and all product, whether in the form of calculations,
letters, findings, opinions, or the like, shall be the property
of Hays County during and after performance of the Work.
Contractor shall have a right to retain a copy of all Work
product for record-keeping purposes.
23. TERMINATION BY COUNTY
This Agreement may be terminated by Hays County, for any reason
whatsoever, by providing thirty (30) days written notice to
Contractor. Any approved services provided under this Agreement
up to the date of termination may be invoiced by Contractor
after the termination date, and payment of said invoice shall
not be unreasonably withheld by the County.

PROJECT STATEMENT
Hays County (County) has requested that Dannenbaum Engineering CompanyAustin, LLC
(Engineer) to provide Engineering Services pertaining to the Posey Road Corridor Study. Said
services will include a Design Schematic for Phase 1 and a Conceptual Schematic for Phase 2.
The limits of the schematics are Phase 1: Hunter Road to CR 266, approximately 1.93 miles in
length and Phase 2: CR 266 to SH 123, approximately 2.41 miles in length. The following is a
more detailed description of the specific scope.
PROJECT DESCRIPTION
This project will be divided into two project Phase limits:
Phase 1 will include an analysis of the roadway between Hunter Road and CR 266. Said services
will include Design Schematics for the Interim and Ultimate Projects. The interim project will
include a 3-lane, continuous left turn, rural roadway section with right turn lanes where
appropriate. Efforts will be taken to minimize the right-of-way (ROW) necessary for the interim
improvements. ROW for the ultimate will also be minimized as possible and any takings will be
configured to minimize the impact to the properties. The drainage will be analyzed with the
intention of improving any necessary cross drainage and driveway culverts and determining if the
ditches have excess capacity or are undersized. Intersections will be improved as necessary
including radius returns. Aerial Mapping and topography will be provided. The County shall
provide Right-of-Entry for the properties.
Geotechnical borings will be provided and a pavement design will be prepared based on the Traffic
Analysis.
The Ultimate Project will be based upon the results of the Traffic Analysis to be performed by the
Engineer. It is anticipated at this time that the Ultimate configuration will consist of a 4-lane
divided urban roadway section. Alternates and cost comparisons will be prepared for the Ultimate
and Interim projects.
Phase 2 will include a preliminary analysis of the roadway between CR 266 and SH 123, including
a new location roadway between CR 266 and Center Point Road. The alignment will then follow
Beback Inn Road to SH 123. Said services will include a Conceptual Schematic for the Interim
and Ultimate Projects. The interim project will include a 3-lane, continuous left turn, rural

roadway section with right turn lanes where appropriate. Efforts will be taken to minimize the

analyzed with the intention of improving any necessary cross drainage and driveway culverts and
determining if the ditches have excess capacity or are undersized. Aerial Photography will be
provided, however, the Lidar data will not be processed under this scope and existing CAPCOG
Lidar Data will be utilized. Topography, ROW Mapping and field notes will also not be provided.
The Engineer Will Not analyze the FEMA floodplain crossing east of CR 266. The structure
requirements will be based on the FEMA floodplain map and will be subject to change once a
study is performed.
Geotechnical borings and pavement design will not be provided for Phase 2. The cost estimate
will be based on the pavement design prepared for Phase 1.
A Traffic Analysis will not be performed for Phase 2. It is anticipated at this time that the Ultimate
configuration will consist of a 4-lane divided rural roadway section. Preliminary cost estimates
based on the conceptual schematic will be prepared for the Ultimate and Interim projects.
PROPOSED FACILITY
The project will be designed according to the 2014 TxDOT Standard Specifications and Hays
County guidelines.
I.

PROJECT MANAGEMENT
A.

Coordination with Hays County, City of San Marcos, TxDOT, Police Department,
Fire Department and Emergency Management Services and sub-consultants.
Coordination will include correspondence, telephone conversations, faxes, and
emails.

B.

Four (4) coordination meetings estimated at three (3) hours per meeting

C.

Coordination of Right of Entrys. Right of Entry services are detailed in the attached
proposed scope of services by Survey and Mapping, Inc.

D.

No coordination with UPRR for the at-grade crossing in Phase 1.

E.

Arrange, prepare for and attend no more than two (2) open house/public meetings.
This task will include preparation of public involvement exhibits, handouts and
presentations, public meeting summaries and hearing summary and analysis. See
attached proposed scope of services by Concept Development & Planning, LLC.

F.

Utility Coordination: Engineer shall not be responsible for the utility coordination
tasks under this scope other than any above ground, visible utilities that may be
identified by the survey in Phase 1.
Utilities shall be shown on the schematic as close as possible based on the record
drawings, provided the Engineer receives the record drawings from the utility
companies.

SERVICES TO BE PROVIDED BY THE SUBCONSULTANT TO


THE ENGINEER
Cox|McLain Environmental Consulting, Inc. (hereafter CMEC), sub-consultant to Dannenbaum Engineering
Company Austin, LLC (hereafter the Engineer), will provide environmental consulting services pertaining to
the Posey Road Corridor Study in Hays County, Texas. CMEC understands the project would be designed and
constructed along Posey Road from Hunter Road to County Road (CR) 266 (approximately 1.93 miles in
length) and would consist of an Interim design and an Ultimate design. It is anticipated at this time that the
Interim design will include a 3-lane, continuous left turn, rural roadway section with right turn lanes where
appropriate, and that the Ultimate design will consist of a 6-lane divided urban roadway section. CMEC
understands that the Interim design will require minimal right-of-way acquisitions, primarily in the areas of
substantial intersections. CMEC also understands that the Ultimate design would require additional right-ofway, which may not be acquired at this time. The assessment of impacts will be confined to the footprint of
the Interim design. Environmental constraints for the ultimate footprint will also be presented.
This scope of services assumes no federal funding and no other NEPA compliance triggers. This Scope of
Services provides for the preparation of an Environmental Technical Memorandum and an Archeological
Survey Report, for the Interim design. Field investigations will be limited to the footprint of the Interim
design. Should new right-of-way be required, CMEC understands that all right-of-entry will be obtained by
the Engineer. No field investigations are proposed for the footprint of the Ultimate design. Environmental
constraints for this portion will be gathered from remote sources. Environmental constraints for the Ultimate
design will be discussed in the Environmental Technical Memorandum along with the potential impacts
associated with the Interim design. The Environmental Technical Memorandum is intended to document
requirements for compliance with environmental regulations that are applicable to local and state funded
projects. The Archeological Survey and Survey Report for the Interim design will comply with the Antiquities
Code of Texas.
Environmental resources to be analyzed are described below.

