The Limitation Act 1963 (1963 c.47) was an Act of the Parliament of the United Kingdom that amended the statute of limitations to allow actions in some cases where the injured party had not discovered the injury until after the standard date of expiration. The Act was based on the report of the Davies Committee on Limitation of Actions in Cases of Personal Injury, created after the Court of Appeal decision in the case of Cartledge v Jopling, and the Committee notably produced their final report before Cartledge had been heard in the House of Lords. The draft bill was presented to Parliament on 6 May 1963; it was given the Royal Assent on 31 July and came into force on the same day.
The act allowed an injured party to bring a claim outside the normal statute of limitations period if he could show that he was not aware of the injuries himself until after the limitation period had expired and if he gained the permission of the court. After a series of problems emerged, including vagueness on a point even the House of Lords was unable to clarify and poor draftsmanship, the Act was repealed bit by bit during the 1970s, with the Limitation Act 1980 scrapping the last remaining sections.
The Limitation Act 1939 (2 & 3 Geo.6 c.21) was an Act of the Parliament of the United Kingdom that simplified the law relating to limitation periods in England & Wales. The Act was based on the fifth report of the Law Revision Committee and is divided into 3 parts, with Part I dealing with limitation periods, Part II dealing with exceptions and Part III dealing with general matters.
Section 2 of Part I introduces a new limitation period; six years for all cases in tort and contract. The period runs from the point where the injury or problem was created, not from when it was discovered; thus, the Act replicates problems later solved by the Limitation Act 1963. Part II allows for a "resetting" of the limitation period in situations where the party is insane, not a legal adult or imprisoned for either the death penalty or for penal servitude.
The Limitation Act 1980 (c. 58) is a British Act of Parliament applicable only to England and Wales. It is a statute of limitations which provides timescales within which action may be taken (by issuing a claim form) for breaches of the law. For example it provides that breaches of an ordinary contract are actionable for six years after the event whereas breaches of a deed are actionable for twelve years after the event. In most cases, after the expiry of the time periods specified in the Act the remedies available for breaches are extinguished and no action may be taken in the courts in respect of those breaches.
Summary of time limits
The ordinary time limits allowed by the act are set out below. These limits may, in some cases, be extended or altered. Most of the time limits run from the day after the accrual of action, which is "the earliest time at which an action could be brought". If the potential claimant was not at least 18 or did not have a sound mind at the time of the accrual of action, time will not run until he is at least 18 and has sound mind. Where there has been fraud or concealment, or the action is for relief from the consequences of a mistake, time will not run until the fraud, concealment or mistake is discovered or could with reasonable diligence be discovered.
