Davison County felony court for Jan. 6

Among the cases heard, a Mitchell man was sentenced to five years in prison, with one year suspended, after violating probation for grand theft by being terminated from Drug and DUI court

MITCHELL — The following cases were among those heard Monday, Jan. 6, during a circuit court session at the Davison County Public Safety Center, with Judge Chris Giles presiding:

  • Michone Collins, 64, of Stickney, failed to appear in court on several drug-related charges. These included possession of drug paraphernalia, failure to renew registration during the designated month and smoking or consuming marijuana by operator of vehicle, all of which are Class 2 misdemeanors. Additionally, Collins faces Class 1 misdemeanor charges for possession of two ounces or less of marijuana and first-offense driving under the influence (DUI). Other charges include possession of a Schedule III or IV controlled substance, a Class 6 felony and possession of a Schedule I or II controlled substance, a Class 5 felony. The court issued a $500 bench warrant. 
  • Edgar Lopez, 19, of Mitchell, had his bond forfeited after failing to appear in court on Monday. Lopez is facing charges of domestic abuse simple assault, a Class 1 misdemeanor, as well as five counts of fourth-degree rape.
  • Askari Goss, 29, of Tacoma, Washington, had his attorney serve as his power of attorney and pleaded guilty to possession of two ounces or less of marijuana, a Class 1 misdemeanor. As part of a plea agreement, several other charges were dismissed, including Class 2 misdemeanor charges for possession of drug paraphernalia and littering, as well as another Class 1 misdemeanor charge for obstructing police. Additionally, charges for possession of one-half to one pound of marijuana and possession of a controlled substance were dismissed. Goss was fined $350 and granted an imposition of sentence. 
  • Gavin Spradlin, 22, of Tacoma, Washington, had his attorney act as his power of attorney and pleaded guilty to possession of two ounces or less of marijuana, a Class 1 misdemeanor. As part of a plea agreement, multiple other charges were dismissed, including a Class 2 misdemeanor for possession of drug paraphernalia, along with two Class 6 felonies for possession of between two ounces and one-half pound of marijuana and possession of a controlled substance. Spradlin was fined $350 and granted an imposition of sentence. 
  • Timothy Latham, 46, of Portland, Oregon, forfeited his bond after failing to appear in court on Monday. Latham is facing charges of driving with a suspended license, a Class 2 misdemeanor; first-offense DUI and  hit and run, both Class 1 misdemeanors; and second-degree eluding, a Class 6 felony. 
  • Kyle Long Crow, 35, of Sioux Falls, was assigned a court-appointed attorney and the case was continued. Long Crow is facing a probation violation charge. 
  • Derek Schleder, 47, of Mitchell, appeared in court and admitted to a probation violation charge. Schleder had been serving probation for a grand theft conviction. He began the James Valley Drug and DUI court program last October, but was terminated from it in December. Schleder was sentenced to five years in the state penitentiary, with one year suspended, and received credit for 84 days already served. 
  • Jazlyn Anderson, 24, of Mitchell, pleaded not guilty to multiple drug-related charges, including possession of a controlled substance (Clonazepam), a Class 6 felony, possession of a controlled substance (marijuana wax), a Class 5 felony. Additional charges included possession of drug paraphernalia, a Class 2 misdemeanor, and possession of 2 ounces or less of marijuana, a Class 1 misdemeanor. A jury trial is scheduled for March. 
  • Isaias Lucas Niz, 23, of Plankinton, pleaded guilty to a first-offense DUI, a Class 2 misdemeanor and abuse or cruelty to a minor under the age of seven, a Class 3 felony. As part of a plea agreement, a Class 2 misdemeanor charge for driving without a license was dismissed. According to court documents, Niz was stopped while driving intoxicated with a female passenger holding a 1.5-year-old child who was not properly restrained. Niz was sentenced to 31 days in jail, with 30 days suspended, and received credit for one day already served. Niz was also fined $350. 