A.

Environmental Documentation Technical Memorandum and Other


Studies
1.

Investigate Relevant Resource Categories All relevant resource categories must be


investigated and documented in accordance with appropriate regulations and with the latest
guidance from Hays County. Major topics are discussed in more detail below. Baseline data will
be collected for the Ultimate design of both phases. Field investigations and impact assessments
will be limited to the footprint of the Interim design.
a.

Cultural Resources

CMEC staff will conduct cultural resource investigations (both archeological and historic) that
will include archival research and field surveys (as appropriate) with findings to be coordinated
per the Antiquities Code of Texas and reported in the various memoranda. Archival searches
shall include the Texas Historical Commissions (THC) Sites Atlas and other data sources to
identify previously documented archeological sites, cemeteries, historical markers, properties
and districts listed on the National Register of Historic Places (NRHP), and State Antiquities
Landmarks (SALs).
If necessary, results of the search will be integrated with soil information, topographic maps,
aerial photographs, and other pertinent data in an application for a Texas Antiquities Permit on
behalf of Hays County for investigations related to the Interim design. Once a valid permit
number is obtained, field investigations will be conducted at the Phase 1 intensive-survey level
(Category 6 under 13 TAC 26.15), consisting of pedestrian examination supplemented by shovel
testing as needed based on ground surface visibility, soil depth, drainage, topography, existing
disturbance, safety concerns, and other field observations/constraints. Field methods will
comply with the requirements of 13 TAC 26, as elaborated by the THC and the Council of Texas
Archeologists (CTA). This investigation will evaluate archeological and historic resources for
their potential eligibility for inclusion in the NRHP per Section 106 (36 CFR 800) of the NHPA or
designation as a SAL under the provisions of the Texas Antiquities Code (13 TAC 26.12). A draft
report of all results, including preliminary NRHP/SAL evaluations of any identified archeological
resources and complying with THC and CTA guidelines will be submitted to THC and the County
for review. Once THC concurrence has been received, a final report will be submitted as per the
terms of the approved archeological permit and all materials collected during the investigation
will be permanently curated to the Center for Archaeological Studies (CAS) in San Marcos per
the Antiquities Code.
The current scope would not include NRHP testing, data recovery excavations, or human
remains evaluation/coordination/removal, which could be undertaken under separate scope
and fee if required by THC.

b.

Water Resources

Data shall be collected on surface water streams and other existing water resources as well as
the potential for pollution during construction and from the completed facility. The 100-year
floodplain, as delineated by Federal Emergency Management Agency (FEMA), shall be identified
and the impacts of the proposed project shall be assessed. Impacts associated with construction
over the Transition Zone of the Edwards Aquifer shall be identified. Potential for impacts to
groundwater and the Edwards Aquifer shall be evaluated.

c.

Wetlands and Other Waters of the U.S. - Evaluations of wetlands and waters of the
U.S. shall be performed in all areas potentially affected by the proposed design.
Wetland field delineations shall also be conducted, if determined necessary during
field investigations. Wetland data sheets shall be prepared and included in the
Technical Memo appendix. All necessary rights-of-entry shall be secured by the
Engineer.

ii.

U.S. Army Corps of Engineers (USACE) It is assumed that no wetlands would be


affected and impacts to waters of the U.S. would fall within a Nationwide Permit
#14 without Pre-Construction Notification (PCN). If impacts to any waters of the
U.S. or wetlands were to require a Pre-Construction Notification to USACE or an
Individual Permit, that work would be completed under a supplemental scope and
budget.

Biological Resources

A description of the project area biological resources including vegetation communities and
wildlife habitat shall be developed. Ecologically sensitive resources, including potential
threatened or endangered species habitat and migratory bird habitat, shall be identified and
their potential to be affected by project construction and operation shall be assessed and
described in the environmental report. The County will be notified if species-specific surveys or
agency consultation would be required. No federal- or state-listed species presence/absence
surveys are proposed as a part of this scope. This scope does not include preparation of a
Section 10 consultation with the U.S. Fish and Wildlife Service.
i.

Habitat Analysis and Characterization of Project Study Area - An analysis and


characterization of habitat and habitat impacts for the study area will be conducted
and documented in the Technical Memo.

ii.

Wildlife and Threatened and Endangered Species Assessment An examination of


existing data shall be performed to determine the likelihood that state-listed
species, federally-protected species, their habitat, or designated critical habitat (per
50 CFR 17.94-95) could be impacted by the proposed project. Existing data shall
include the Element Occurrence Identification (EOID) records of the TPWD Natural
Diversity Database, species lists maintained by the U.S. Fish and Wildlife Service,
TPWD, and species protected by the Migratory Bird Treaty Act (MBTA) and the Bald

and Golden Eagle Protection Act. A determination of impact or effect for all species
shall be included in the Technical Memo.
d.

Hazardous Materials Initial Site Assessment

A database search of previously recorded hazardous material sites in the project area shall be
conducted and a summary incorporated into the environmental report. During field visits,
project environmental staff shall identify any sites within the additional impact areas that may
pose a potential hazardous materials risk. A full Phase I Environmental Site Assessment is not
included in this scope of services.
e.

Land Use and Socioeconomics

Project planners will map land use in the project area and collect socioeconomic data from the
U.S. Census and the Texas Workforce Commission to determine existing conditions and
potential impacts on the community in the project study area.
2.

Technical Memoranda Preparation/Comment Response Building on constraints data collected, this


task includes the writing and production of one Technical Memorandum, including responding to
comments from Hays County. Detailed mitigation plans are not part of this Scope of Services. This
task includes the submittal of electronic copies of the Technical Memorandum to Hays County.

3.

Public Involvement (support for Dannenbaum) CMEC would provide two staff members to attend
one public meeting. It is assumed that environmental constraints exhibits would be provided (to the
extent that information can be shared with the public). Additional support for public and/or
technical/stakeholder meetings would take place under a supplemental scope and fee estimate.

B.

