Google Workspace Labs for Business Terms of Service

Customer agrees that its and its participating End Users’ use of Google Workspace Labs is subject to the Agreement, including Section 6 (Pre-GA Offerings Terms) of the
Google Workspace Service Specific Terms , as such section is amended by these Google Workspace Labs Terms of Service (the “Labs Terms”). -
These Labs Terms amend Section 6.1 (Access to and use of Pre-GA Offerings) of the Google Workspace Service Specific Terms in relation to Workspace Labs as follows:

These Labs Terms replace the first paragraph of Section 6.1(b) with the following:

6.1(b) Use of customer data.

Subject to the remainder of this Section 6.1, Customer instructs Google to process Customer Data (which will be deemed to include, but not be limited to, data submitted, stored, sent or received via any Pre-GA Offerings by the Customer or its participating End Users) in accordance with the Agreement (including the Service Specific Terms and these Labs Terms), as follows:

(i) to provide, secure, monitor, test and analyze the Pre-GA Offerings (including generating content requested by Customer or those its End Users via the functionality of the Pre-GA Offerings);

(ii) as further specified via Customer's and its participating End Users' use of the Pre-GA Offerings (including their features and functionality) and any related TSS; and
-
(iii) to aggregate and/or pseudonymize it to the extent reasonably practicable and to use such aggregated and/or pseudonymized Customer Data to improve and develop the Pre-GA Offerings and any Google Workspace services, unless Customer opts out of the instruction specified under this subsection (iii) by
turning off Google Workspace Labs customer data use for product improvement for your organization .

For clarity:

(i) Customer Data as referred to above may include Customer Personal Data and content generated by Customer and its End Users via the functionality of the Pre-GA Offerings;

(ii) if Customer opts out of use of its Customer Data for product improvement and development purposes as described above, the opt-out will not apply to Customer Data submitted, stored, sent, received or processed via the Pre-GA Offerings before such date; and
-
(iii) Customer acknowledges that it is responsible under the Agreement for any consents and notices required to permit Google's processing of Customer Data as described in this Section 6.1(b)above.

These Labs Terms further amend Section 6.1 (Access to and use of Pre-GA Offerings) of the Google Workspace Service Specific Terms by deeming all references to “Customer Test Data” in Sections 6.1(b)(i) to (iii) and 6.1(c) to be replaced with references to”Customer Data”.

These Labs Terms also add the following restrictions and disclaimers applicable in relation to Workspace Labs:

(a) Customer must comply, and ensure that its participating Administrators and End Users comply, with the
Prohibited Use Policy . -
(b) Workspace Labs features include safety features designed to block harmful content, such as content that violates the Prohibited Use Policy. Customer must not, and ensure that its participating Administrators and End Users do not, attempt to bypass these safety measures or generate or use content that violates these Labs Terms, including the
Prohibited Use Policy . -
(c) Administrators and End Users must be 18 years of age or older to participate in Workspace Labs, and Customer must ensure that no Administrators or End Users younger than 18 years of age access or use Workspace Labs.

(d) Customer acknowledges that Google Workspace Labs features are experimental technology and may generate or display (i) information or content (i.e. Customer Data) that has been submitted, stored, sent or received by End Users via the Pre-GA Offerings or other Google Workspace services; (ii) inaccurate, offensive, or inappropriate information or content; or (iii) information or content that doesn’t represent Google’s views.

(e) Subject to subsection (f) below, Customer must use, and ensure that its participating End Users use, discretion before relying on, publishing, or otherwise using content provided by Workspace Labs features.

(f) Customer may not, and must ensure that its participating End Users do not, rely on responses generated by Workspace Labs features as medical, legal, financial, or other professional advice. Any content regarding those topics is provided for informational purposes only and is not a substitute for advice from a qualified professional. Content does not constitute medical treatment or diagnosis.

If Google believes that Customer or any of its End Users has violated these Labs Terms, Customer or its End Users may be suspended from participation in Google Workspace Labs. If Customer believes that its or any End User’s participation has been incorrectly suspended, Customer can contact Google at