  • Sergio Lopez, 18, of Sioux Falls, pleaded not guilty to multiple charges, including possession of drug paraphernalia and possession of alcohol by a minor, both Class 2 misdemeanors; intentional damage to property valued between $400 and $1,000 and obstructing police, both Class 1 misdemeanors; and first-degree burglary, a Class 2 felony. His bond was set at $5,000, and a request for a personal recognizance bond was denied. A jury trial is scheduled for March. 
  • Ashley Jenson, 41, of Mitchell, pleaded not guilty to possession of drug paraphernalia, a Class 2 misdemeanor; false reporting to authorities, a Class 1 misdemeanor; and possession of a controlled substance (methamphetamine), a Class 5 felony. Jenson was granted a PR bond. A jury trial is scheduled for March. 
  • Majda Korkutovic, 32, of Letcher, had a status hearing regarding charges she is facing which include unauthorized ingestion of a controlled substance, a Class 5 felony and second-degree burglary, a Class 3 felony. Korkutovic is currently undergoing treatment in Yankton. The case was continued to allow her to complete her treatment program. 
  • Cleveland Skunk, 33, of Mitchell, was assigned a new court-appointed attorney, and the case was continued. Skunk is facing charges of domestic abuse simple assault, a Class 1 misdemeanor, and a third-offense domestic abuse simple assault, a Class 6 felony. 
  • Millie Miller, 47, of Mitchell, pleaded not guilty to multiple charges, including possession of drug paraphernalia, having an open container and driving with a suspended license, all Class 2 misdemeanors; first-offense DUI, a Class 1 misdemeanor; and possession of a controlled substance (meth), a Class 5 felony. Miller was granted a furlough from the 24/7 program to attend treatment at IRecover. A jury trial is scheduled for March. 
  • Matthew Wegner, 42, of Mitchell, pleaded not guilty to multiple charges, including reckless use of a weapon and possession of a loaded firearm while intoxicated, both Class 1 misdemeanors, and two counts of aggravated assault with a dangerous/deadly weapon, Class 3 felonies. The court denied Wegner’s request to be removed from the 24/7 sobriety program. According to court documents, Wegner was initially assaulted by the victim in his backyard. In response, Wegner retrieved a pistol from his residence and used it to strike the victim repeatedly. He hit the victim’s face with the butt of the pistol, knocking the victim out of his shoes. Wegner grabbed the victim’s shirt, lifted his head and struck him multiple times with the grip end of the pistol, causing the victim’s head to hit the ground. During the altercation, the pistol discharged. The victim sustained a broken nose and bone injuries to both eye sockets. A jury trial is scheduled for March.  
  • Tyler Fernau, 35, of Mitchell, pleaded not guilty to charges of domestic abuse simple assault and reckless driving, both Class 1 misdemeanors, as well as second-degree kidnapping, a Class 3 felony. Fernau’s bond was reduced from $25,000 to $15,000, but his request for work release was denied. A jury trial is scheduled for March. 
  • Robert Martin, 30, of Mitchell, was assigned a new court-appointed attorney, and his case was continued. Martin faces multiple charges, including two counts of second-degree petty theft for amounts under $400, both Class 2 misdemeanors; third-degree burglary and possession of a controlled substance (meth), both Class 5 felonies; and second-degree eluding and identity theft, both Class 6 felonies. According to court documents, Martin stole $140 from the Freedom Valu Center at 504 S. Sanborn Blvd., and also stole a wallet, using the debit card inside to withdraw $100 from an ATM.  
  • Wetu Kiyukan, 29, of Mitchell, pleaded guilty to distribution of meth, a Class 4 felony. As part of a plea agreement, two additional charges, distribution of drugs in a drug-free zone, a Class 4 felony, and possession of methamphetamine, a Class 5 felony, were dismissed. The court ordered a pre-sentencing report and denied a bond modification. Kiyukan is also undergoing a treatment needs assessment. She will be sentenced later this month. 
  • Aria Uthe, 27, of Sioux Falls, had her lawyer present to request a furlough for treatment at HSC, which the court granted. Uthe is facing a probation violation. She was serving probation for possession of meth.