Assumptions
This scope is services is based on the assumption that no NEPA triggers will be encountered (federal
funding or permitting).
All necessary rights of entry will be secured by the Engineer/County. If access is not available at the time
of fieldwork, a reasonable and good-faith effort will be made to document inaccessible parcels from
accessible parcels and/or public right-of-way.
Assumes one Antiquities Permit (Interim design).
Assumes digital archeological site registration only (discounted fee) and that no paper site form
submittals would be required.
Assumes curation of archeological records only (no artifacts) to CAS at discounted rate (digital versions
will be created)

C.

Exclusions
In addition to the items previously described within this section, the following tasks are not covered in
this scope of work and may or may not be necessary. If deemed necessary, these tasks could be
conducted under a separate or supplemental work authorization.

Preparation of a NEPA document;


Formal Section 10 Endangered Species Act consultation, including preparation of a stand-alone Biological
Assessment or Habitat Conservation Plan;
Presence/absence surveys for endangered species;
Construction phase services, including preparation of Environmental Permits, Issues, and Commitments
(EPIC) sheets;
Freshwater mussel surveys;
Work extending beyond the specified limits of the project at the time of this work order;
Any Section 404 permit preparation or agency correspondence;
Reconnaissance or intensive historic structures surveys or assessments of eligibility, or management
recommendations for any historic structures;
Archeological site testing, data recovery, or human burial evaluation/coordination/removal (services
beyond a survey-level investigation);

SURVEY SCOPE OF SERVICES AND FEE


PROJECT LIMITS
Phase 1: Hunter Road to CR 266, approximately 1.93 miles in length and Phase 2: CR 266 to SH 123,
approximately 2.41 miles in length, in Hays County, Texas, as shown on Exhibit A. The project limits
will be located within, and limited to the area within the right-of-way lines of Posey Road.
PROJECT CONTROL
SAM shall use the existing survey control points as previously established for the IH 35 corridor Aerial
Mapping performed for TxDOT through HNTB. All horizontal values will be referenced to the NAD83
(2011), Epoch 2002.00, Texas State Plane Coordinate (TXSPC) Central Zone. All horizontal values will
be represented in US Survey Feet (USFT) and will be scaled to surface utilizing the Surface Adjustment
Factor (SAF) for Travis County of 1.00011. The vertical values for this project will be based on the
North American Vertical Datum of 1988 (NAVD88) utilizing Geoid 2012A. The vertical values will be
represented in USFT.
RIGHT-OF-ENTRY
Should access to a privately owned property be required, SAM will prepare a Right-Of-Entry letter for
the property owner (per the local Appraisal District Records) and provide a copy of it to Dannenbaum for
mailing & execution. SAM will be provided a copy of each signed/authorized ROE letter and use it to
contact affected land owners prior to commencing any work on private property. The survey crew will
also have a copy with them to confirm their authorization to be on the property. SAM anticipates that
Dannenbaum Engineering will handle problems regarding any and all refusal to grant ROE or
communication with land owners who are hostile with respect to the completion of this scope of services.
SAM will document any interactions with land owners while performing the work.
BOUNDARY DELINEATION
ASSUMPTIONS
PHASE 1
The following assumptions were made for the preparation of this Scope of Services. If these assumptions do not
prove correct, a modification to the scope and budget for this project may be required.

SAM will perform sufficient records research to define the boundaries of the parcels within Phase 1
SAM will only locate sufficient property corners to be able to place the deed parcels to show their
approximate positioning.

This work shall not include boundary surveying sufficient for land transfer of title for land acquisitions or
transfer.
PHASE 2
No boundary or supplemental survey services will be performed for PHASE 2.

LIDAR SCOPE OF SERVICES


UNDERSTANDING
It is Surveying And Mapping, LLC (SAM) understanding that Dannenbaum Engineering is requesting low
altitude LiDAR and imagery acquisition, for Phase 1: Hunter Road to CR 266, approximately 1.93 miles in length
and Phase 2: CR 266 to SH 123, approximately 2.41 miles in length, in Hays County, Texas. All work performed
herein shall conform to the American Society of Photogrammetry and Remote Sensing (ASPRS) for 1 = 50
scale, 1 foot contour intervals.
ASSUMPTIONS
Based on the information provided to SAM, we understand that the following services are being requested:

SAM will perform Aerial Acquisition for Phase 1 and Phase 2, as shown in Exhibit A.
SAM will perform schematic extraction for Phase 1, as depicted in Exhibit A.
Extraction for Phase II will not be a part of this scope.
The Mapping corridor for Phase I will be edge of pavement to edge of pavement. The limits are shown
graphically in Exhibit A (red).
1=50 scale digital imagery data collected will be converted into three (3) inch ground sample distance
(GSD) orthoimagery.
1 foot accurate DTM will be produced utilizing imagery and LiDAR data collected for Phase 1 and
provided as a deliverable in DGN file format.
LiDAR and imagery acquisition for Phase 1 & 2 will be completed in a single mobilization, as each
segment is to be collected in a single continuous effort.
Dannenbaum will coordinate with SAM to confirm required projection, datum, geoid, coordinate
systems, and units of measure required for data deliverables;
This scope of work and cost proposal does not include the data collection by conventional survey of areas
(by others) that are obscured from airborne LiDAR.

GROUND SURVEY
Prior to the flight, SAM will provide the aerial targeting layout required to control the areas for mapping and
ground truthing. The following ground survey support will be provided by SAM:
Prior to the flight SAM will set ten (10), panels consisting of a cross 4 long from the end of each line (2
each direction from the center of the cross) and being 1 wide with a capped iron. Horizontal and vertical
control will be established with a tolerance of +/- 0.03 feet horizontal,
+/- 0.06 feet vertical.
Rod or nail with metal tag at locations specified on Exhibit A.
SAM will obtain at least 20 ground truthing points within project limits to support QA/QC of process
LiDAR data.
SAM will obtain multiple checks along the route to validate the XYZ accuracy of the LiDAR.
SAM will set two (2) Primary Control Points within the project limits and, simultaneous with LiDAR
acquisition, will provide survey field personnel to position and operate two GPS base stations.

