Handling disputes in Scotland: a very short history of Scots Law
The unique history of the Scottish legal system means there are significant differences between the systems north and south of the border. In this video, Elaine Brailsford provides a (very short) history of Scots Law as part of our handling disputes in Scotland series.
Knowledge of the courts and the rules they apply is essential to what we do at Shepherd and Wedderburn. The work we do ranges from advising our clients on what is likely to happen if they take a certain course of action, assessing the prospects of their case, negotiating a solution on their behalf and/or representing them in formal mediation, court or arbitration proceedings.

Scotland's 'not proven' verdict to be scrapped in justice reforms
The bill to scrap Scotland's controversial "not proven" verdict and make changes to the nation's justice system has been published.
The Victims, Witnesses and Justice Reform (Scotland) Bill also proposes to reduce the size of criminal juries from 15 to 12.
It aims to address a number of issues around serious sexual offences, creating a new specialist sexual offences court.

We work in all of the courts in Scotland, appearing ourselves in the Sheriff Courts, instructing Advocates and our own Solicitor Advocates to appear in the Court of Session and appearing
in the Scottish Land Court and Lands Tribunal for Scotland. The majority of our clients’ disputes are heard by the Court of Session and so we focus in this guide on Court of Session procedure
and in particular on Commercial Actions.
Having in-house Solicitor Advocates (who have rights of audience in our higher courts) as well as an excellent working relationship with the Scottish Bar, and knowing which Advocate to instruct for which piece of work, means optimum representation for our clients.

Megan Clubb
Megan joined Brodies in January 2023 following completion of her traineeship with a large national firm, and prior role as a paralegal, working on behalf of lenders.
Megan understands the regulatory pressures and restrictions lenders are faced with, along with their need to ensure customers are always treated fairly. The skills Megan gained as a litigator allow her to successfully engage with both lenders and borrowers during the transactional process while ensuring the transaction runs as smoothly as possible for all parties involved.

Agreement on an offer for property purchase is a legally binding contract, resulting in a system of conveyancing where buyers get their survey done before making a bid to the seller's solicitor, and after a closing date for bids the seller's acceptance is binding on both parties, preventing gazumping. In recent times sales of house by way of offering to sell to the first party to make an unconditional offer of a fixed price has eroded the traditional offers over system. It is important historically because the feu was first created in Scotland, which is an antecedent of the fee system, used in conveyancing throughout the common law system.
