In Manego versus Orleans Board of Trade, after losing on a civil rights claim, a plaintiff repackages the facts to state an antitrust theory. Will res judicata kick the claim out of court?
Isaac Manego applied for liquor and entertainment licenses to open a disco in Orleans, Massachusetts, a small town on Cape Cod. Just a few hundred feet from the disco’s proposed location, children and families frequented an ice-skating rink.
Following a mortgage foreclosure, the rink was owned and operated by a bank. The bank’s vice president David Willard served as general manager of the rink. Willard and the bank opposed Manego’s disco, citing concerns about alcohol service and traffic risks in such close proximity to the families at the rink. The rink also planned to expand its entertainment offerings to include roller skating, dancing with live music, and soft drinks.
Outside the bank, Willard served as president of the Orleans Board of Trade, which functioned as the town’s chamber of commerce. Willard and the Board of Trade vehemently opposed the disco at hearings held by the Board of Selectmen. The selectmen denied Manego’s application for the liquor and entertainment licenses. However, a short time later, the rink, which had been sold to Paul Thibert, applied for an entertainment license. The selectmen approved the license.
Manego sought relief in state court, alleging that the selectmen denied the licenses because of Manego’s race. The state court dismissed the suit.
Manego filed a second suit in federal court claiming that the selectmen, the bank, and Willard conspired to deny him the licenses in violation of several civil rights laws. The district court dismissed the claims. The First Circuit affirmed, noting no evidence proved that racial animus motivated the denial of the licenses.
Manego filed a third suit in federal district court. This time he claimed that the Board of Trade, the bank, and Willard conspired to deny him the licenses in violation of antitrust law, alleging that the rink and disco would be offering similar entertainment and vying for the same customers. The defendants sought dismissal, arguing the claims were barred by res judicata. The district court dismissed the claims. Manego appealed to the First Circuit.