LiDAR ACQUISITION
SAM will acquire LiDAR data at not less than 20 points per square meter average density, and will
simultaneously collect color imagery suitable to generate 3-inch pixel GSD resolution orthoimagery for Phase 1.
Equipment
The following equipment will be used for data acquisition.
Aerial Platform - Helicopter
Trimble Harrier 68i aerial mapping system fully integrated with a Trimble 60MP aerial camera.
Base Stations
Aerial acquisition will be controlled with GPS base stations during the acquisition. Base station data is logged at
2 Hz and merged with GPS and IMU data recorded on-board the helicopter (GPS - 10 Hz and multiple receivers)
using post-processed kinematic techniques to produce a highly accurate position for the laser aperture and
cameras.
LiDAR Acquisition - Quality Assurance/Control Process
Captured LiDAR data will be recorded on removable data storage units onboard the aircraft. After acquisition,
the data will be copied to SATA drives and returned to our offices where it will be copied onto our network
drives. The data will then be post-processed and reviewed to confirm complete data acquisition coverage. Any
seams, holes, or other unwanted artifacts can be quickly identified to assess the need for any data acquisition recapture. Once approved, the data will be archived and prepared for production.
Daily acquisition QC procedures will be utilized to ensure data integrity from the mapping systems. These
procedures include using a current satellite ephemeris for tracking the satellite constellation to plan scanning
operations around the time of GPS Position Dilution of Precision (PDOP) spikes, adequate GPS static collection
for receiver initialization and dynamic flying to initialize the IMU. During data acquisition, technicians
constantly monitor the scanning system, checking the data logging rate, data storage capacity, GPS PDOP and
imagery being collected.
LIDAR DATA PROCESSING
Initial Processing GPS/IMU Geo-referencing and Data Calibration
Once the collected data arrives, it is immediately processed and verified. Inertial measurement unit (IMU) data is
processed and checked for gyro bias, systematic errors, and positional error.
Laser Point Processing
The calibration parameters are systematically checked and refined by estimating the residual boresight angles
(roll, pitch, heading) and scanner scale corrections from overlapping strip areas, minimizing the inter-strip
differences using a least squares approach.
The .las data will then be projected into the required coordinate system. Simultaneously, the elevations will be
transformed from ellipsoidal to orthometric heights by applying the latest GEOID models and all data will be
geo-referenced to appropriate State Plane Coordinate System NAD83.

Accuracy Testing
Once the LAS files are created for a line, the data is tested to ensure it meets accuracy standards for the project.
The ground survey information collected will be for use as an independent check of the LiDAR accuracy
(minimum 10 pts. required). SAM recommends not less than 10 well distributed check points throughout the
project. The survey test points should be on hard surfaces that are well defined features. Using the conventional
survey data, a statistical comparison test will be run to verify that the geodetic positioning of the LiDAR data
meets the accuracy standards required for the project. The absolute vertical accuracy of the project is +/-.25 ft.
vertically, and 90% of the points tested shall be within this accuracy.

LIDAR DATA CLASSIFICATION AND FEATURE EXTRACTION


Data Filtering
Once the initial post processing of the laser and imagery data is completed, it is ready for project set up and
initial automated filtering and classification.
Automated Filtering
Once the GPS/IMU data has been processed and the LiDAR data has gone through the boresite (correct for all
roll, pitch, and yaw) the LiDAR data is sent to our LiDAR processing technicians for automated filtering and
classification. Automated filtering of the data is the first process necessary to complete the bare earth ground
processing and prepare the topographic mapping.
Manual Editing
Effective auto filter routines can produce very clean LiDAR classifications. It is, however, always necessary to
complete a manual review and edit of the data. The manual edit process eliminates any remaining anomalies and
misclassifications within the data set.
Feature Extraction and Planimetric Mapping
While automated filtering is a necessary component of each project and produces useful point cloud products,
additional processing is required to produce all deliverables requested for the project. Our process includes
collection of visible planimetric features and roadway striping in the specified collection area in accordance with
the features required by TXDOT. Vector mapping will be produced for each of the planimetric features and will
be delivered as a DGN drawing file for each line.

Quality Assurance/Control Process - LiDAR Data Classification and Feature Extraction


Feature Extraction Quality Control
At the time of classification and feature extraction, our LiDAR technicians will use LiDAR data processing and
feature extraction software to accurately identify, classify and locate specific features. There are multiple
Quality Control steps built into our feature collection process. The methodology proposed for this project is
designed to ensure that QC steps for feature extraction and attribution meet or exceed the requirements set forth
in the RFP. The major QC components of feature extraction process are summarized below.
Use of workflow checklists
Our suite of software is designed specifically to ensure that quality control is part of each step in the process.
One of its key features is the use of well documented and managed workflows called Cues which define and
control each step of a given task. These work flow checklists serve several purposes in the QC process:
Process repeatability and consistency
The software guides each technician through the required processing steps. Each technician uses the exact same
process. The Cues encode flow logic so that steps have to be executed in a specific order. This ensures that
each part of the collection process is repeatable and consistent no matter how many technicians are working on
each phase of the project.
Process tracking
The software automatically records a time-stamped history of who executed each step on each workstation. This
creates a time and date trail for any change recorded to the database during the duration of the project. These
records are reviewed to make sure that each step in the collection process is completed.
Access Control
Cues also control access such that only a person who is a member of a specific processing group can execute a
specific step (for example, if technician X is not a member of the QC group, he cannot execute the QC step).
This also limits use of any data block to one person for any given task. It is not possible for two technicians to
complete tasks at the same time on a given section of data and overwrite each others updates.
In addition to these general quality management design features, there are also specific QC tools built into each
of the processing steps.
IMAGE ACQUISITION
SAM will capture vertical color aerial imagery simultanoeus to the the LiDAR suitable for producing 3- inch
GSD pixel orthophotography.
Aerial Triangulation
During the analytical Aerial Triangulation (AT) process, image coordinates of all tie, control, and check points in
the imagery are measured and a least squares bundle adjustment is performed. This process yields exterior
orientation parameters for all imagery and three-dimensional object coordinates for all measured image points.

