What is legal capacity?
This video will cover the topic of legal capacity and explain what our approach to determining legal capacity is and let you know what we do to make sure our clients understand the work we are doing - even when capacity is not an issue.
The legal meaning of capacity, put simply, is a person’s ability to enter into binding agreements (like contracts) or make other legal decisions (eg, like deciding to sue someone or a company).
As a starting point, if you are over the age of 18 you have the capacity to make legal decisions. Some such decisions will be obviously legal in nature, like commencing legal proceedings or entering into a contract, and others will be less obviously legal, like getting married or opening a bank account.

Legal Capacity in Contract Law • Can Minors Enter Into Contracts?
The basic presumption in contract law is that anybody can enter into a contract. However, certain individuals may not have the ability to fully understand the nature of their obligations that flow from a contract.
Therefore, the law protects certain societal groups by avoiding situations where they become bound by contract. This is the issue of legal capacity.

This video will cover the topic of legal capacity and explain what our approach to determining legal capacity is and let you know what we do to make sure our clients understand the work we are doing - even when capacity is not an issue.
The legal meaning of capacity, put simply, is a person’s ability to enter into binding agreements (like contracts) or make other legal decisions (eg, like deciding to sue someone or a company).
As a starting point, if you are over the age of 18 you have the capacity to make legal decisions. Some such decisions will be obviously legal in nature, like commencing legal proceedings or entering into a contract, and others will be less obviously legal, like getting married or opening a bank account.
When people do not have legal capacity, we are not able to take instructions from them and we must wait until someone is appointed to be their legal representative (via a Power of Attorney or court order) before we can help them. The person that is appointed is usually a loved one. However, it can also any person that is qualified to help or even an organisation (eg, State Trustees)
Many people will have legal capacity, but still have trouble understanding legal processes and the work that we do for them. We see our role as lawyers and advocates, as not only making sure that we get great our outcomes for our clients, but also to make sure that we explain (and our clients understand) the work which we are doing for them.
When is making sure a person has capacity important?
We will ordinarily assume that capacity is present unless circumstances are present to indicate it may not be.
Those circumstances may be:
• the diagnosis of an illness which impacts on your cognitive capacity (your ability to think and understand)- eg, Dementia, Alzheimer’s, mental health, drug use or addiction;
• difficulties understanding verbal English;
• difficulties understanding written English;
• intellectual disability; and
• many others.
Importantly, the test relates to your capacity to understand the consequences of your decisions and lawyers (and others) are not allowed to impose their own values and judgements onto your decisions.
Why is capacity or understanding important to us?
There are serious legal consequences for us if we take instructions from you and you do not have legal capacity to understand those decisions.
Perhaps most importantly, we strive to ensure that our clients understand the work we are doing for them, and are up to date with the progress we are making on their claims.
This includes:
a) that you are cognitively able to understand the implications of work we are doing (you have capacity); and
b) importantly, we carefully explain the work we are doing for you in a way that you understand.
What is out approach to making sure our clients understand?
We understand that each of our clients has different factors which decide their ability to understand the work we are doing. For example, some people experience difficulties for some of the following reasons:
• First time users and the use of jargon – we will not use jargon;
• Older people;
• Younger people;
• Different cultures;
• Different languages – the need for interpreters;
• Illnesses/injuries which impact on cognitive capacity (eg, a brain injury);
• No telephone;
• Requiring in-person contact only;
• Unable to visit for in-person meetings;
• Flexibility issues;
• Need contact with the support of someone else – alternative contacts and emergency contacts;
• Informal instructions or via a Power of Attorney;
• Prison clients and associated complexities;
• Requiring simple language, no jargon, no acronyms;
When is it most important that we make sure that you have capacity and understand?
Determining legal capacity is particularly important for people with illnesses such as:
• Alzheimer’s Disease;
• Schizophrenia;
• PTSD;
• BPD;
• Brain injury.
All the above illnesses may mean a lack of capacity now or future capacity issues. You may:
• develop capacity issues; and/or
• have temporary issues understanding the work we are doing; and/or
• have lost capacity at the time we start working with you.
We will always have frank conversations with you or your support person(s) to work out any capacity and communication issues.
We have formal steps to put in place safeguards around capacity, like suggesting that you nominate someone in an official capacity to help you with your claim.
Doctors are always an important part of the work we do on TPD and other insurance claims, but they become particularly important when issues of capacity arise.
Ultimately, no matter what issues you may have understanding the work we are doing for you, the processes we are undertaking or the conversations (verbally and in writing) we are having with you at any time, we will strive to make sure we communicate with you in a way that understand.