Imagery and Control Data Comparison


SAM, LLC will begin the A/T process immediately after receiving the imagery. All ABGPS/IMU data will be
imported into the project, and control points will be measured on every photo on which they occur. We will then
perform and exterior orientation analysis which will compare the given coordinates of the control points with
their locations as projected on the photos by the given exterior orientation.
Measure Control Points Using Auto-Correlation
We will use a digital photogrammetry application that applies image-matching techniques to automate the point
transfer and the point mensuration procedures to automatically extract tie points. To improve the bundleadjustment we will manually measure points as necessary in any weak areas.
Review Residuals of Image Coordinates and Bundle Adjustments
A simultaneous bundle block adjustment will be performed using a least squares solution for all ground control,
ABGPS/IMU, and photogrammetric observations.
ORTHOPHOTOGRAPHY PRODUCTION
The digital orthophotos will have a resolution of 1 pixel = 3 inches. All imagery will be rectified to the processed
bare earth LiDAR data. The major processing tasks related to orthophotography production have been listed
below.
Rectification
The LiDAR data will be used to rectify the orthophotography. A triangulated irregular network (TIN) is created
from the ground data which consists of the ground points and breaklines such as hydro lines and roads collected
during the LiDAR data extraction process. Together these elements help to define the shape of the surface in
three-dimensional space. Rectification to the surface model ensures the image pixels will be correctly located in
the X and Y dimensions of the map space.
Balancing/Mosaicking
Digital orthoimagery is subject to imbalances in tone, hue, and contrast due to a number of factors, including
source imagery. We will not only balance adjoining images but will also use balancing techniques on the project
as a whole. This process will eliminate the "patchwork" appearance caused by changes in conditions and sensor
location/orientation between flight lines and image capture stations. To achieve consistent tone across the
project area and to address the overlap between tiles, we will mosaic the images.
Tiling
When the orthoimagery has passed internal quality check procedures, it will be broken up so that no individual
image is larger than 10 MB. Imagery will be provided in TIF/TFW and/or ECW/EWW formats.

Orthophotography Quality Control

Aerial imagery is thoroughly reviewed by our digital imaging discipline lead for clarity, contrast, shadow
detail, and sun spots.
The DEM is evaluated using various isometric views to check for any "spikes." DEM data are merged
for given block and the elevation data is graphically displayed relative to the project boundary to ensure
that all areas will be correctly rectified.
Ortho technicians validate that the DEM blocks overlap to ensure that there are no data gaps between
blocks of imagery.
Ortho technicians review the location of seam lines and manually modify them to avoid height objects
and to place them in monotone areas (through open field, along road centerlines, etc.)
Ortho Technicians review the block-wide image characteristics and modify a histogram as necessary to
adjust the overall tonal balance. Tonal balancing on a project-wide basis is reviewed to ensure consistent
imagery and to specifically identify any breaks or processing failures.
A final visual inspection of each tile is completed for aesthetics and anomalies. Visible control points are
measured on the final orthoimages and are compared against the values of the survey control coordinates.
An RMSE is calculated for all measured control points and compared against the accuracy standards for
the project.

PROJECT DELIVERABLES
SAM will provide all files via secure ftp site and/or on a portable hard drive. Applicable electronic files shall be
fully compatible with the States MicroStation GeoPak system without further modification or conversion.
Phase I, only:
Digital Orthophotography Image files (both TIF/TFW and ECW/EWW formats)
Analytical aerial triangulation summary report in digital form.
One set of electronic files in MicroStation V8i.

Upon receipt of signed proposal and written notice to proceed, acquisition will be scheduled. After acquisition
has been completed and we have received the survey control data, we anticipate 3 to 4 weeks to provide the final
deliverables.

SUPPLEMENTAL DESIGN SURVEY SCOPE OF SERVICES


ASSUMPTIONS
PHASE 1: (WITHIN THE EXISTING R.O.W. OF POSEY ROAD ONLY)

The following assumptions were made for the preparation of this Scope of Services. If these assumptions do not
prove correct, a modification to the scope and budget for this project may be required.

SAM will obtain elevations where there are obscured areas due to dense tree canopy, or where tall
vegetation / grass existed at the time of the aerial flight that impaired the visibility of the LiDAR.
Obtain sufficient cross sections from the edges of the existing pavement to the existing rights-of-way of
Posey Road, along with grade breaks, to prepare a DTM with 1-foot contour intervals.
Location of all visible utilities, culverts, bridges and other improvements.
Obtain invert elevations of all visible manholes, inlets, culverts and bridges
SAM will obtain elevations within the UPRR right-of-way from the existing northern right-of-way line of
Posey Road to approximately 100 southerly of the existing southern right-of-way line of Posey Road.
SAM will locate all railroad equipment, top of rail, ditches, swales and visible utilities within said area.

SOIL BORINGS

SAM will located a maximum of twenty-five (25) soil borings located within Phase 1 and no more than
two (2) mobilizations.
SUBSURFACE UTILITY ENGINEERING (SUE)

ASSUMPTIONS
The following assumptions were made for the preparation of this Scope of Services. If these assumptions do not
prove correct, a modification to the scope and budget for this project may be required.

SAM will provide only QL-C & QL-D services within the ROW of the Phase 1 project boundary shown
in Exhibit A. Total length (assumed) of ROW is 1.93 miles.
The Client will provide SAM with record information and profile drawings of all the utilities within the
project site the Client has already collected.
SAM will rectify the field observed utilities with those defined by those collected in QL-D.

SCOPE OF SERVICES
SAM will provide all the following Subsurface Utility Engineering (SUE) services to the standard of care
applicable in the Subsurface Utility Engineering (SUE) profession.
Quality Service Level D (QL-D) Collect existing utility records information (as-builts) from utility providers,
municipalities, counties, and other agency suppliers within the area of investigation.

SAM will rely on records provided by the client, Texas One-Call systems, and via vehicle reconnaissance
and inventory of utility marker posts along adjacent roadways. The sole purpose of this activity is to
collect existing record information of utility systems that may have an impact on this project.

Quality Service Level C (QL-C) SAM survey crew will provide this service consisting of field surveying to
obtain accurate horizontal position of visible utility surface features associated with the underground utility
systems located within the project limits.

QL-C & QL-D Services:
A 2D AutoCAD or DGN file depicting the QL-C & QL-D locations for utilities investigated within the project
area will be prepared for this project. The utilities will be referenced by the type of utility, color coded to
American Public Works Association standards, utility company or agency name, address, telephone number and
contact person. scanned utility records collected, and utility contact information will be created for this project.

Paved areas may require coring to perform vacuum excavation services. In such cases SAM will provide a Core Rig and Operator. Core rig
rate includes Operator and materials & equipment to replace and set core (keyhole) following vacuum excavation completion.
Pothole or Test Hole Option:
Potholes are strictly the excavation and exposure of the subject facility with a measurement of depth and notation of facility size, type
and composition painted on the ground and/or provided in a non-certified report. This report will be provided by Vac Crew onsite upon
completion of potholes and typically is handwritten.
Test holes provide the same level of information and are surveyed for a precision x,y & z coordinate and are provided in a test hole report,
signed and sealed by an Engineer. Test Holes require survey and Engineer review. Vac Crew, Survey and Engineer fees will be in
accordance with the above rates.
UNDERSTANDING OF SUE SERVICES:
1.

Normal traffic control, for Quality Service Levels A and B, is considered standard placement of traffic cones, freestanding
warning signage and vehicle-mounted traffic directional sign. Traffic control requiring lane closures, traffic detouring,
flagpersons, police, etc, is considered special traffic control. If special traffic control is to be provided by SAM, LLC, this
service will be subcontracted to an approved subcontractor and billed to the Client at cost plus 10%.

2.

The subsurface utility engineering service assumes that all project survey control required for performing this service is preexisting. Establishing project survey control will be provided at a cost pre-approved by the Client.

3.

It is assumed that no contaminated materials are encountered. If contaminated materials or soils is encountered the client
will be notified immediately and any remediation will be the clients responsibility and at the clients cost.

4.

Right of Entry will be provided by the client and all locations must be able to be accessible to the vac truck prior to work
beginning. If access issues are encountered, SAM, LLC will notify the client immediately to determine alternatives for
accessing the required location and resolved in 24-hours. If unable to resolve access issues in 24-hours, Vac Crew may be
demobilized and require a remobilization fee to return to the site once access is established.

Travel:
Cost of mileage on company-owned vehicles, excluding vacuum excavation vehicle, is computed at the current I.R.S. mileage allowance.
Purchased Services:
All purchased services are invoiced at actual cost plus ten percent (10%) handling. These include but are not limited to reproduction, computer time,
long distance telephone, consultants, subcontract services, rented or leased equipment, expendable supplies, and project required special supplies.

Dear Sirs:
Corsair Consulting LLC proposes to provide geotechnical engineering design services as they relate to
pavement design, for the Posey Road Corridor study Phase 1 from Hunter Road to CR 266 located in
Hays County, TX. The following is our proposed scope of services:
Geotechnical Investigation:
A. Obtain and review existing and available geotechnical and geologic information. Perform
field reconnaissance of project limits. Attend coordination meeting.
B. Perform borings, obtaining a boring sample at approximately 500 foot intervals to a
proposed depth of 10 feet below existing grade. Borings are estimated to consist of the
following:

20 borings to a depth of 10 feet within the at-grade project limits.


Borings are to occur within the limits of the existing ROW, dependent upon utilities and
access.

Deliverables:
1) Draft report for review by Dannenbaum and the County
2) Address review comments and submit a final report.
3) Pavement design options:
a. Flexible base section
b. Full depth HMAC section
c. Optional widening and full depth repairs (if needed) and overlay of the existing
pavement
d. Temporary pavement section for traffic control
4) Life cycle and maintenance cost for all pavement design alternatives in the report.

Perform laboratory testing to classify soil strata, evaluate plasticity and shrink/swell potential and
evaluate the compressive strength. Tests may include moisture contents, atterberg limits, unconfined
compressive strengths, sieve analyses, absorption swell tests, lime-series tests, resilient modulus test
and sulfate content tests depending on our evaluation of the materials.

Develop a recommended pavement design following TxDOT methodology and prepare a Geotechnical
Report to include the summary of field investigations, laboratory testing results and recommended
pavement design.
Our anticipated schedule is as follows:
Commence field work 2-3 weeks from NTP
Duration of drilling 2-3 days
Soils classification and lab testing 6-8 weeks
Draft report 4 weeks from completion of field work
Final report 2 weeks after completion of lab testing

WHEREAS, the City of Wimberley applied for and received STP-M M funding from the Capital
Area M etropolitan Planning Organization (CAM PO) for engineering design and ROW purchases to
add turn lanes and pedestrian crossing at RM 12 and FM 3237; and
WHEREAS, the Hays County Commissioners Court approved an I LA (interlocal agreement) with
the City of Wimberley on M ay, 17, 2016 to undertake the design of improvements; and
WHEREAS, Hays County will enter into a Local Project Advance Funding Agreement (LPAFA)
with the Texas Department of Transportation (TxDOT) to secure the STP-M M funds awarded by
CAM PO for the project; and
WHEREAS, Hays County intends to procure consultant services to carry out the scope of services
outlined in the Local Project Advance Funding Agreement in accordance with established Hays
County procurement practices; and
NOW, THEREFORE, BE I T RESOLVED that the Hays County Commissioners Court authorizes
Hays County Judge Bert Cobb to execute a Local Project Advance Funding Agreement with
TxDOT for the proposed design services for RM 12 and FM 3237; and;
BE I T FURTHER RESOLVED that the Hays County Commissioners Court Directs Hays County
staff to continue with the procurement of professional consultant services upon signing the LPAFA
with TxDOT.

PROFESSIONAL SERVICES AGREEMENT


HAYS COUNTY, TEXAS
HAYS COUNTY, a political subdivision of the State of Texas
(hereinafter the County) with administrative offices at 111 E.
San Antonio, Suite 300, San Marcos, Texas 78666, and Lockwood,
Andrews & Newnam, Inc. hereinafter Contractor), whose primary
place of business is located at 2925 Briarpark Drive, Suite 400,
Houston, TX 77042, hereby enter into this Professional Services
Agreement (hereinafter Agreement) effective the ___ day of
_________, 201_ (hereinafter Effective Date). The County and
Contractor (collectively the parties to this Agreement or the
parties) agree as follows:
1. OVERVIEW
Contractor has been requested by the County to perform
professional engineering services related to Hog Creek Drainage
Improvements Preliminary Engineering Analysis.
2. SERVICES
Contractor agrees to perform services for the County in
accordance with the Countys instructions and, in particular,
the instructions of _______________ and/or legal counsel for the
Hays County Commissioners Court; and in conformance with the
descriptions, definitions, terms, and conditions of this
Agreement.
The Scope of Services shall be limited to those
services and terms attached hereto as Exhibit A, and any
subsections of Exhibit A, if as and when they are attached
hereto and signed by the parties (collectively the Work). If
the parties to this Agreement amend the Work required under this
Agreement (by adding or removing specific services and/or terms
enumerated in Exhibits A and/or C), the Compensation cited
in Section 5 of this Agreement may also be amended to conform
with the change in Scope of Services, as agreed by the parties.
3. ADDITIONAL TERMS
Additional Terms and Obligations of the parties to this
Agreement, if any, are stated in Exhibit C, attached hereto.
4. DURATION
The parties agree that the Work shall be completed Ninety Days
(90) days after commencement date. (hereinafter the Completion
Date). In the event that Contractor is unable to complete the

5. COMPENSATION
Contractor will be compensated for the Work on an hourly-charge
basis, the terms of which are cited in Contractors rate
schedule, which is attached hereto as Exhibit B. Despite any
reference to Contractors rate schedule, which shall be used to
calculate monthly invoice amounts under this Agreement or a
change in the Scope of Services (i.e. Amendment), the parties
agree that the County shall pay Contractor a total fee not to
exceed Fifty-two Thousand, Seven Hundred and Forty dollars
($52,740 USD) for the Work under this Agreement.
6. PAYMENT
Contractor shall invoice the County for the Work performed under
this Agreement on a monthly basis, beginning at the end of the
first full month following the Effective Date.
The County
agrees to promptly pay all invoices by sending payment to
Contractors address stated in Section 8, below.
The County
shall owe Contractor an additional one percent (1%) per month on
any unpaid balance, beginning at the end of the first full month
following the Countys receipt of said invoice(s) and accruing
monthly thereafter.
7. NOTICE OF COMPLETION
Upon completion of the Work, Contractor shall send a Notice of
Completion to the County in writing, and the County shall have
the option to inspect the Work (or the product thereof) before
it is considered complete under this Agreement.
If the County
is satisfied that the Work under this Agreement is complete, the
County shall send Contractor an Acceptance of Completion in
writing.
If, after inspection, the County does not agree that
the Work is complete or believes that the Work is of deficient
quality, the County shall send Contractor a Deficiency Letter,
stating the specific aspects of the Work that are incomplete
and/or deficient.
If, after ten (10) business days from the
Countys receipt of Contractors Notice of Completion, the
County does not send Contractor either an Acceptance of
Completion or a Deficiency Letter, the Work under this Agreement
shall be considered complete.
8. NOTICE (GENERAL)

9. INSURANCE
Contractor agrees that, during the performance of all terms and
conditions of this Agreement, from the Effective Date until the
Countys acceptance of Contractors Notice of Completion or
until this Agreement is otherwise considered completed as a
matter of law, Contractor shall maintain Commercial General
Liability insurance that meets or exceeds the industry standard
for professional services providers in Contractors field of
employment and for the type of services that are being performed
by Contractor under this Agreement.
10. MUTUAL INDEMNITY
Contractor agrees, to the fullest extent permitted by law, to
indemnify and hold harmless the County, its officers, directors
and employees against all damages, liabilities or costs,
including reasonable attorneys' fees and defense costs, to the
extent caused by Contractors negligent performance of the Work
under this Agreement and that of its subcontractors or anyone
for whom the Consultant is responsible or legally liable.
The County agrees, to the fullest extent permitted by law, to
indemnify and hold harmless Contractor, its officers, directors,
employees and subcontractors against all damages, liabilities or
costs, including reasonable attorneys' fees and defense costs,
to the extent caused by the County's negligent acts in
connection with this Agreement.
Neither the County nor Contractor shall be obligated to
indemnify the other party in any manner whatsoever for the other
party's negligence.
11. COMPLIANCE WITH LAWS
Each party agrees to comply with all laws, regulations, rules,
and ordinances applicable to this Agreement and/or applicable to
the parties performing the terms and conditions of this
Agreement.
12. SURVIVAL
Notwithstanding any termination of this Agreement, the following

Sections, and the terms and conditions contained therein, shall


remain in effect: 3, 5, 8, 10, 12, 14, 15, 16, 17, 18, 20, 21
and 22.
13. FORCE MAJEURE
Either of the parties to this Agreement shall be excused from
any delays and/or failures in the performance of the terms and
conditions of this agreement, to the extent that such delays
and/or failures result from causes beyond the delaying/failing
partys reasonable control, including but not limited to Acts of
God, Forces of Nature, Civil Riot or Unrest, and Governmental
Action that was unforeseeable by all parties at the time of the
execution of this Agreement. Any delaying/failing party shall,
with all reasonable diligence, attempt to remedy the cause of
delay and/or failure and shall recommence all remaining duties
under this Agreement within a reasonable time of such remedy.
14. SEVERABILITY
If any Section or provision of this Agreement is held to be
invalid or void, the other Sections and provisions of this
Agreement shall remain in full force and effect to the greatest
extent as is possible, and all remaining Sections or provisions
of this Agreement shall be construed so that they are as
consistent with the parties intents as possible.
15. MULTIPLE COUNTERPARTS
This Agreement may be executed in several counterparts, all of
which taken together shall constitute one single Agreement
between the parties.
16. SECTION HEADINGS, EXHIBITS
The Section and Subsection headings of this Agreement, as well
as Section 1, Entitled Overview, shall not enter in the
interpretation of the terms and conditions contained herein, as
those portions of the Agreement are included merely for
organization and ease of review.
The Exhibit(s) that may be
referred to herein and may be attached hereto, are incorporated
herein to the same extent as if fully set forth herein.
17. WAIVER BY PARTY
Unless otherwise provided in writing by the waiving party, a
waiver by either of the parties to this Agreement of any
covenant, term, condition, agreement, right, or duty that arises
under this Agreement shall be considered a one-time waiver and
shall not be construed to be a waiver of any succeeding breach
thereof or any other covenant, term, condition, agreement,
right, or duty that arises under this Agreement.

18. GOVERNING LAW AND VENUE


THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE
WITH THE LAWS OF THE STATE OF TEXAS.
Any lawsuit, claim, or
action, whether in law or in equity, arising from this Agreement
will be brought in Hays County, Texas.
19. ASSIGNMENT
Neither party to this Agreement may assign it duties, interests,
rights, benefits and/or obligations under this Agreement, in
whole or in part, without the other partys prior written
consent thereto.
20. BINDING EFFECT
Subject to any provisions hereof restricting assignment, this
Agreement shall be binding upon and shall inure to the benefit
of the parties hereto, and their respective successors,
permitted assigns, heirs, executors, and/or administrators.
21. ENTIRE AGREEMENT; AMENDMENT
This Agreement (including any and all Exhibits attached hereto)
constitutes the entire agreement between the parties hereto with
respect to the subject matter hereof.
Any amendments to this
Agreement must be made in writing and signed by the parties to
this Agreement prior to the performance of any terms or
conditions contained in said amendments.
22. WORK PRODUCT
Any and all product, whether in the form of calculations,
letters, findings, opinions, or the like, shall be the property
of Hays County during and after performance of the Work.
Contractor shall have a right to retain a copy of all Work
product for record-keeping purposes.
23. TERMINATION BY COUNTY
This Agreement may be terminated by Hays County, for any reason
whatsoever, by providing thirty (30) days written notice to
Contractor. Any approved services provided under this Agreement
up to the date of termination may be invoiced by Contractor
after the termination date, and payment of said invoice shall
not be unreasonably withheld by the County.

EXHIBIT A
Scope of Work
Purpose:
Hays County has requested that LAN conduct a preliminary drainage analysis to determine the
feasibility of the design and construction of a large regional detention pond to mitigate the
potential for structural flooding along Hog Creek within and adjacent to the City of Woodcreek.
Due to the anticipated size of the pond, it is expected that the proposed structure will be
classified and regulated as a Dam thus triggering TCEQ regulatory design and maintenance
guidelines. The purpose of this project will be to determine the preliminary hydrologic and
hydraulic sizing of the dam, potential permitting associated with construction, potential for state
and federal grant funding opportunities, and recommendations for moving forward with design.
Scope of Work:
1. Project Management
a. General project management will be ongoing through the period of the contract
and include items such as participation in the development of a Project
Management Plan, developing and updating the project schedule, preparing
contract correspondence, transmitting deliverables, documenting the quality
control process, and other project oversight activities.
b. Working meetings with County staff shall be held to discuss study related issues,
review the progress of the work effort, or to address issues which may arise. The
Engineer shall prepare and deliver meeting minutes to the County within five (5)
working days after each meeting. Monthly meetings with County Staff are
anticipated, in addition to as-needed conference calls for the duration of the
project. A total of six (3) meetings is anticipated.
c. Quality Control Plan - LAN prepares Project Work Plans for all projects. As part
of this, a detailed Quality Control Plan will be established that will outline how all
QA/QC procedures will be completed during project execution. At a minimum,
this will include scheduled reviews of all deliverables, detailed project scheduling,
and assigned Quality managers assigned to the various tasks.
2. Data Collection
a. Document Collection - LAN will collect, review and organize the relevant
information related to storm water in the Hog Creek region. This will include but
not be limited to LiDAR information, existing conditions FEMA models, most
current USACE/GBRA studies & models, and other relevant GIS information.
b. Site visits will be performed to visually inspect specific problem areas and
drainage features identified in the initial review and data collection. LAN will
document the site visit with field observation reports and organized photos.
c. Field Survey - It is not anticipated that detailed field survey will be necessary for
this preliminary analysis. If determined it is needed it will be considered
additional services outside of this agreement.
3. Hydrologic Analysis
a. Utilizing the USACE/GBRA hydrologic model (HEC-HMS), confirm and update
basin parameters to be site specific for the proposed analysis.
b. Utilizing the updated USACE/GBRA hydrologic model, compute flow rates for a
range of flood frequencies including the 10%, 4%, 2%, and 1 % events.

c. Utilizing the updated USACE/GBRA hydrologic models compute flow rates for
the Probable Maximum Flood (PMF).
d. Simulate proposed regional detention pond (dam) to preliminarily size spillways,
embankment, and inundation limits to meet TCEQ Dam Safety regulations.
4. Hydraulic Analysis
a. Build HEC-RAS model for Hog Creek utilizing HEC-HMS peak flowrates for
existing conditions.
b. Utilize HEC-RAS model to simulate proposed conditions (with pond) utilizing
peak flowrates from proposed HEC-HMS model.
c. Utilize HEC-RAS models to compute flood profiles for a range of flood
frequencies including the 10%, 4%, 2%, and 1% events for both existing and
proposed conditions.
d. Assess potential structures to be removed from 1% flood event.
e. Evaluate and minimize upstream and downstream impacts in proposed conditions.
f. Evaluate and maximize potential for flood reduction to Cypress Creek in proposed
conditions.
5. Dam Constructability Review
LAN will conduct preliminary assessments to determine what will be required to ensure
that the proposed construction will comply will all relevant regulatory agencies as well as
other potential engineering and land acquisition design requirements. Each of the
following anticipated requirements will be documented in the Preliminary Engineering
Report:
a. TCEQ Dam Safety Requirements
b. Geotechnical Engineering Requirements
c. Environmental Impacts Assessment
i. Texas Parks & Wildlife Requirements
ii. USACE ordinary high water mark regulations
d. FEMA Requirements
e. Potential Right-of-Way Assessment
6. Preliminary Engineering Report
a. Meet with County staff to discuss results preliminary engineering analysis.
b. Develop flood mitigation options for the 1% flood event that will satisfy all TCEQ
dam requirements (passing 75% PMF).
c. Documentation of Dam Constructability Review.
d. Prepare opinion of probable cost for preliminary dam design.
e. Quantify benefits based on preliminary proposed design.
f. Recommendations on potential for federal or state funding based on the
benefit/cost analysis.
g. Develop report that summarizes H&H analysis results, costs, impacts, benefits,
potential funding sources, and final recommendations as to next steps on the
potential flood mitigation project.
Deliverables:
1. Hydrologic models and hydraulic models
2. Preliminary Engineering Report that details the methodologies, assumptions, and results
of the analysis, as well as recommendations and next steps based on project feasibility.
